HomeMy Public PortalAbout19900327SCMeeting1 Tybee Island, Georgia March 27, 1990 Mayor Charles J. Hosti opened the special called council meeting. Present were Councilmen Jeff Dukes, Pat Locklear, Jimmy Brown and Bill Walsh. Absent were Jack Youmans and Paul Jackson. Members of the Citizens School Committee present: George McDonald, Rose Thompson, Bob Dyer and Gary Conleay. Jeff Dukes moved that the meeting be closed for the purpose of discussing real estate purchase. Bill Walsh, seconded. The vote was unanimous. Councilman Dukes then explained that the Citizen - Committee which he chairs has explored ways and means of acquiring the schoolhouse complex and grounds of the former public elementary school. He stated that the committee had met over lunch with Dr. Fay, the Board President, and Ann Crowder, member, and that the letter and resolution being submitted to Council for approval were based in part upon suggestions by these two Board members. Two appraisals, one commissioned by the Board and one by the Committee declared the land to be market- valued at around $500,000.00, with the value of the aging buildings negligible, according to Dukes's statement to Council. Councilman Dukes stated that the City Attorney had that morning examined the letter and resolution and had found no basis for objecting to the wording. Councilman Dukes then read aloud the documents and moved that they be approved. Councilman Locklear seconded. In the efsuing discussion Councilman Brown asked whether the committee had considered including a reversion clause, i.e., a promise to return the property if and when the Board might want to reestablish a school. Councilman Dukes responded that such a clause was in the first draft but was deleted when it appeared that the Board was likely to interpret this as a veiled effort to pressure them to reopen the school, and therefore be counterproductive. Councilman Locklear questioned the use of the term "schoolhouse," as opposed to "school complex ", and was told that the term was used so as to be consistent with cited statute. Councilman Walsh asked what Port Wentworth had paid for the school which it bought, and was told the figure was about $51,000.00 1 1 1 Tybee Island, Georgia Page 2 which was the appraised value. The motion was then passed unanimously. Councilman Dukes and Mayor Hosti then commended the Citizen Committee and thanked them on behalf of the city. Siit+: u�5k% b�, Cie. i4. � ':.tS&ai,:'NP•o}'iL.E�'.f.i.N;' R E S O L U T I 0 N WHEREAS, the City of Tybee Island, Georgia did, in 1954, convey a parcel of land to the Savannah - Chatham County Board of Public Education for the pur;:ose of building and operating an elementary school upon said land at Tybee Island; and WHEREAS, this transfer of land to the Board was for the payment of 510 to Tybee Island and "the benefit flowing [to the city] by the creation of a new school building upon said lands "; and WHEREAS, the Board did operate such school until 1988 to the benefit of the citizens of the City and the surrounding community; and WHEREAS, the Board by closing the school in 1988 did abrogate the terms of the 1954 agreement; and WHEREAS, the Board has declared by various means its intention not to further use the buildings and grounds as a part of the educational system; and WHEREAS, Georgia law specifically empowers such county Boards of Education to convey to a municipality any such schools lying within the boundaries of such municipality when in the determination of the Board such school premises are found to be "unnecessary or inconvenient "; and WHEREAS, the City of Tybee Island is in dire need of additional space for discharging its responsibilities to the citizens of Tybee Island and to the visitors who make the City a major resort and recreational area with demands for services exceeding a small city's financial capabilities; NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY RESOLVED, that the City of Tybee Island, Georgia does request the Savannah - Chatham County Board of Public Education to sell to the City of Tybee Island the buildings and grounds of the former Tybee Island Elementary School in a non - competitive bid transaction for the sum of Fifty Thousand Doilars ($50,000.00).
