HomeMy Public PortalAbout1936_10_26 42 At a regular meeting of the Mayor and Town Council of the town of Lees- burg, in Virginia, held in the Council Chamber, in Leesburg, Virginia, on Monday, • October 26, 1936, at 7:30 P. M., there were present E. N. Bradfield, Mayor; Ros- coe B. Rhoads, Recorder; and Roy M. Flippo,. Herbert Howard, Lawrence S. Hutch- ison, Harry F. Newton, Louis C. Rollins and Joseph H. Turley, Councilmen. -The minuted^of the last meeting'were read, and approved, with correc • - tion, on motion of,Councilman Hutchison, duly seconded and carried, that a copy of the letter from the Recorder to the Board of Health, under date of October 5, 1936, be incorporated as a part of the minutes of the meeting. .The following bills were read, approved-and ordered paid:- • Neptune Meter Company, - $101.85. Neptune Meter Company, .18 -Rumsey Pump Corp.,- - - - - - 30.16 .Whitmore & Armfield, 67.00 Moore, Clemens & Co., 67.00 $266.19 Mr. Herbert J. Fry appeared before Council, and requested that a sewer -, be laid on East Loudoun Street, from East Fayette Street to near South Church Street; stating that adjacent property owners were willing to pay one-half of ' the cost of such a project. After some discussion, it was moved by Councilman Turley, duly seconded and unanimously carried, that a committee be appointed to ascertain the size of pipe, depth and direction, and whether rights of way could be procured gratis, and report back to the Council as soon as possible. The Mayor appointed Councilmen Rollins and Newton. Mr. Raymond Hough reported that one of the pumps used to pump water to the tank was in a very bad condition and was practically useless. He stated that it needed new connecting rod bearings, new drive shaft pinion gears, new piston pins and bearings and that the bearing boxes needed re-babbitting. On motion of Councilman Howard, duly seconded and carried, the Recorder was instructed to write • the Rumsey Pump Corp., and ascertain if the needed repairs could be supplied.. Mr. Harrison Williams again appeared before Council and requested that action be taken on the report of the Board of Health, which was ordered-laid on the table at the meeting of October 12, 1936, until this meeting. After quite some discussion - Council feeling that the report .did not contain sufficient in- formation for action - it was moved by Councilman Rollins, seconded by Council- man Howard, and carried, that the Board of Health issue a specific report on the sanitary conditions, therein and thereon, of the stable and yard owned by Miss Harriett Conrad, Miss Mary Conrad and Mr. Cuthbert Conrad, situated at $104 East • North Street, Leesburg, Virginia, and tenanted by Silas Randall, and that the Recorder convey, by letter, the wishes of the Council to said Board of Health, and that said Board report back as soon as possible. Those voting in favor of the motion were Councilmen Newton, elippo, Howard, Turley and Rollins. Council- man Hutchison did not vote. There being no further business, on motion, the Council adjourned. 1/0�YR. . 1 RECORDER. 43 At a regular meeting of the Mayor and Town Council of the town of Lees- burg, in Virginia, held in the douncil Chamber, in Leesburg, Virginia, on Monday, November 9, 1936, at 7:30 P. M., there were present E. N. Bradfield, Mayor; Ros- coe B. Rhoads, Recorder; and Roy M. Flippo, Herbert Howard, Lawrence S. Hutchi- son, Harry F. Newton, Louis C. Rollins and Joseph H. 'Purley, Councilmen. ' The minutes of the last meeting were read and approved. IDr. W. P. Bodmer appeared before Council and asked permission to extend . his show window twelve inches beyond the building line, while making improvements to the property of Mrs. W. C. Orr, on West Market Street. On motion of Council- man Murchison, seconded by Councilman Turley, and duly carried the request gas granted. Councilman Rollins did not vote on the motion. On motion of Councilman Hutchison, seconded by Councilman Newton, and unanimously carried, Dr. Bodmer was also granted permission to erect a sign over the sidewalk. Mayor Bradfield reported receipt of a check for :163.00 from the Board of Supervisors for mileage for out of town fire alarms for the months of July and ,. August, 1936, On motion of Councilman Howard, seconded by Councilman Newton, and unanimously carried, it was ordered that the check be turned over to the Town Treasurer to be deposited in a special account, known as the Town of Leesburg, Fire Equipment Bund. ._ Letters from the League of Virginia Municipalities were read to Coun- cil, again requesting that Leesburg join the league. Po action was taken. Councilman Turley reported progress with respect to the erection of a public toilet for the town. The following letter of resignation from the Board of Health was read Ito Council:- • Nov. 3, 1936. To the Mayor of Leesburg, • Leesburg, Va. • Dear Sir:- After reading a report of the proceedings of the Town Coun- cil as published in •the Times-Mirror of Oct. 29th, 1936, the Town Board of Health feels that it has been harshly and unjustly criti- • cized, especially by one member of Council. In order that the record might be straight the Board wishes to state the following: For some time it has been generally known that certain parties had petitioned Council to condemn and have re- moved a certain horse stable situated on the north side of North St. a few doors from King St. Council evidently did not care to assume this responsibility. Council therefore proceeded to authorize the Mayor to appoint a• Hoard of Health consisting of the three physicians of Leesburg. The members of this Board did not ask for appointment. The members of this Board feel that, if the above petition had not been presented to Council, no Board of Health would have been ap- pointed at this time. In spite of this feeling, the members of the I Board were willing to serve in any manner that would promote the wel- fare of the town. On Oct. 5, 1936, the Board received the following letter: Dr. John A. Gibson, Chairman, Board of Health, Leesburg, Va. . Dear Sirs:- At the regular meeting of the Mayor and Town Council of the town of Leesburg, in Virginia, held Monday, Sept. 28, 1936, it was petitioned to abate an alleged nuisance, in the form of a stable, situated on the Northside of East Market Street, Lees- burg, Va. 44 On motion, duly seconded and carried, it was directed that the aforesaid petition be referred to the Board of Health, and that said Board.report back at the next meeting of Council. • You will, therefore, please have your.Board inspect the premises and report back as directed. Sincerely yours, Roscoe B. Rhodes, Recorder In conformity with this request, the Board made a report to Coun- • oil at their next meeting. In this report, the Board stated that it felt it unjust to single out and condemn one stable. It felt that all stables were a menace to health and that if one stable should go, all should go. Now let usreturn, for a moment, to the above letter. You will note that the stable is described as "situated on the Northside of East Market St." From this description it would be rather difficult. to .lo- cate the stable in question. One member of Council aecuses the Board of being "evasive". This Board would like to know who was "evasive" in the above letter. However, this Board did not publicly criticize and proclaim that Council was "evasive." It simply, in their effort to co-operate, put two and two together, used a small amount of Horse Sense, and assumed that the stable in question was the same one that certain parties had petitioned Council to condemn. • One Councilman states: "They (the Health Board) want us to pull their coal out of the fire." "This is a kickback." This Board re • - spectfully submits that it has no coals to be pulled out of any fire. On the other hand, Council had a very hot coal which it wished to be "pulled out of the fire." This Board wanted, and endeavored, to as- 111 sist Council in this matter. It must be remembered that the Board of Health has no police powers or powers to pass ordinances. This is the province of Council, The Board can act only in an advisory ca- pacity, but seems to have received nothing but abuse. If Council will inform itsself it will find that there are ample statues under which it can act in the above matter. It is strictly up to Council. When this Board was appointed it had every desire to work with and assist Council in any manner possible for the betterment of the town. It did not expect, and does not have to submit to, tirades and abuse from any member of Council. • If this certain Councilman has been incorrectly quoted in the paper, this Board owes, and hereby extends to, him an apoligy for the part of this letter that refers to him. On the other hand,. if he was correctly quoted, this Board feels that it is due an apology from him. This Board feels that, under the circumstances, . it will not re- ceive the co-operation expected, and, without this co-operation, it cannot work in harmony with Council. It feels that its usefulness, as a Board of health, is at an end. The undersigned, therefore, respectfully submit their resignations, as members of the Leesburg Board of Health, to take effect immediately. A copy of this letter is being sent to the Times-Mirror for I publication in order that the citizens of the town may understand our position. O Signed: • JOHN A. GIBSON; M. D. John A. Musgrave. • 45 Following remarks by Councilman Turley, it was moved by Councilman Hutchison, seconded by Councilman Flippo, and unanimously carried, that the resignation of the Board of Health be accepted with regrets. A letter from Mr. Harrison Williams, Leesburg, Vs:, was read to Council, in which he stated that he had abandoned his plans to erect an apartment house at the southeast corner of King and North Streets, in Leesburg, Virginia. Cooksey, 15.00 • $637. 60 On motion of Councilman Howard, seconded by Councilman Rollins, and unanimously carried, it was ordered that town employee Raymond Hough be granted two weeks additional salary in lieu of his annual vacation. - After inquiring if any member of the Council, or any person present, desired to bring any matter to the attention of the Council, Mayor Bradfield stated that the Council was authorized to hold executive sessions under Section 17 of the Charter, which section he read in full. The Mayor then stated that he desired a motion to be offered that the Council go into executive session. Councilman_ Turley stated he would offer the motion desired by the Mayor, which motion was duly seconded by Councilman Flippo. The vote was as follows:- For the motion, Councilmen Newton, Flippo, Hutchison, Howard and 'Parley. Coun- cilmaa`_Rollinstdid not vote. Meeting in executive session, Mr. Arthur Hough, town employee, was brought before the Council and charged with being intoxicated while on duty. Mr. Hough confessed to the charge, stated that he was very sorry, and promised never to take another drink of liquor. Councilman Rollins offered a motion, . which was duly seconded by Councilman Howard, that Mr. Hough be given another trial. Councilman Hutchison,then offered an amendment to Councilman Rollins' motion, to the effect that if Mr. Hough is ever found to be intoxicated, while on duty, that he be automatically dismissed from the service of the town. Councilman Howard also seconded the amendment, which was put to vote and carried unanimously, Councilman Rollins' motion then being put to vote was also car- ried unanimously. On motion of Councilman Howard, seconded by Councilman Newton, and un- animously carried, it was ordered that the regular session of the Council be re- sumed. .
