MAYOR y • • ` ECORDER • • September 16 , 1937 • At a special• meeting of the Layor and Town Council of the town of Leesburg , in Virginia, held in the Council Chamber- on Thur- sday, September 16 , 1937 , at 8 O ' clock P. M. , there were present , Lucas D. Phillips , Mayor ; Louis T. Titus , Recorder ; and Roy M. Flippo , Lawrence S.'cHutchtson, Louis C. Rollins , J. D. .Taylor and Joseph H. Turley, Councilmen. Upon motion of Councilman Flippo , seconded by Councilman Hutchison, and. unanimously carried, the following Ordinance was- adopted ; 00 — BE IT ORDAINED, by the Council of the town of Leesburg , in Virginia, that , if any person arrived at the age of dis- cretion profanely curse -or swear or get or be drunk or act -in a disorderly manner in public , he shall be deemed guilty of a misdemeanor and upon conviction therof shall be fined not less than one nor more than ten dollars. • • BE IT FURTHER ORDAINED, toy said council that , if any person shall take a drink of alcoholic beverages or shall -tender a drink of alcoholic - beverages to another , whether accepted or not , at or in any public place , he shall be deemed guilty of a misdemeanor, and fined not less than one nor more than ten dollars. It was moved by Councilman Turley , seconded by Council- man Flippo ;' and unanimously carried , that the following Ordinance be adopted ; ' BE IT ORDAINED, by the Council of the town of Leesburg ; in Virginia, that it shall be unlawfull for any person to drive •or operate any automobile or any other motor vehicle , • car ; truck, engine , or train, while under the influence of J.- alcohol , alcohol , brandy , rum, whisky, gin, wine ; beer , ale ; porter , stout, or any other liquid, beverage or article containing - • alcohol or while under the influence of any narcotic drug , 82 . or any other self-administered intoxicant or drug of what- soever nature in the Town of Leesburg , in Virginia. . • Any person who violates any provision of this Ordin- ance shall be guilty of a misdemeanor , punishable by a fine of not less -than One Hundred Dollars or imprisonment for not less than one month nor more' than six months ; either or both in the discretion of the Mayor or court trying the same , for a first offense , and the Mayor or court , in its discretion; may suspend the sentence during good behavior of the person convicted•. Any person convicted of a second , or subsequent offense- under this ordihance shall be punished by a fine of not less than One Hundred Dollars nor more that Five Hundred Dollars and by imprisonment for not less- than one month nor more than one year , and neither the_ Mayor nor any court shall suspend the sentence in such case. On motion of Councilman Hutchison , seconded. by Council- man Flippo, and unanimously carried , the following Resolution was passed ; .j, BE IT RESOLVED, by the Council of the town_ of Leesburg , in Virginia , that the Mayor of said town shall continue to have all jurisdiction vested in such Mayor at the time the "Trial Justice Act of 1936" was enacted into law, which act - is entitled : "An Act to Amend the Code of Virginia by adding thereto fifteen ( 15) new sections , numbered 4987-A to 4988-0, both inclusive , relating to the appointment of Trial Justices and substitute Trial Justices in Counties , etc. " ; and that the jurisdiction of the saidrMayor3hal1 pertain to- the issuance of warrants and the summoning of witnesses and the trial of cases involving violation of town ordinances , and that the said Mayor shall collect all fees and fines and pay same into the treasury of the town of Leesburg , in Virginia , as now provided by law, or by ordinance of the said town. , It was moved by Councilman Hutchison, seconded by Council- man Flippo , and unanimously carried, that the following Ordinance be adopted ; • BE IT ORDAINED, by the Council of the town of Leesburg, in Virginia , that Stilson H. Hell be and he is hereby con- stituted and appointdd attorney for the town of Leesburg `for a period of one year from the date of this Ordinance , and his salary shall be $.100.00 per year, payable $50.00 at the expiration of six months from the date hereof and $50,00. at the expiration of one year , from the passage of this Ordin- ance. On motion of Councilman Flippo , seconded by Councilman Taylor , and unanimously carried , the following Ordinance was ad- opted. • WHEREAS, by an Ordinance passed by the Council of the town of Leesburg , in Virginia , on the 13th day of September , 1937 , creating a Sinking Fund to be deposited in a separate account in the Peoples National .Bank of Leesburg , Leesburg , • Virginia ; and WHEREAS , since the passage of said Ordinance the Auditor representing the Auditing Department of the Commonwealth of Virginia , has advised that all monies of said fund should be placed in the general checking account of the town and set aside as a sinking fund under the new system of book keeping recently installed by said town ; Now, therefore , BE IT ORDAINED, by the 9ouncil of the . • town of Leesburg , in Virginia , that the said ordinance passed by the said Council on the 13th day of September; 1937 , authorizing and instructing the Auditor- Treasurer to trans- fer on the first day of each month out of the "general fund of the town four-seventeenths of all tax receipts collected • 83 • - during the preceding month from levies imposed on the real estate and personal property- and deposit . same" in a Sinking - Fund , be and the same is hereby rescinded , cancelled and annulled. - (a) BE IT FURTHER ORDAINED, by the said. Council that the Auditor-Treasurer be and he is hereby authorized and directed to keep a record of all monies collected from the sinking fund levy on real estate and personal property and also a record of all expenditures of said monies. It was moved by Councilman Turley , .seconded by Council- . man Hutchison , and unanimously carried , that the fhllowing Res- olution be passed; • BE IT RESOLVED, by the Council of the town of Leesburg , in Virginia, that the Auditor-Treasurer be and he is hereby authorized and instructed to purchase the necessary terra- cotta pipe to repair the drain on the North side of .gest Loudoun street in front of the properties now .occupied by Jack Zimmerman and others and haat' said pipe laid in said street. Turley; Counbilmen. _ • The minutes of the last regular meeting and the minutes of a special meeting held on September 16 , 1937 , were read and approved. Mr. R. M. Jackson appeared before the Council to ask the the Council to advertise in the High School paper at the rate of $10.00 per year . Upon motion of Councilman Turley , seconded by Councilman • Rollins and unanimously carried , the following Resolution was passed ; BE IT RESOLVED, by the Council of the town of Leesburg , in Virginia , that the sum of ten dollard be apd the same is hereby appropriated for an advertisement in the .Leesbur_g High School paper . • BE IT FURTHER RESOLVED , by said Council that the Auditor- Treasurer be and he is -hereby authorized to draw a check payable to the Leesburg High School paper for the stm of ten dollars. • • Mr. Pulliam- of a committee from the Fire company appeared 'before the Council askine- the Council to .purchase 1000 feet of new fire hose. Mr. Baker of the Quaker City Rubber Company appeared before the Council and displayed samples of fire hose . It was- moved by Councilman Flippo , seconded by Councilman
