Auditor-Treasurer be and he is hereby authorized and
directed to keep a record of all monies collected from the
sinking fund levy' on real estate and personal property and
also a record of all expenditures of said monies.
It was moved by Councilman Turley , .seconded by Council-
man Hutchison , and unanimously carried , that the ffllowing Res-
olution be passed;
BE IT RESOLVED, by the Council of the town of Leesburg ,
in Virginia , that the Auditor-Treasurer be and he is hereby
authorized and instructed to purchase the necessary terra-
cotta pipe to repair the drain on the North side of West
Loudoun street in front of the properties now .occunied by •
Jack Zimmerman and others and harry said pipe laid in said
street. vc

At a regular meeting of .the Mayor and Town Council of the •
town of Leesburg , in. Virginia , held in the Council Chamber on Mon-
' day , September 27 , 1937 ; at 8 O ' clock P. M. , there were present ;
Lucas .B. Phillips , Mayor; Louis T. Titus , Recorder; and Roy M. Flippo ,
Lawrence H. Hutchison, Louis C. Rollins ; J. D. Taylor and Joseph H.
Turley, Councilmen.
The minutes of the last regular meeting and the minutes of
a special meeting held on September 16 , 1937 , were read and approved.
Mr. R. M. Jackson appeared before the Council to ask the
the Council to advertise in the High School peper at the rate of
$10.00 per year
Upon motion of Councilman Turley , seconded by Councilman
Rollins and unanimously carried , the following Resolution was passed ;
. BE IT RESOLVED, by the Council of the town of Leesburg ,
in Virginia , that the sum of ten dollard be apd the same is
hereby appropriated for an advertisement in the .Leesburg High
School paper .
• BE IT FURTHER RESOLVED , by said Council that the Auditor-
Treasurer be and he is tereby authorized to draw a check payable
• to the Leesburg High School paper for the shin of ten dollars.
• Mr. Pulliam. of a committee from the Fire Company appeared
'before the Council asking the Council to ,purchase 1000 feet of new
. fire hose. •
Mr. Baker of the Quaker City Rubber Company appeared before
the Council and displayed samples of fire hose .
It was - moved by Councilman Flippo , seconded by Councilman

Hutchison and unanimously carried that the matter of purchasing
hose be laid on tha table:
A Mr. Phillips appeared before the Council and displayed
a sample of water meter for sale. No action was taken. in regard to
purchasing water meters.
On motion of Councilman Hutchison, seconded by Council-
man Flippo and unanimously carried ; the following Ordinance was
adopted ; -
`i5) - - (a)
BE IT ORDAINED , by the Council of- the town of Leesburg ,
in Virginia , that any person who drives a vehicle upon the
streets or highways of said town recklessly , or at a speed
or in a manner so as to endanger , or be likely to endanger
life , limb or property of any person shall be guilty of -
reckless driving , which shall constitute a misdemeanor:

Any person driving a vehicle on a street or highway of
the town shall drive the same at a careful rate of speed not
greater nor less than is reasonably proper , having due regard
to the traffic , surface and width of the street or highway or
any other conditions then exdsting. Any person who shall drive «>
_any vehicle upon a street or highway of said town at such
speed as to endanger the life limb or property of any person,
or so as to unnecessarily block , hinder or retard the orderly
and safe use of the street ,or highway by those following , or •
so as to cause congestion on the street or highway , shall be
• prima facie guilty of reckless driving. -
( c ) II
Any person who shall drive at a speed exceeding the speeds
set forth in this Ordinance shall be prima facie guilty of
reckless driving.
First . Fifteen mi-les an hour when passing a school during
recess or while children are going to or leaving school during
the opening and closing hours , provided , that markers be placed
- on the streets or highways so as to plainly show the location •
-of such schools. - - •
• Second. ;Fifteen miles an hour in a business district , as •
• defined herein. • .
Third. Twenty-five miles an hour in a residential district ,
as defined herein.
Fourth . The section of the town East of Liberty Street,
West of Church Street , South of Cornwall Street and North- of
Loudoun Street is hereby declared to be and designated a business
district and the rest of said town is hereby declared to be and
designated a residential district within the meaning of this
ordinance. • - -
• (d)
Reckless driving within the meaning -of this—Ordinance shall
be deemed to include the- following offenses , which are expressly
prohibited :
First. Driving a vehicle when not under proper control ,
or with inadequate or improperly adjusted brakes .
Second: Driving to the left of the center of the street
except -upon one-way streets , if and when the travel is permitted
only in one direction upon a street or streets.
• Third. Passing or attempting to pass two other vehidles
abreast mooing in the dame direction.
Foutth . Violation the provisions of the right of way laws , -
as set out in Section 2154( 123) and 2154 ( 124) in the -1936 Code
of Virginia.
Fifth. Failure to give adequate and timely signals of •
intention to turn, slow down or stop. • •
Sixth. Exceeding a reasonable speed under the circumstances

_and traffic . conditions obtaining atbthe time.
F - Seventh; Passing other vehicles going in the same direction
while crossing an intersection, or while pedestrians are passing
or about to pass in front of either of such vehicles.
Eighth. Driving a vehicle out of an alley; lane or building
• or- across a sidewalk onto a street., without first bringing such
vehicle to a fmll stop immediately before crossing such side-
- ' walk.
Ninth. Making a left turn without passing to the right of.•the . center point of the intersection, whether. marked or not ;
and; without first signalling his intention to so turn.
Tenth. Making a right turn without keeping close to the
curb, and without first signalling his intention to so turn.
_ Eleventh. Passing a shhool buss while taking on or dis-
charging children , whether going in the same or in opposite
direction, at a greater speed than five milesmper hour. :
Twelfth. - Failure of the operator of a motor vehicle ,
, trai4er, or semi-trailer to stop , .slow down dr regulate the speed
of' same to accord with the requirements of road. signs erected by
_ orupon the authority of the State Highway Commission or the
authorities of said town.
Thirteenth . Coasting or operating a motor vehicle with the
gears in neutral .

- : tiny person convicted_ of reckless driving under the pro-

visions of this Ordinance shall be-punishedlfor a first viola-
tion by a fine of not less than ten dollard nor more than one
hundred dollars , or confined in jail for aperiod not to exceed
thirty .days , or both, for conviction of subsequent violation
, -within twelve months fromthedate of prior conviction of
reckless driving , a fine of not less than fifty dollars nor

• more than five hundred`,dollars , or by imprisonment. in jail for
a period of not less than ten days nor, more than six months ,
or by both such fine and imprisonment.
.On motion of Councilman Flippo, seconded by Councilman
Hutchison and unanimously carried , the following Ordinance was
adopted ; _ •
_ . BE IT ORDAINED, by the Council . of the town of Leesburg ,
-in Virginia ; that, if any person commit simple assault or
battery upon another within the town of Leesburg , he shall be
guilty of a misdemeanor , and upon conviction, shall be fined
, not less than five dollars nor more than one -hundred dollars ,
or confined in jail not exceeding twelve months , or. both.

• man Hutchison and- Unanimously carried that the following, Ordinance
be :adopted ; _

BE IT• ORDAINED, by the Council. af the town or Leesburg ,
in`Vira_inia , that• i,t shall be unlawfull. for any person- or persons
- to resist, hinder , or obstruct- any officer or special police-
man of the town of Leesburg in making an arrest , serving a
warrant', order , notice , process , or in the performance or'
discharge of any of his duties. Any violation of the provis-
'� ' ions of this Ordinance shall constitute a misdemeanor , punthsh-
able by a fine of not less. than five dollars nor more than
. one hundred dollars , or confinement in jail for not less than
,tten days nor more than six months , or beth.
Upon motion off Councilman Hutchison ,. seconded by Council-
• man_ 'Flippo , and unanimously' carried , the following Ordinance was

BE IT ORDAINED, by the Council of the town of Leesburg,
, in Virginia ; that, if_ any person wilfully interrupt , molest ,
or' disturb the exercise of any private , public or free school ,
he shall be guilty of a misdemeanor , and ,. .upon, conviction thereof,
shall_ be fined not less than five dollars nor. more than one one
a hundred dollars', or confined in jail not more than six months ,
or both.
It was moved by Councilman Flippo , seconded by Council-
man Hutchison and unanimously carried that the following Ordinance
be adopted; •
BE IT ORDAINED; by the Council of the town of Leesburg ,
in Virginia , that if any• person curse , swear , or use vulgar
or profane language within the said town, or make Vulgar , •
obscene or indecent gestures or actions , or indecently expose
his person he shall be deemed guilty of a middemean or, and ,
upon conviction thereof, shall be fined not less than five-
dollars nor more than one hundred dollars , or confined in
jail not more than six months , or both.
On motion of Councilman Hutchison, seconded by Council-
man Taylor , and unanimously carried , the following Ordinance was
adopted; - -

BE IT ORDAINED , by •the Council of the town of Leesburg ,
in Virginia, that, if any person wilfully interrupt or dis •
-
turb any assemblage met for the worship of Dod or civic pur-
pose , he shall be deemed guilty of- a misdemeanor , and upon
conviction thereof, shall be fined not less than five dollars
nor more than one hundred dollars , or confined in jail for a
period of not more than six months , or both.
It was moved by Councilman Turley, seconded by Council-
man Hutchison; and unanimously carried , that the following Ordin-
ance be adopted ;
BE IT ORDAINED, by the Council of the town of Leesburg,
in Virginia, that it shall be unlawfull for any person to make
a noise , loiter or assemble with other persons on any street ,
sidewalk, or public place , to the annoyance , disturbance or
obstructimn of any person or persons ; or in such a manner as
etc) disturb the peace , - quiet , good order and convenience of
the town or person using the streets and sidewalks thereof.
Any person violating the provisions of this Ordinance shall
be deemed guilty of a misdemeanor , and, upon conviction , fined
not less than five dollars nor- more than one hundred dollars ,
or confined in jail not exceeding 30 days , or both. •

• Upon mo$ion of Councilman Hutchison, seconded- by Council- tman Flippp , and unanimously carried, the following Ordinance was
adopted ;
UP) - BE IT ORDAINED , by the Council of the town of Leesburg,
in• Virginia , that it shall be unlawfull for any oerson to
thro* into or place upon any street , alleys , sidewalks , or on
/ - private premises within the town of Leesburg , any carcass ,
/ rubbish , garbage , newspapers , handbills , dirt , filth,' shavings ,
manure ; offal , ashes , vegetables , fruit , glass , tacks', tin can , •
slop , soap-suds , water, or any other article , matter or sub-
stance of any kind or description calculated to render any
street , alley ; sidewalk or--private property unclean, unsightly
or unsafe or liable--to injuriously affect. the health or safety
of the community. Nor shall any garbage , rubbish, offal, or
filth or any kind or description be removed from private
premises and deposited within the corporate limits of the town, •
except at such place or places as may be provided by the council .
Any violation of this Ordinance shall constitute a misdemeanor ,
punishable by a fine of not less than one dollar nor more than
one hundred dollars , or confine& in jail not more than thirty
days , or both: wMeucr •

It was moved by Councilman Flippo , seconded by Council=
man Turley, and unanimously carried , that the following Ordinance
be adopted ;

BE IT ORDAINED, by the Council of the tvwn- of Leesburg,
• in Virginia , that it shall be unlawfull to permit water from
• any building , lot,• gutter, spigot or spout to flow accross
the sidewalk or foot-way of any street in this town, except
• a natural flow of water or unless the flow of water is covered;

. - the cover of which is not to be above the surface of such
foot-way, street or sidewalk, and such drain shall be of
sufficient capacity to confey the water received by it -and
shall be built , kept open and in good repair. by the owner
Or occupant of the premises which it drains. Any violation
of. this Ordinance shall constitute a misdemeanor, punish-
abtle. by- a fine of not less than one dollar nor more than
• ten dollars for each day such violation shall continue.
- On motion of Councilman Turley, seconded by Council-
man Taylor , and unanimously carried , the following Ordinancewas

//BE IT ORDAINED, by the Council of the town of Leesburg,
in' Virainia , that if any dog bite's or annoys any person or
animal •or is permitted to run after any person or other
animal in the streets in a vicious manner , the Mayor or Court
trying 'the case , upon proof of the same may order such dog to
be killed', by the "Sergeant , -or impose a - fine of not less than
• one dollar nor- more -than ten -dollars ; and if the- owner of the
dog shall conceal -it or otherwise hinder the Sergeant in
executing the order of the Mayor or Court , such person shall
be fined from five dollars to twenty dollars for each offense.
It shall be .unlawfull for the owner of 'any vicious dog -to
allow it to run at large in the town and for each violation
of this Ordinance , the Mayor or Court trying same shall impose
a fine not in excess of tewnty dollars , or order the Sergeant
to_ kill such dog. . _
It was moved by Councilman Rollins , seconded by Council-
man Flippo , and unanimously carried , that the following Resolution
be passed ;
BE IT RESOLVED, by the Council of the town of Leesburg,
in Virginia, that the Auditor-Treasurer be and he,ris hereby
authorized to purchase a suit of clothes and an overcoat for
the night-watchman, the cost of each not to exceed thirty
dollars ($30.00)
On motion of Councilman Turley , seconded by Councilman
• Flippo , and unanimously carried , the following Resolution was
passed; : _
BE IT RESOLVED; by the Council of: the town of Leesburg ,
in Virginia , that the Auditor-Treasurer, be and hp is hereby
p authorized. and empowered, -to employ an engineer to establish
a curb-line on the North side of West Loudoun street.
It was moved by Councilman Hutchison, seconded by Council
man Flippo , and unanimously carried, that the following Resolution
be passed ;

BE IT RESOLVED, by the Council of the town of Leesburg ,
mn Virginia , that -the :Auditor-Treasurer be and he is hereby
authorized to have constructed , by the town street force , a
driveway into, the property of Mr. H. L. Jenkins on the West
- s • side of South King Street', with the understanding that the
said Mr. Jenkins pay for same. .
On motion of Councilman Turley , seconded by Councilman
Rollins , and unanimously carried , the following Resolution was
passed,;

• - - BE IT RESOLVED, by the Council of tha town of Leesburg ,
in Virginia, that the Auditor-Treasurer be and he is hereby
authirized to have the town street force to repair the street
between tha paving of .the State Highway Department. and the
curb-line in front if the properties of Mrs. E. L. McFarland
and Mr. A. B. Richard , on the East and West side of South
King Street respectively.

It was moved by Councilman Rollins , seconded by Council-
man Hutchison and unanimously carried thet the following Resolution
be passed ; _
•
BE IT RESOLVED, by the Council of the town of Leesburg ,
in Virginia , that the Auditor-Treasurer be and he is hereby
authorized to prughase- five hundred ( 500) gallons of tar $f
possible , and if not to purchase one thousand ( 1000) gallons.
On motion of Councilman Turley , seconded by ,Councilman
Rollins , and unanimously carried , the following Ordinance was
adopted ;
BE IT ORDAINED , by the Council of the town of Leesburg;
in Virginia , that the Auditor-Treasurer 'be and he is hereby
authorized and instructed to pay the following hills :

At a special meeting of the Mayor and Town Council of the
town of Leesburg , in Virginia , held in the Council Chamber on Tues-
day October 5 , 1937 , at 7 :30 P. M. , there were present , Lucas D.
Phillips , Mayor; Louis T. Titus , Recorder ; and Roy M. Flippo ,
Lawrence S. Hutchison, Louis C. Rollins , J . D. Ta2lor , and Joseph
H. Turley, Councilmen. •
On motion of. Councilman Flippo , seconded by Councilman
Hutchison and unanimously carried the following Resolution• was
passed ;
BE IT RESOLVED, by the Council of the town of Leesburg,
in Virginia , that the Mayor be and- he is hereby. authorizedt
and empowered to sell the Leesburg Pumper #1 which is owned
by the said town, for the sum of $650.00 cash, but no
equipment , except such as was in it when purchased , shall- be
sold with the said pumper.
BE IT FURTHER RESOLVED, by the said Council that the
Mayor and' Recorder be and they are hereby authorized ,
instructed and directed to sign all of the necessary papers.
for the purpose of transferring title to the aforesaid pumper
to the purchaser , if and when $650.00 cash is received for
the said pumper.
There being no further business , on motion, the Council
adjourned . •
