ORDINANCE NO. 05 -897
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING SECTION 3328 OF THE TEMPLE CITY MUNICIPAL
CODE RELATIVE TO THE PLACEMENT OF AN OVERNIGHT
PARKING PERMIT ON A VEHICLE
WHEREAS, February 1, 2000 the City Council of the City of Temple City adopted Ordinance 00 -840,
which requires that overnight parking permits be visibly placed on the lower left -hand corner (driver's side)
rear window, and the permit shall not be effective unless so placed; and
WHEREAS, the City Council of the City of Temple City recognizes the requirement of overnight
parking permit holders to place annual parking permits on the lower left -hand corner (driver's side) rear
window; and
WHEREAS, the City Council of the City of Temple City recognizes that the requirement of overnight
parking permit holders to place temporary parking permits on the dashboard of the vehicle will allow law
enforcement officers a clear view of the permit; and
WHEREAS, the City Council of the City of Temple City seeks to utilize those tools which will assist in
the periodic and timely correction of motor vehicle congestion and parking conditions that may diminish the
quality of life, safety, and well -being of Temple City residents.
NOW, THEREFORE, the City Council of the City of Temple City does hereby ordain as follows:
SECTION 1. Section 3328 of the Temple City Municipal code is hereby amended to read in its
entirety as follows:
Duties of The Permit Holder:
(A) The annual perManent overnight parking permit shall be visibly placed on the lower left -hand
corner (driver's side) rear window, and the permit shall not be effective unless so placed.
(B) The temporary overnight parking permit shall be visibly placed face -up on the driver's side
dashboard are of the vehicle, and the permit shall not be effective unless so placed.
(C) A temporary parking permit shall not be effective unless it clearly displays, in ink, the vehicle
license plate number or vehicle identification number for the corresponding vehicle.
(D) A permit to park overnight by the provisions of the foregoing sections of this Article does not
authorize parking that is otherwise prohibited by State Law or other provisions of the Temple
City Municipal Code.
SECTION 2. The City Council hereby declares that, should any provision, section, subsection,
paragraph, sentence, clause, phrase, or word of this ordinance or any part thereof, be rendered or declared
invalid or unconstitutional by any final court action in a court of competent jurisdiction or by reason of any
preemptive legislation, such decision or action shall not affect the validity of the remaining section or portions
of the ordinance or part thereof. The City Council hereby declares that it would have independently adopted
the remaining provisions, sections, subsections, paragraphs, sentences, clauses, phrases, or words of this
ordinance irrespective of the fact that any one or more provisions, sections, subsections, paragraphs,
sentences, clauses, phrases, or words may be declared invalid or unconstitutional.
SECTION 3. The City Clerk shall certify to the passage and adoption of this ordinance and to its

approval by the Mayor and shall cause the same to be published according to law.

I, City Clerk of the City of Temple City, do hereby certify that the foregoing ordinance, Ordinance No.
05 -897, was introduced at the regular meeting of the City Council of the City of Temple City held on the 1st
day of March, 2005 and was duly passed, approved and adopted by said Council at their regular meeting
held on the 15th day of March, 2005 by the following vote:
