Councilman Turley spoke with reference to converting the room in the town hall building, recently occupied as a pool parlor, into a rest room for women, and suggested that a committee be appointed to investigate the feasi- bility of such a proposition. - Councilman Newton then offered a motion, which Was seconded by Councilman Flippo, that the Mayor appoint a committee to as- I certain the approximate cost of establishing a rest room for ladies and men. Those voting in favor of the motion were Councilmen Newton, Flippo and Hutch- ison, c-.Councilmen_Roliinsi;andrTurley_declinedito�vote:li Mayor Bradfield then cast his vote in favor of the motion and appointed Councilmen Rollins, Turley and Newton as a committee. The following bills were read, approved and ordered paid: Commonwealth of Virginia, (Industrial Assessment) - - $ 3.25 F. M. Fling, — - - 12.00 $ 15.25 Councilman Hutchison, of the committee appointed to meet with a committee from the Fire Department, to look into the matter of purchasing • a new pumper for the town, reported to Council that the committeesa had met, and investigated the specifications of the several pieces of equipment recom- mended, and suggested that if the town was going to buy a new pumper, that Seagraves equipment be selected. . On motion of Councilman Turley, seconded by Councilman Rollins, and unanimously carried, the committee was discharged with a vote of thanks. Councilman Flippo recommended to Council that the two "Stop" signs at Loudoun and King Streets be raised, in order that they might be more easily • seen. After some discussion, it was moved by Councilman Turley, seconded by II Councilman Hutchison, and unanimously carried, that the Town Sergeant be in- structed to purchase two (2) "Stop" signs similar to the ones used at Market and King Streets, and place them at Loudoun and King Streets. At a regular meeting of the Mayor and Town Council of the town of Leesburg, in Virginia, held in the Council Chamber on Monday, May 24, 1937, at 8:00 P. M., there were present E. N. Bradfield, Mayor; Roscoe B. Rhoads, Recorder; and Roy M. Flippo, Lawrence S. Hutchison, Harry F. Newton, Louis C. Rollins and;Joseph Turley, Councilmen. Hirst, 8.16 • Leesburg Lime & Fuel Corporation, 51.93 $535.79 Mr. Arthur Hough, Lown employee, was summonsed before Council to an- swer charges of becoming intoxicated while on duty. Councilman Turley spoke very earnestly in Mr. Hough's behalf and asked Council to reconsider the motion made and carried at its meeting on November 9, 1936 (Page 45), and give Mr. Hough another chance. Councilman Turley then offered a motion that Mr. Hough be given another chance, which was seconded by Councilman Rollins. Those voting in favor of the motion were Councilmen Turley and Rollins. Those opposing the motion were Councilmen, Flippo, Hutchison and Newton. It was moved by Councilman Newton, seconded by Councilman Hutchison, and unanimously carried, that a successor to Mr. Hough, as town employee, be con- sidered at the next meeting of the Council. Messrs. Steve Savopoulos and L. T. Frye,appeared before Council and asked to have curbing and gutters laid in front of their properties, and also the property of Town Sergeant J. F. Thompson, on East South Street. Mayor Bradfield instructed Councilmen Rollins and Flippo to investigate the situation and report back at the next meeting of the Council. On motion of Councilman Rollins, seconded by Councilman Hutchison, and unanimously carried, the Recorder was instructed to notify Mr. Thomas R. Keyes, E. Royal Street, Extended, to have his septic tank repaired at once. Councilman Rollins reported progress with respect to the establishment of a rest room for ladies and men, in the unoccupied room in the Town Hall build- '. ing. On motion of Councilman Rollins, seconded by Councilman Flippo, and un- animously carried, it was ordered that the sidewalk, curb and gutter in front of the property of Mr. J. I. Kidwell, West Loudoun Street, be repaired. • The Budget and License Ordinance for the town of Leesburg, in Virginia, as read by the Town Auditor, and discussed, at the meeting of April 19, 1937, and published in the Loudoun Times-Mthrror on April 22, 1937, and in the Loudoun News on May 13, 1937, was again read to Council by the Auditor, and upon motion of Councilman Rollins, seconded by Councilman Newton, and unanimously carried, the same was adopted as, published and read, as follows:- 60 • BUDGET & LICENSE ORDINANCE. Capital of Merchants 20¢ on $100.00 MERCHANTS' LICENSE (RETAIL) For every license to a person, firm or corporation engaged in the business of a retail merchang, the amount to be paid shall be.as follows: If the amount of sales throughout the then next preceding calendar year did not exceed one thousand dollars, the amount shall be ten dollars; when such sales exceeded one thousand dollars and did not • 61 • exceed two thousand dollars, the amount shall be fifteen dollars; when such sales exceeded two thousand dollars, the amount shall be fifteen dollars on the first two thousand dollars and seven cents on every one hundred dollars upon all in excess of two thousand dollars. The amount of sales shall be taken from the report furnished the Commissioner of Revenue for Loudoun County showing sales during the next preceding calendar year, from January 1 to December 31, inclusive. For the purpose of ascertaining the tax to be paid by a2retail merchant be- ginning business, he shall estimate the sales which he will make between the date of the issuance of his license and the thirty-first of December following, includ- ing an estimate of the slaes of goods, wares and merchandise Offered for sale. Every under estimate shall be subject to correction by the Auditor for the town of Leesburg, whose duty it shall be to assess such retail merchant with such addi- tional-taxes as my be found to be due after the close of the license year on the basis of the true sales. MERCHANTS' LICENSES (WHOLESALE) For every license to &person, firm or corporation engaged in the business of a wholesale merchant, the amount to be paid shall be as follows: If the amount of purchases throughout the then next preceding calendar year did not exceed tbn thousand dollars, the amount shall be twenty-five dollars; when such purchases exceeded ten thousand dollars, the amount shall be twenty-five dollars on the first ten thousand dollars, and seven cents on every one hundred dollars upon all in excess of ten thousand dollars. _ The term "wholesale merchant" as used in this section, means every merchant who sells to other persons for resale only. ' RESTAURANT LICENSE. Any person who shall cook, or otherwise furnish for compensation, diet or re- freshments of any kind, for casual visitors at his house, for consumption therein, • and who does not furnish lodging, and who is not a keeper of a hotel or lodging house shall be deemed to keep a restaurant. Any person who shall sell soft drinks from a soda fountain shall also be deemed to keep a restaurant. Every person who shall keep a restaurant, shall pay for the privilege an an- nual license tax of ten dollars plus an additional tax at the rate of twenty cents per one hundred dollars on all purchases made by him during the next preceding year. The word *purchases" as used, shall be construed to include equipment or capital outlays. Every person, except merchants.paying a corporation license tax to the town of Leesburg, for the privilege of delivering, peddling or bartering anything ex- cept the product of a farm owned or operated by him, to consumers in the town of Leesburg, shall pay a license tax of $100.00. Every person, firm or corporation selling and delivering at the same time, goods, wares or merchandise of any kind in the town of Leesburg, other than at a definite place of business, goods, wares or merchandise to licensed dealers or retailers shall pay a license tax thereby of $50.00. It is further provid- ed that every vehicle used in the business aforesaid shall have conspicuously displayed thereon the name of the person, firm or corporation using the same, together with its or his post office address and such license shall be con- spicuously displayed on each vehicle. All persons, firms or corporations not paying a State license tax or tax to a corporate subdivision thereof, shall pay a license tax of $50.00 whether orders are taken in advance or not. Every person, firm of corporation, who shall engage in the business of photographer, or shall act as a photographer agent or canvasser, shall pay for the privilege the sum of $5.00. . Every proprietor or occupant of a public hall or other room fitted for publio exhibitions, balls, performances, fairs, or other entertainments, ex- cept churches and charitable organizations, to which admission or charges for participation are made, or for Which free will offerings are received or who ., uses or rents the same for such purpose, or receives charges of free will of- ferings for participation therein or therefor, shall pay $25.00 license tax for such privilege; and no person shall, without a license authorized by law, ' charge for the use of same while used or employed for any of the purpose a- foresaid, or for anyllecture, concert or any other exhibition. No person, shall be allowed to conduct any shooting gallery or gallery for target practice with guns,•pistols, or other similar implements or with bow and arrow, or gallery of other like amusements, without first having ob- tained a libense therefor, and•for the privilege of conducting such a gallery shall pay a license tax of $50.00. No license Shall be issued' without first obtaining a special permit from the Council. 63 • Every non resident baker, vendor of meats, ice cream, soft drinks, or other merchandise who operates delivery wagons, shall pay a license fee of $15.00 per year for each vehicle so operated, except that this shall not apply to wagons or trucks making delivery of merchandise to- fill orders previously taken in writing. All persons, firms or corporations engaged in business not specifically em- braced in the foregoing and liable to taxation under the laws of the State of Virginia, there shall be assessed by the town of Leesburg, the same license tax as assessed by the State. For interpretation of the above businesses, reference is made to the Stat- utes of Virginia defining said businesses. The citizens of Leesburg are hereby notified that on the 24th day of May, • 1937, at the Mayor's Office in Leesburg, a meeting will be held at 8:00 o'clock to act of the said budget.
