HomeMy Public PortalAbout1946-08-15 MeetingMINUTES OF THE FIRST MEETING OF THE COUNCIL AUGUST 15, 1946 The first meeting of the council of Bel Harbour Village was held in the "Administration Building" in the Village at eight o'clock P. M. on Thursday, the 15th day of August, 1946. There were present in person: J, Julien Southerland, Mayor; Charles R. Graham, Glenn E. Massnick, Willard, H. Webb, George M. Whittaker and Ray Semmes, Jr., being the Aldermen of the Town and eonetituting the full membership of the Village Council; Mery Wetterer, Town Clerk; and Herold T. Dickey, Town Marshal. The Mayor and the Town Clerk reported that pursuant to Sections 165.01 and 165.07 of the Florida Statutes of 1941, a complete record of the meeting held by the registered voters within Bel Harbour Village on the 14th day of August, 1946 at eight o'clock P. M., signed by the Mayor, the five Aldermen and the Town Clerk have been recorded in the office of the Clerk of the Circuit Court of. Dade County, Florida, and this having been done under Seotion 165.08, Florida Statute 1941, a municipality known as Bel Harbour Village is now a body corporate with full power of a Town under,the laws of the State of Florida, The Mayor then reported that he had duly taken the oath of office provided for in Section 165.06 Florida Statutes 1941, and that he would now administer to the Aldermen and other officers -elect a like oath of office; and thereupon each of the Aldermen and the Town Marshal end the Town Clerk took the oath of office prescribed by Section 165.06 Florida Statutes 1941, and on motion of Mr. Charles R- Graham, seconded by Mr. Glenn E. Massnick, all of the said oaths of office were ordered to be attached to and made a, part of the minutes of this meeting. The Mayor then stated to the meeting that the Town Council having been organized, the next business before the meeting would be to elect one of the mem- bers as President of the Council; and thereupon, on motion of Mr. Massnick, seconded by Mr. Semmes, Mr. Willard H. Webb was elected President of the Council. Mr. Webb then assumed the Chair as President of the Council, and nnounced that all the preliminaries having been complied with according to law, and all mem- bers of the Council being present, the Counoil was qualified to proceed with the business of the Village and would be now officially convened. It was pointed out to the meeting that by Section 165,05 Florida Statutes 1941, it is provided that the Aldermen, members of the Council, shall hold office for two years, but that at their first meeting they shall by lot divide their body into two classes, as nearly equal in number as possible, one of which shall hold office for two years and the other for one year. Thereupon, on motion of Mr. Graham, seconded by Mr. Whittaker, it was voted that as there were an odd number of councilmen three of them serve for two years and two of them for one year, and that the members of the Council proceed by lot to determine the length of their terms. Five slips of paper, three numbered "two" and two numbered "one" were then placed in a hat, and each of the councilmen drew one of the slips, the result of which drawing showed that the five Councilmen should serve for the following periods: For Two Years Charles R. Graham :George M. Whittaker Glenn E. Massnick For One Year Willard H. Webb Ray Semmes, Jr. AUGUST 1, 1946 On motion of Ni". Massnick, seconded by Nr. Whittaker, it was voted that the result of the drawing by lot be confirted and that Alderman Graham, Whit- taker and Masanick would serve for two years and Alderman Webb and Semmes for one year. The Mayor suggested that when the record of the meeting held. August 14, 1946 forming the Town. known as Bel 4arbour Village is returned from the offiee of the Secretary of State, it should be made a permanent record of the Vil- lage, and that there be attached also as a part of the permanent records of the Village the certificate of the Supervisor of Registrations for Dade County dated August 12, 1946, showing that there were thirty-four regiatered voters in the municipality on that date; and thereupon, on motion of Mr, Semmes, seconded. by Mr. Graham, it was ordered that when the minutes of the meeting held,August 14, 1946 organizing the Bal darbour Village are returned from the office of the Secretary of State they and the certificate of the Dade County Supervisor of Registrations dated. August 12, 1946, be attached to and made a part of the minutes of this meeting. The President stated that the next order of business was the consider-. ation of Resolution No. 1 which would create certain offices for the Vil- lage, etc. The resolution numbered "1" was read to the meeting and on motion of Mr. Whittaker, seconded by. Mr. Graham the resolution was adopted as Resolution No. 1 of the Village entitled: "A RESOLUTION CREATING VARIOUS OFFICES IN THE VILIAGE, AND FIXING THE COMPENSATION FOR SAID OFFICES; DESIGNATING A VILLAGE HEADQUARTERS, AND FIXING THE TIME FOR MEETINGS OF THE VIL- LAGE COUNCIL; CONFIRMING THE ADOPTION OF A SEAL FOR. THE VILLAGE; DFSIGNATING A DEPOSI- TARY FOR. THE VILLAGE FUNDS." Resolution No. 1 having been duly adopted, the President stated that it was now in order to elect a Village Attorney and a Village Engineer; and on motion of Mr. Graham, seconded. by Mr.eSemmee, J. Julien Southerland was elected attorney for the Village and Fred. E. Zurwelle, engineer for the Village, by unanimous vote. Mr. Graham pointed out that it would. be necessary for the Town Mare Meal to have some Police Officers assist him. in policing the Village, and thereupon, on motion of Mr. Semmes, seconded by Mr. Whittaker, the fol- lowing were. made Police Officers with full powers of arrest, for the Vil- lage: Robert Altenbaugh Robert C. Zill Charlea R. Graham On motion of Mr. Whittaker, seconded by Mr. Graham, it was voted that the Town Clerk shall also act as tax assessor and tax collector. On motion of Mr. Massnick, seconded by Mr. Graham, Mr. Willard H. Webb was designated to act as building inspector for the Village. There was presented to the meeting for consideration a plat of the RESIDENTIAL SECTION OF BAL HARBOUR prepared by Zurwelle-Whittaker, and dated July 29, 1946, which divides into lots and blocks certain parts of the municipality between Collins Avenue (Bal Harbour Boulevard) and AUGUST 15, 194. Fa7 the seawall on the west of the Village and between the southern and north- ern boundaries of the Village; after discussion, upon motion of Mr. Mass - nick, seconded by Mr. Charles R. Graham, the following resolution was adopted: RESOLVED that the Council of Bel harbour Village hereby approves the plat entitled "Residential Section of Bel Aarbour" as prepared by Zurwelle-Whittaker. Inc. and bear- ing date July 29, 19460 which plat is to be recorded in the public records of Dade County, Florida; and. the Mayor and the Village Engineer are hereby authorized to certify ehat said plat has been approved by the Village Council of Bal Harbour Village, Florida, such certification to be attested by the Town Clerk. Mr. Southerland, as attorney for the Village, presented to the Coun- oil a proposed Ordinance No. J. establishing the municipal court and re- lating in detail to the procedure therein and to the punishment of of- fenses against the Village. The proposed ordinance was read section by section, and after discussion and consideration, on motion of Mr. Massnick, seconded by Mr. Whittaker, the said 'erdinance No. 1 entitled: "AN ORDINANCE ESTABLISHING THE VILLAGE COURT AND RELATING IN DETAIL TO THE PROCEDURE THEREIN AND TO THE PUNISHMENT OF OFFENSES AGAINST THE VILIAGE" was unanimously adopted. The Village Attorney, presented to the Council proposed Ordinance No. 2, which was designated to define offenses against the Village and to provide for punishments and fines and to make certain provisions for evi- dence in the Village Court and to regulate searches and seizures, to pres- cribe traffic regulations and to provide for mechanical inspection of motor vehicles. The proposed ordinance was read section by section, and after discussion it uss voted to delete the sections with regard to the motor vehicle inspection. and on motion of Mr. Graham seconded by Mr. Semmes the said Ordinance No. 2 entitled: "AN ORDINANCE DEFINING PUNISHMENTS ANP NES, DENCE IN THE MUNICIPAL SEARCHES AND SEIZURES, was unanimously adopted. OFFENSES AND FIXING AND RELATING TO EVI- COURT, REGULATING TRAFFIC REGULATIONS" The Village Attorney presented to the Council proposed Ordinance No. 3, which provicIPA tic the adoption of building, electrical and plumbing codes for the Village and for licenses by reciprocity for contractors and sub- contractors and for bonds and insurance by each contractor. The ordinance was read section by section, and after discussion and consideration, on motion of Mr. Semmes, seconded by Mr. Whittaker, the said Ordinance No. 3 entitled: "AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA REGULATING THE ERECTION, CONSTRUCTION, ENLARG- ING, ALTERATION, REPAIR, MOVING, REMOVAL, AUGUST 1, 19I6 DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMAT, USE, HEIGHT, AREA AND MAINTENANCE OF AIL BUILDING AND/OR STRUCTURE3 IN BAL HARBOUR, FLORIDA,AND PROVIDING FOR LICENSES R)R CON- TRACTORS AND SUB -CONTRACTORS AND FOR A BOND FOR ANDINSURANCE BY EACH. CONTRACTOR" was set aside for further consideration at a later date. There being no further business before the meeting, on motion, made, seconded and carried, the meeting waa adjourned.
