HomeMy Public PortalAbout1938_04_11' 1.22 April , 11 , 1938 . • At a regular meeting of the Mayor and Town Council of the town of Leesburg , in Virginia held in the Cotncil Chamber on Monday, April 11 , 1938 at .7 :30 P. Ill: there were present ; Lucas D. Phillips , Mayor ; Louis T . Titus . Recorder ; Roy M. Flippo , John T. Hourihane , Lawrence B. Hutchison , L. C . Rollins , J. D. Taylor and Joseph H. Turley , Councilmen. The minutes of a special meeting held on April 5 , 1936 for the purpose of giving the public andopportunity to discuss the proposed budget for the next fiscal year , were read and approved. On motion of Councilman Hutchison seconded by Councilman Hourihane and unanimously carried , the following Resolution was . passed ; BE IT RESOLVED, by the council of the town of Leesburg , in Virginia , that the Mayor and the Recorder be and they' are hereby authorized to have published , an appropriate notice , in each of the two weekly newspapers in the town of Leesburg for the purpose of notifying the public that hearings will be held by the council of the said town , in the Council Chamber in the Town Hall Building of said town, on Wednesday April 20 , 1936 at 7 :30 O 'clock P. M. for the purpose of giving any citizen or tax-payer of the town• the right to present any; objection or offer any suggestions in regard to or criticisms of the tax Ordinance which was introduced at the last special meeting of the Council on the 5th day of April , 1938. It was moved by Councilman Taylor secpnded by Councilman Hutchison and unanimously carried , that the following Resolution be passed ; Whereas , The Chesapeake and Potomac Telephone Company of ., Virginia , in consideration of its franchise granted by the council of the town of Leesburg on the 24th day of April 1917 , and the rights and priveleges enjoyed by virtue of said franchise within the said town of Leesburg has agreed to "provide and maintain , free of charge , two ( 2) unlimited individual line telephone stations and ( 1 ) auxiliary bell ( or at the option of said "Town" the cost equivalent thereof in other types of local exchange service) to be located along its lines at certain points , to be designated by said "Town" , within the limits of the Town of Leesburg , and to furnish free service for municipal business from said individual line telephone stations to all subscribers ' stations of said "Telephone Company" located within the local service area of Leesburg. "Except as changed or modified by agreement of the parties , said arrangements shall continue in effect so long •as "Telephone Company" , its successors and assigns , enjoys and exercises the rights and priveleges granted by said ordinance of the 24th day of April , 19$7. " Row, therefore , 4E IT RESOLVED , by the council of the town of Leesburg , in Virginia , that the Recorder and Mayor ' • be and they are hereby authorized , instructed and directed to sign an appropriate agreement between the said town and the said Chesapeake and Potomac Telephone Company of Virginia for the purpose of enabling the said town to secure the • aforesaid telephone. service upon the terms and conditions for the consideration aforesaid. The Mayor read an opinion in regard:-to all advertising of the town of Leesburg in the local newsrapers , a copy of which is filed with the Recorder ' s records. On motion of Councilman Turley , seconded by Councilman Flippo and carried-, :(Uouncilman Taylor not voting) , tin the following Resolution was -passed; 123 Whereas , there are two weekly newspapers in the town of Leesburg ; and • Whereas , the town. has Ordinances , Resolutions , Financial statements , notices and other matters for publication from time to time ; add ▪ Whereas , it is the desire of the council of the said town to apportion its. advertising between the two said newspapers do as to be- fair and impartial to each paper; and • Whereas , the council believes it. would be for the best interest of the town for the council to adopt such a policy as it deems fair and just to each of the said newspapers ; end . Whereas , the council appreciates the service rendered the town heretofore by the two local newspapers by publishing at appropriate times the news relative to the affairs of the town; and - .• Whereas , the council of the town believes that the best interest of the town will be served by the town paying the said newspapers the usual rate for advertising ; and . Whereas , the council is. of the further opinion that the welfare -of. the town will be served beet by maintaining: such business relations between the town and the said newspapers as will encourage said newspapers to feel free to criticize any acts• of the council or town government without fear of; retaliation from the officials of the town ; and - Whereas , the council further ,believes that a free? and - Unbiased press is one of the greatest protectors of the rights of the people and the promotion of efficient government ; 'and that the newspapers should he encouraged to comment ons and criticize the activities of the government ; ane Whereas , even though it feels compelled to reject the same for the purpose of enabling it _to estsblish what !it deems to be a sound policy , the council wishes to express its appreciation to the local newspaper, which has offered' to publish the proposed tax ordinance or any other town publication for one dollar : Now, .therefore , BE IT RESOLVED , by the Council of' the Town .of Leesburg , in Virginia ; that pje Auditor-Treasurer..be and he • is hereby authorized , instructed and directed to divide all • Ordinances , Resolutions , Notices Financial Statements , Budgets and other papers , which the council' may hereafter authorize to be published , from time to time ; equally between the two local newspapers located within the town of Leesburg. BE IT FURTHER RESOLVED , by the said council of the town of • Leesburg , in Virginia , that the town will- pay the usual rate • charged by the said newspapers for advertising. The Auditor-Treasurer read his monthly report for the month Il of march-. • On motion of Councilman Hutchison , seconded by Corncilman Turley and unanimously carried the following Ordinance was adopted ; BE IT ORDAINED, by the Council of the Town of Leesburg , in Virginia that the Auditor-Treasurer be and he is hereby authorized instructed and directed to pay the following bills ; 124 3 Virginia Public Service Company (Mayor ' s Office) - S 4:62 (Fire House ) 4 .61 ( Street Lighting) 119 :62 (Whiteway' Lighting) 89 . 50 (General Pumping 160:07 (Harrison Pumpin4 1:00 Chesapeake & Potomac Telephone Company - - - - .65 C. Davis Company 9 .08 Hanline Brothers 16.50 Neptune Meter Comonay 148. 78 Total - - - -$723.97 On motion of Councilman Turley , seconded by Councilman Hutchison and unanimously carried , the following Resolution was passed ; Whereas , the council has been informed' that the Town Water Supply has been approved by the State Health Department ; and Whereas ; the council has been further informed that the Town can purchase "Public Water Supply Approved" signs for approximately $2 . 50 each ; and Whereas , the council deems it wise and appropriate to purchase four of the said signs for the Town : Now therefore ; Be ' IT RESOLVED, by the council of the town of Leesburg , in Virginia , that the Auditor-Treasurer be and he is hereby authorized , instructed and d.irected ' to purchase four "Public Water Supply Approved"csigns and he is further authorized to draw a check for payment of the purchase price of said signs . BE IT FURTHER RESOLVED , by the said council of the Town of Leesburg , in Virginia , that the Recorder be and he is hereby . authorized and instructed to give the Auditor-Treasurer a certified • copy of this resolution. On motion of Councilman Hutchison , seconded by Councilman Flippo and unanimously carried , that following Ordinance we's passed ; BE IT ORDAINED, by the Council of the Town of Leesburg , on Virginia that the .9adatyroTrMr:uGcrF. Kitts for hauling the garbage from the town from April 1 , 1938nto July 1 , 1938 be increased to $75.00 per month. • • On motion of Councilman Turley , seconded by Councilman Taylor and unanimously carried the following ,Ordinance was adopted ; BE IT ORDAINED, by the Council of:the Town of Leesburg , in Virginia , that the Auditor-Treasurer IDs hereby authorized ; instructed and directed to fiureha'se a uniform for the day police officer the cost not to exceed +30.00. Li. , for the purpose of giving • the public an ppportunity to make objection to to suggestions regarding the proposed tax and license Ordinance , there were present ; Lucas D. Phillips , Mayor ; Louis T. Titus , Recorder ; Roy M. Flippo , II John T. Hourihane , L. S. Hutchison , L. C . Rollins . J . D. Taylor and Joseph H. Turley , Councilmen. r The minutes of the last regular meeting were read and approved. Those present other than the Council and town officials were ; Mr . J . E. &drain , Mr. J . W. Robey , Mr. George R. Hughes and . " Mr. Bivlighun and Mr . Millner of _the press . The Recorder read the proposed tax and license Ordinance and same was discussed by the Council and the Mayor . On motion of Councilman Taylor seconded by Councilman Hutchison and unanimoua ;y carried the following Resolution was passed ; • BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the -Auditor-Treasurer be and he is hereby authorized and directed to have published by one insertion in a newspaper in the said town , the Tax and License Ordinance which was introduced and laid on the table at the Council meeting , Tuesday April , 5 , 1938 , and also a notice that there will be a meeting of the Council in the Council Chambef at the Town t Hall Building on the 17th. day of May , 1937 at 7 :30 P.
