At a regular meeting of the Mayor and Town Council. of the
town of Leesburg , in Virginia , held in the Council Chamber on Monday
• January , 24 , 1936 at 7 :30 P. M. there were present ; Lucas D. Phillips ,
Mayor ; Louis T. Titus , Recorder ; Roy M. Flippo , John T . Hourihane ;
Lawrence S. Hutchison , Louis C. Rollins , J . D. Taylor and Joseph H.
Turley ,Councilmen.
The minutes of the last meeting were read and approved.
On motion of Councilman Hutchison seconded by Councilman ' 11
Curley , and unanimously carried the following Resolution was pdssed ;
. BE IT . RESOLVED , by the council of the Town of Leesburg , in
Virginia ; that the Auditor-Greasurer be and he is hereby author-
ized 9nstructed and directed to advertise for bids for new and
used one-half ton trucks , commonly known as "pick-up" trucks ,
and set a date when he will receive said bids by an appropriate
notice inserted one time in a newspaper published in Leesburg,
Virginia , and the Auditor-Treasurer shall present such bids as
he. receives to the council at its next regular meeting.
It was moved by Councilman Flippo seconded by Councilman
Eutchison, and unanimously carried , that the following Resolution
be passed ; •
WHEREAS , at the present time there is considerable traffic
congestion on the streets and highways in the Town of Leesburg ,
in Virginia ; and
WHEREAS; the council of the Town of Leesburg is of the
opinion that it is. adviseable for the Town to purchase a park-
ing lot for the purpose , among other things , of relieving con-
gestion and providing desirable parking facilities within the
said town ; . and
WHEREAS ; the said council is of the further opinicn that
the twoslota situated , lying and being in the said town , one
of which is known as the "Fadley Lot" and adjoins the other
• on the East , Loudoun Street on the north , the Cooksey and
:Murray lots on the West and Royal Street on the South , and the
other said lot adjoins the said°Fadley Lot" on the West ; Loudoun
Street on the North , William W. Warren and the W. R. Galleher
• Estate on the East and Royal Street on •the South , are more
suitable for a parking lot than any other lot or parcel of land
to be had within the said town at a reasonable price ;
NOW,THEHEFOEE , BE IT RESOLVED , by the Council of the Town
of Leesburg, in Virginia , that the •Auditor-Treasurer be and
he is hereby authorized , instructed and directed to enter into
agreements with the personal representative of the Henry J .
Fadley Estate and the heirs thereof, and the proper officials
of the St. James Episcopal Church of Leesburg , Virginia , for the
purchaseedf the said .two lots , located as aforesaid , by the
Town of Leesburg , in Virginia , provided same can be purchased
for a sum not to exceed 0 ,000.00 , and a fee simple title to and
possession of the said two lots can be obtained by December 15 ,
1938 , and the said agreements shall be made subject to the approval
of the purchase of said lots located as aforesaid by the said
town in the next budget thereof, and , also , subject to the
approval and confirmation by the Circuit Court of Loudoun
County , Virginia , of the sale of the said two lots or the
interest therein of the said Fadley Estate and the heirs' there-
of, and the said St. James Episcopal Church , of Leesburg ,
Virginia , to the extent such approval and confirmation by the
said court as shall be necessary for the -purpose of enabling
said town to secure an unencumbered title to the said lots , and
the' agreement to purchase one of said lots shall be condition-
ed upon the said town being anle to purchase the other said lot ;
and in the event said agreements aro- made , they shall contain
a clause requiring title to said lots to be conveyed to the Torn
of Leesburg, in Virginia , and require the seller or sellers to
institute such legal proceedings as may be necessary for the•
purpose of having a free and tnincumbered title to said lots
conveyed to the said town ; and the Auditor-Treasurer is
authorized to sign the name of the town to the said agreements
after, but not before , they are approved by the Town Attorney ;
and , in the event said agreements are entered into as aforesaid ,
and a free and unincumbered title thereto is conveyed to the
• town, the town will pay the owner or owners of said lotsor lots
' the price agreed on, which price is not to exceed the afore-
said sum of $4 ,000.00, on or before December 15 , 1938 , provided
said lots are conveyed to the said to-.rn as aforesaid .
It was moved by Councilman Hutchison , seconded by Council-
man Turley and unanimously carried, that the following Resolution be
passed ;
WHEREAS , the total indebtedness of the Town of Leesburg ,
is only Thirteen Thousand ($13 ,000.00) ; and
WHEREAS; the said debt is evidenced by thirteen (13) bonds
for One Thousand Dollars ($1;000.00) each and the said bonds
provide for 4Q per cent interest , payable , semi-annually; and
WHEREAS , since the said bonds were executed , interest on
bonds of many other municipalities has been reduced ,
especially when the debtor-municipality was in a good financial
condition ; and
WHEREAS , the said bonds of the- Town of Leesburg are
callable and payable at the present time ; and
WHEREAS , in view of the present sound condition of the
Town' s financial affairs , it is the unanimous opinion of the
' council that the rate of interest on the said bonds should be
reduced to 3 per cent.
- NOW; THEREFORE, BE IT UIU&NIMOUSLY RESOLVED, by the
Council-of the Town of Leesburg , In Virginia , that Mayor
Phillips and Recorder Titus be and they are hereby authorized
aqd directed to investigate the possibility of getting some
• person, persons , firm of corporation to take over the said
bonds pursuant to an agreement with the Town to accept 3 per
cqnt interest thereon in lieu of the present rate of 42 per
cen$ and accept payment of any or all of the ' said bonds when
the Town shall be able or desirous of paying off and dis- '
• charging the said debt or ahy part thereof within the time the
said bonds shall become due and payable.
BE IT FURTHER UNANIMOUSLY RESOLVED, by the said council
of the Town of Leesburg , in Virginia that it is the desire of
• the said council and the said Mayor Phillips and Recorder Titus
are hereby authorized and instructed to give the present
holders of the said bonds an opportunity to enter an agree-
ment with. the Town for the acceptance of 3 per cent on the
said bonds subject to the conditions stipulated in the pre-
ceding paragraph before attempting to negotiate such an agree-
` ment with any other person , persons ; firm or corporation .
l On motion of Councilman Turley, seconded by Councilman
Hutchison , and unanimously carried , the following Ordinance was
adopted ;
WHEREAS , the Council of the Town of Leesburg , in Virginia ,
is advised that it is necessary to adopt a zoning Ordinance
before zoning districts can be established within the -Town for
the purpose of preventing or restricting certain kinds of
buildings and other improvements ; and
WHEREAS, it is the belief of the council that a zoning
Ordinance should be established in the said town in accord •

ance with Chapter 123 A of the 1936 Code of Virginda by
dividing the Town into one or more districts of such shape and
area as may be deemed best for the promotion of health , safety ,

morals ; comfort , prosperity and general we.lfare 'of the public ;
and •
WHEREAS? it is the desire of the said council to take all .
' necessary action by institution and prosecuting appropriate
proceedings to establish zoning districts within the said town ;
and
WHEREAS, the said council is advised that' in order to
carry into effect the establishment of said zoning districts
it is necessary to have the Circuit Court of Loudoun County,
Virginia , appoint a zoning commission to study and recommend
to said council the boundries of the various original districts
and appropriate regulations to' be enforced therein ; and
WHEREAS•, the said council is further advised that in order
to have the said Court appoint a zoning commission for the .
purpose aforesaid , it is •necessary to institute proceedings
in the said Court for the purpose of requesting the appoint-
ment of said zoning commission :
NOW;THEREFORE,BE IT ORDAINED , by the Council of the Town
of Leesburg , in Virginia , that the institution of appropriate
proceedings in the Circuit Court of Loudoun County , Virginia ,
be and the same is hereby authorized for the purpose of having
a zoning commission appointed to enable the said council to
carry into effect the establishment of zoning districts and
providing for appropriate regulations thereof within the said
town; and
BE IT FURTHER ORDAINED , by the said council of the Town of
Leesburg , in Virginia , that Stilson H. Hall , Town Attorney , be
• and he is hereby authorized , instructed and directed to
institute and prosecute all necessary and proper proceedings
for the purpose of enabling the said council to establish or
have established zoning districts and to provide appropriate
regulations- therefor within the said town of Leesburg . in
Virginia ; and '
BF IT FURTHER ORDAINED, by the sabd Council of the Town of
Leesburg , in Virginia , that the Auditor-Treasurer be- and he is
• hereby authorized , instructed and directed to ddvance or pay
the necessary and required Court costs for the purpose of
instituting and prosecuting the aforesaid proceedings in the
Circuit Court of Loudoun County, Virginia ; and
BE IT FURTHER ORDAINED , by the council of the said town of
Leesburg , in Virginia , that the Recorder be and he is hereby
authorized , instructed and directed to send or deliver two
certified copies of this Ordinance to the aforesaid Stilson H.
• Hall , Town, Attorney.
On motion df Councilman Hourihane , seconded by Councilman
Rollins and unanimously carried , the following Ordinance was adopted ;
BE IT ORDAINED ; by the Council of the Town of Leesburg ,
• in Virginia , that the Auditor-Treasurer be and he is hereby
authorized and instructed to pay the following bills ;

Virginia Public Service Company - - - - 3.81
E. L. Poston - 2.25
Total - - - $ 16;06
There being no further. business .on motion duly made ,
