WOME P: City Manager Woollett read a letter from Mrs. Waller, Chairman for the UNICEF drive requesting a charitable solicitation permit to solicit funds on October 31st, 1962. CURB & GUTTER AT 9902 HOWLAND AVE. City Manager Woollett advised a petition had been received sign- ed by 68,5% of the property owners for curbs and gutters. Mayor Tyrell declared the Public Hearing opened, and asked if anyone wished to speak for or against authorizing this work to be done, Mr. Ted Sperling, 9902 Howland Ave., spoke against having this installation on his property unless 5 remaining on the street also install the curb and gutter, and advised if the Hearing was just against ta-;is location he was against the installation. The City Manager advised that his property at 9902 Howland was the only one not agreed to putting in the curb and gutter on h4s side of the street. Also that the other street was in the pro- cess of having the same installation, Mayor Tyrell asked if any- one else wished to speak. No one came forward. - Councilman Nunamaker moved to close the Public Hearing, Council- man Fitzjohn seconded, and carried. PUBLIC HEARING: 7 :45 P. M, CURBS & GUTTER 5337 -5343 aLICKMAN - City Manager Woollett advised a petition had been received sign- ed by a majority of the property owners on this street requesting± curb and gutter installation, Mayor Tyrell declared the Public Hearing opened and asked if anyone wished to speak for or against this improvement. No one came forward to speak. Councilman Nunamaker moved to close the Public Hearing, Councilman Fitzjohn seconded and carried. WOOLLEY STREET: TEMPLE CITY IMPROVEMENT NO. 1 City Manager Woollett advised this was the time to set a Public Hearing at which time the spreading of the assessment for the cost of the sewer installation known as Temple City Improvement No. 1. PUBLIC HEARING: 8 :00 P. M. ANNEXATION NO, 5 -A, NORTHEAST TEMPLE CITY, UNINHABITED. 9891 Wendon Ave. The City Manager advised Mr. & Mrs. Clarkson requested annexa- tion to the City of Temple City. As the property was in Arcadia that City consented to detachment. This concerns just the prop- erty of the Clarksons' and there have been no protests received. He also read a letter from the applicants stating they were un- able to be in attendance and confirmed their desire to be annex- ed to Temple City. Mayor Tyrell declared the Public Hearing opened and asked if any. one wished to speak for or against this annexation. No one came forward to speak. RECOMMENDATIONS: PARKS & RECREATION COMMISSION: Policy on Co- sponsorship - R -40, Revised 10/62 Policy on Special Programs R -41 Revised 10/62 Policy on Holiday Procedure -R -42, Revised 10/62 Policy on Recreation Personnel Attire - R -43 Following discussion regarding 5 policy items listed above Coun- cilman Nunamaker recommended the decision on these items be held over until the joint meeting with the ,'arks & Recreation Commis- sion on Thursday, October 25, to which the rest of the Council agreed. Senior Citizens of Temple City. The City Manager advised the Parks & Recreation Commission made a strong recommendation this group continue their afFiliation with the Los Angeles County Senior Citizens Assn., Inc., as in the past. He explained the City co- sronsors this croup so is involved in the decision. Following considerable discussion Councilman Merritt moved to approve the Parks & Recreation Com- mission recommendation as to the Senior Citizens Assn., Council- man Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 15. TRAFFIC COMMISSION RECOMMENDATIONS: 8. Channelization of Lower Azusa Ave. City Manager v�doollett advised Lower Azusa Ave. is entirely with- in our City Limits to the south side, beyond which is El Monte and County. The City of El Monte have agreed to go along with this. If approved the Council should instruct the Superintendent O 356 Council Minutes, October 22, 1962, page 4 of Streets to cause the work to be done, and in this event the City of El Monte would be billed for their share. Councilman Nunamaker moved that this be done as it would be a great im- provement, Councilman Dickason seconded, roll call vote as fol- lows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 16. PROPOSED INCREASE OF LAW ENFORCEMENT COSTS: Mayor Tyrell advised that we are awaiting the transcript of the presentations made by both the County and the Organization of Contract Cities. These will then be analyzed, a presentation prepared and made to the Board of Supervisors some time late in November or early December. 17. PUBLIC HEARING: 8 :30 P. M., REQUEST FOR LICENSE TO ESTABLISH PEPPERMINT LOUNGE AT 9661 LAS TUNAS DR. City Manager Woollett advised the City had received a request for a public eating and dancing license from Joseph Buccola E Anthony Filardo of 9833 Key West, Temple City. He advised the applicants were interviewed and questioned closely by the City Manager, and recommendations have been received from the License Detail of the Sheriffs Dept., the City Traffic Commissi- on, and the City Parks & Recreation Commission. The Traffic Commission met on Oct. 3, who in findinc; they expected to accom- odate 284 plus 24 stool spaces, determined 79 parking spaces would be required for that occupancy and at the present time there are none for off- street parking and they would be depend- ent upon on- street parking and the 25 spaces in the city lot in the rear and for this reason of inadequate parking recommend- ed denial of the license. The Parks E Recreation Commission looked favorably upon the application with certain restrictions regarding the possible noise problem, adequate security inside and outside and patrol, and establishment of standard of dress, and the establishment should not have the atmosphere of a saloon. Deputy Gilman of the Sheriff's Dept., License Detail, reported if the license is granted that their Dept. recommended the fol- lowing conditions: 1. The boys shall wear suits, or slacks and coat, dress shirt and tie. The girls shall wear party dresses or skirts, blouses and /or sweaters. 2. The age shall be at least 18 years of age and not reached 21st birthday. 3. The employees shall be at least 21 years of age and the names of all employees shall be submitted to the Sheriff. Band and entertainers may be and shall be at least 18 years of age. 4. No person shall be re- admitted to the dance, who has left such dance, unless the full admission price is recharged. 5. There shall be a uniformed parking lot attendant on duty, and at least one private patrolman on duty inside the pre- mises whenever dancing is being conducted. 6. The licensee shall not permit any person to dance with an- other person of the same sex while attending and participat- ing in a public dance. 7. The licensee shall prevent the presence of any intoxicated quarrelsome, disorderly person or any person with an alcohol• is beverage in his possession upon the premises. 357 Council Minutes, Oct:-:ber 22, 1962, page 5 Mayor Tyrell opened the Public Hearing; and requested every one in the audience who wised to speak either for or against this request to stand and be sworn in before giving their testimony. A large number of people in the audience stood up and took the oath administered by Mayor Tyrell. The Mayor then asked for those who wished to speak in favor of the license request. Mr. Anthony Filardo, 1414 So. Tenth Ave., Arcadia, one of the ap- plicants, spoke in support of the license request, and informed the Council of the type of operation he proposed as follows: ages must be 18 and under 21 yrs. of age, cannot smoke on dance floor, must be dressed properly, and he advised the Lounge would be primarily for dancing, serv- ing only pizza, to prevent noise nuisance the back door would be closed and used for emergency only, identification cards such as driver's licenses and draft cards would be checked for age proof; there would be a $1.00 cover charge and no one can leave and come back in without paying another $1.00, all entering will be check- ed for drinking or possession of alcoholic beverage, entertain- ment will be dancing with a 4 or 5 piece band provided, open from noon week days and later on Sundays, until 2 A. M., will have a patrolman on duty inside, also a parking attendant with supervision by approximately three inside the building. He ad- vised the building construction is adequately sound proof with acoustical tile on all but 4 ft. of the lower part of the build- ing. They plan to use the City parking lots in the rear of the building and ,)ossibly the bank parking lot on Camellia and on- street parking. He advised they would comply with any restric- tions and requirements the City wished to impose. Mr. Filardo was questioned by the Council at length regarding the proposed operation as well as previous locations where Mr. Filar - do had been in business, which were eating establishments with beer licenses also. Mr. Dennis Townsend, 9186 Jaylee Dr., Temple City, a student at L. A. State College, appealed to the Council for a place of this nature for this age bracket who are out of High School, and many college students. The following people spoke in favor of granting the license: Bill Martin 81221 Ardendale Nina Cash, 6133 N. Loma Ave. Bill Mattinson, 5327 Cloverly Ida May Anderson, 5559 Rosemead as well as Joseph Buccola, 9033 Key 'West, the other applicant for the license. No one else came forward at this time and Mayor Tyrell requested those opposing the issuance of the license to now address the Council. Rev. Charles Hamby, 5956 Golden lest, spoke in opposition to the license being granted, and advised the local Ministerial Assn. had circulated petitions in opposition which was present- ed to the Council with 1855 signatures. He advised his church (Methodist) planned to have dances with a dance band regularly. He advised he with several others made a tour of other similar operations, including the Cinnamon Cinder. He stated we have to regulate our town according to the citizens that live here. Rev. Lyman Ellis, 5453 McCulloch, requested the petition submit- ted be made a part of the record. Councilman Merritt so moved, Councilman Nunamaker seconded, and carried. Rev. Ellis also advised he had personally invited Mr. Filardo to appear before the Ministerial Assn. at their meeting before the petition was prepared which Mr. Filardo failed to attend. 358 Council Minutes, October 22, 1562, page 6 Mrs. Helen Achilles, 112 N. Del Mar, San Gabriel, Council -woman of that City, stated she felt due to the municipal boundaries of the two cities that this was a mutual problem. Also inasmuch es they had a similar experience in their City that she had fam- iliarized herself with the operation of the Peppermint Stick and similar operations. She also stated it was her feeling that very adequate areas can be provided under a "canopy where $'s are not the chief concern." Mrs. Lilly Gilley, 6153 N. Oak, spoke representing the Jr. Wom- ens Club, also in opposition to this request and recommended a Youth Center such as Monterey Park and other cities have through the Recreation Department. Mayor Tyrell stated a letter received From Mrs. Gilley substan- tiating the above presentation will be made a part of the record Bob Rudolph, 5811 Miloann, felt if this was to be a sheriff's problem he was against it, but wanted to go on record as believ- ing in Temple City. Mrs. Jos. Lang, 9133 Hermosa Dr., wished to go on record as opposing this establishment. As no one else came forward to speak so the Mayor stated this no% was time for rebuttal for those in favor of the petition. The following people spoke in favor of the grantine of the license: Judy Lindberg, (-2'32 E. Nadine, Joseph Filardo, one of the appli- cants, Larry Lindley, 5329 Temple City Blvd., Ronald Newton, 6012 N. Camellia, Al Lindberg and "Pop" Gunst, both of the ParkE & Recreation Commission spoke strongly in favor of the "young adults" and their need they have for a gathering place to dance and get together. Mr. Lindberg objected strongly to the infer- ence that such an operation would bring in "undesirables as he felt the youth in the surrounding areas compared favorably with Temple City youth and as such should not be so labeled. Mr. Gunst entered a strong plea that something be done for the youth which he had been trying for a number of years to do, without receiving the necessary community support. The rebuttal for the opposition was given by Kenneth Dunkelberge. Pastor of the First Baptist Church of Temple City. Rev. Lyman Ellis, Rev. Hamby and Arley Gorham of 5039 Encinita Ave., all spoke in opposition re- affirming their previous objections to issuance of a license. Richard Sale, 5427 E. Olive, a Commissioner on the Traffic Com- mission explained that the recommendation from that Commission was made as they Felt it a safety problem, and under the exist- ing conditions felt it an unsafe problem in regard to parking and safety considering the number of people brought into the area. Robert F. Connelly, 6033 N. Camellia, reminded the Council of the difficulties with the soda fountain across the street not too long ago. J. Palmer, 5818 N. Kauffman Ave., Mrs. Gordon J. Hennely, 5702 N. Encinita Ave., Temple City Church of the Nazarene, 9953 Las Tunas Drive. Councilman Nunamaker moved the Hearing be closed, Councilman Dickason seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen .'None ABSENT: Councilmen -None 359 Council Minutes, October 22, 1962, page 7 Councilman Dickason stated it was his judgment that the parking situation is enouc.h in itself to deny this request for a license He stated he did not want to see our youth exploited by private enterprise or anything else and in his judgment this request should be denied. Councilman Nunamaker felt the Council should be cognizant of the petition submitted with over 1800 signatures, and agreed with the opinions of Councilman Dickason. Councilman Fitzjohn advised he is trying to do what he felt would be in the best interests of the people of Temple City. He does not believe this establishment to be good for Temple City at this location or any other and made the motion that the ap- plication for a license for eating and dancing at 9661 Las Tunas Dr. be denied, Councilman Nunamaker seconded. Councilman Merritt stated he felt if we can call upon this age bracket to fic;ht for our country and put them in areas certainly not by choice, and far less desirable than he believed this plac€ could be. He felt there is a need for something for this age group. He was in favor of private enterprise for the operation and only because of the basis of the traffic recommendation would agree to denial of the application. Mayor Tyrell stated the City Attorney had recently advised the Council to make their decision on the facts, and the facts must be the basis for a decision. This advice was solid From the law, A need has been definitely established to have such a facility available for this age group as well as other age groups in the City. He agreed with Councilman Merritt that when private enter- prise can provide adequate facilities it should do so in opposi- tion to having; the government agency do it. The City can exer- cise appropriate controls so the establishment can be properly run. As for singling out youth of other cities and indicating they are bad because of this establishment, they come into this City for other things, but we single them out for this particular application before the Council. The sole reason for denying it is that there is not adequate parking at the location which is sought, which parking facilities he 'believes are essential to this particular type of establishment and for this reason he would be in opposition to this request to grant the license. M. Meyor Tyrell called a five minute recess at this time, 18. RESOLUTION NO. 62 -244: Warrants & Demands. Councilman Merritt moved to adopt Resolution No. 62 -244, Oarrant..: & Demands Nos. 1864, and No. 1954 through No. 1973, in the amount of $27,695.55, Councilman Fitzjohn seconded, roll call vote as. fol lows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 19. COMMUNICATIONS: A. Boundary Commission, L. A. Co., proposed annexations #297, #298, #302, City of El Monte. City Manager Woollett read a letter regarding the above annexations, Councilman Fitzjohn moved to receive and file,. Councilman Merritt seconded, and carried. B. City Manager' oollett read a letter from the Lions Club re- questing a manner over Las Tunas for Oct. 21 but as the lett( 360 Council Minutes, October 2.2, 1962, page 8 was received too late it required no action. C. Little League Baseball, Inc. City Manager Woollett read a letter of appreciation for use of the 'ark from the Little League Baseball group of Temple City. D. The City Manager read a letter from the Elks Lodge of Arcadia requesting a permit For a street banner for Nov, 10 -1 for the Elks Annual Charity Bali. Councilman Dickason moved to approve, Councilman Nunamaker seconder: and carried. 20. TiME RESERVED FOR ANYONE IN THE AiJDIENCE WHO WISHES TO SPEAKe Ray Johnstcn, 6470 Livia N., spoke strongly in favor of somethin being done for the young adults in response to the plea express- ed at the Hearing, and volunteered the sum of $100, to start the ball rolling to get the community behind the project financially and also to oet out and work toward getting a building suitable for this type of activity. John Clemson of the Parks & Recreation Commission advised the establishment of a teen -age night club will be high on their agenda since they know the keen interest expressed at the meet- ing tonight. 21. MATTERS FROM CITY OFFICIALS: City Manager`:loollett requested Public Hearings be set for the curb and gutter projects on the north side of Freer between Halifax and Palm, and the south side of Freer from Doreen to Pal Mal, and the east side of Welland from Daines to Freer. Councilman Dickason moved that the Public Hearings be set for north and south side of Freer at 7:45 P. M. on Nov. 12 and the east side of Welland for 7:50 P. Councilman Munamaker brought up the question regarding; the over- night parking;. Councilman Fitzjohn stated last meetinc Councilman Dickason made . a motion and he did not get a second and the motion died for that reason.
