HomeMy Public PortalAboutOrd 073 Cereal Malt Bev .^--'-~_..~'-~---_.._---~-------.~-"'-~.._- (Published in the Daily Reporter, ~\ ~, 1984) THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 73 AN ORDINANCE AMENDING SECTION 1 and SECTION 3 OF ORDINANCE NUMBER 21 PROVIDING FOR A LICENSE TO SELL OR GIVE AWAY CEREAL MALT BEVERAGES; AND PROVIDING LICENSE FEES: NO REFUNDS; NON-TRANSFERABLE. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. Section 1 of Ordinance Number 21 is hereby amended to read: Section 1. LICENSE REQUIRED No person shall sell, give away, or distribute in any manner, any cereal malt beverages within the corporate limits of this City, in any business establishment during normal business hours as posted or established by practice without having first secured a valid license issued by the City for the place of business at which such retail sales or distributions are made. It shall be unlawful for any person holding a license for the sale of cereal malt beverages only in original and unopened containers and not for consumption on the premises to sell or dispense such beverages in any other manner than is provided for in the license. Section 2. Section 3 of Ordinance Number 21 is hereby amended to read: Section 3. LICENSE FEES: NO REFUNDS; NON-TRANSFERABLE follows: Rules and regulations pertaining to licenses and fees shall be as (a) The following fees are hereby prescribed for each license authorized by this article; (1) General Retai1er--For each place of business selling cereal malt beverages at retail, for consumption on the premises, two hundred dollars ($200.00) for the calendar year; provided that, to procure or retain a license as a general retailer at least sixty percent (60%) of the gross receipts of such business must be from the sale of food and forty percent (40%) or less from the sale of cereal malt beverages. As a condition of obtaining and/or retaining such license, retailer agrees to furnish to the City Clerk tax returns, receipts, or such other information as he or she shall request to determine compliance with this requirement. (2) Limited Retai1er--For each place of business selling only at retail cereal malt beverages in original and unopened containers and not for consumption on premises, fifty dollars ($50.00) per calendar year. (b) The full amount of the license fee shall be required regardless of the time of year in which the application is made, and the licensee shall only be authorized to operate under the license for the remainder of the calendar year for which the license shall be issued. There shall be no refund in any case when licensees quit business prior to the end of the calendar year, or when the license is revoked for any cause provided for under this Ordinance.
