Special Called Meeting
Tybee Island, Georgia
June 5, 1990
Mayor Pro tem James C. Brown called the meeting to order at 7 P.M.
Council members present were Paul Jackson, Jeff Dukes, Pat Locklear, Jack
Youmans and Bill Walsh. City Attorney Thomas Mahoney was also present.
The purpose of this meeting is to hear evidence on the Novelty
Bar incident involving Mrs. Dawn Leedy and her husband Richard Leedy and
to decide what action should be taken on the business and Budget Adjustments.
Mayor Pro tem Brown asked Cpl. Axtell to give his statement concerning
this incident. Cpl. Axtell stated that on numerous occasions since he started
working the walking patrol on 16th Street he has been called because of the
same kind of related incidents. Cpl. Axtell said on that night he was asked by
Mrs. Leedy to get her husband to leave the bar, he was intoxicated and showed
belligerence, resisted arrest and he arrested him for disorderly conduct. He
said that Mrs. Leedy was also intoxicated. Councilman Youmans asked Cpl. Axtell
if Mrs. Leedy asked him to remove Mr. Leedy from the business. Cpl. Axtell
replied yes. Mrs. Leedy's attorney, Mr. John Sugrue, asked what was the purpose
of taking all 9 of the business licenses. Cpl. Axtell said that some were torn
and on the floor. Mr. Sugrue asked why did you keep them till Tuesday? Axtell
replied that he did not personally keep them. Mr. Sugrue ask if Mrs. Leedy ask
you to take the licenses. Axtell - no. Mr. Sugrue - Did you contact the City
Marshall? Axtell - no, I called the chief of Police. Mr. Sugrue - where were
you located before being asked for help. Axtell - next door at the Anchor Bar.
Officer Barlow gave some background information about incidents at
the Novelty Bar. He stated that he was the back up officer the night in question.
Chief McCutchen said that he told Axtell since the business licenses
was torn, to pick them up and bring them to the police station and to tell
the people to get in touch with him the next day. The chief also advised Council-
man Brown. The chief recommends some type of probation period. The chief said
that the bar was closed for that night only. Councilman Dukes asked if anyone
was arrested? Yes, Mr. Leedy for disorderly conduct. Chief McCutchen stated that
the Novelty Bar is not a problem business.
Councilman Dukes made a motion to place the Novelty Bar on probation
for 30 days and to base it on domestic incidents. Councilman Walsh seconded.
Mayor Pro tem Brown called for a vote and it was unanimous..
The next item was the Budget Adjustments for the first quarter.
Councilman Locklear made a motion to accept the budget that Councilman Dukes
worked so long and hard on getting ready. Councilman Jackson seconded. The
vote was unanimous by council.

Councilman Dukes said that we will have another budget
adjustment coming up in July and that it won't take him as long
to get the figures together because he now knows how to do it.
Councilman Youmans made a motion to recess the meeting
and go on with the agenda prep meeting. Councilman Brown seconded.
the vote was unanimous. Mayor Hosti was also present and will
conduct the agenda meeting.
The special meeting will reconvene for a personnel matter after the agenda
meeting. Councilman Youmans made a motion to reopen the special meeting.
Councilman Brown seconded. Council in favor. Councilman Brown then made
a motion to close the meeting and go into executive session to discuss
a personnel matter. Councilman Locklear seconded. The vote was unanimous.
