Alexander; - It. was moved by Councilman Rollins , •seconded by Councilman Flippo and- carried that the contract for the removal of garbage be awarded to Fisher and Scott. ,r.,. - Councilman Flippo introduced a Resolution in regard- to a modern and up-to-date sewer syetet andadisposal plant, and requested that same be laid on the table• for-'further consideration: It was' moved by Councilman Hutchison- secondedby- Councilman Flippo and unanimously 'carried that thefollowing Resoluti'on:'-be passed; BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia that the Xudi'tot=4rbAatret -be and he--is hereby authorized to pay-the following--bilis ; . ' !YOR la _ las - 4 RECORDER . • June 29 , 1938 • At a special meeting of the .Mayor -and Town Council of The Town of Leesburg , -in Virginia held in .the Council Chamber on Wednesday June 29 , 1938 at 9 :00 F. M. there were present, Lucas D. Phillips, Mayor , Louis T. Titus , Recorder ; Roy M. Flippo; D.John .T. Hourihane , Lawrence H. Hutchison, L. C. Rollins •& J. D. Tailor , Councilmen. On motion of Councilman Hutchison, seconded by Councilman Hourihane and carried the following. .F.esolution was passed,; • BE IT RESOLVED, by the Council-. ofthe Town ,of..Leesburg , • in Virginia, that Thomas S. Alexander be and he is hereby, awarded the contract for the hauling of slop for the -Town of Leesburg from July 1 , 1938 to_ July. 1 ; 1939 , for the , sum. of • $480.00, payable in 24 equal installments , semi-monthly, during the said 12 months period and the said Alexander shall be required to haul and remove the slops out of the said town and deposit same so that it will not create a ` nuisance or annoyance-to -anyone within or without the said Town and the said slpos shall be removed twice each week ' during the Winter months and three times each week during the summer months on and during regular working hours' from thehouses and places of business within the said town and the officials bfthe said town shall have the right to determine what is to be considered as slop; and Stilson EL Hall-, Town Attorney, is hereby authorized and instructed- to prepare a proper contract for the purpose of carrying this Resolution into effect and the said Alexander and the Town of Leesburg shall be made parties thereto and thesame shall be signed by the Mayor for the said Town and it shall also be signed by the said Thomas A. Alexander and shall contain a clause or stipulation requiring the said Alexander to indemnify and save harmless the town from any liability to any person for any injury caused by him in the performance of said contract • • . 147: • to any :person, persons orproperty and also any ,servantsl employees or agents he may employ in 'carrying out the terms of .the said contract which -shall be made pursuant to this Resolution, and the said Stilson H: Hall -id further authorized to include such other provisions in said contract as he may deem necessary and wise for the protection of the town and specifying what shall be done by the said Alexander ; and the said Alexander shall be required - to give a bond -in the sum of $480.00, to be approved by the Mayor and the said Town Attorney , within 5 days from the passage of this Resolution for the purpose of insuring the daithful performance of the -aforesaid contract to be executed pursuant- to 'the provisions of' this Resolution. On motion• of Councilman Hutchison, seconded by Councilman Flippo and carried the following Resolution Was. -passed ; • BE IT RESOLVED, by the Council' of the Town _ of Leesburg, in Virginia, . that T. E. Fisher and L. A. Scott be and, they . are hereby awarded the contract for hauling garbage and rubbish for the Town of Leesburg from July 1 , 1938 , to July 1 ,:. 1939 , for the sum of '.$900.00, payable in 12 qqual installments , one of which said payments shall be made at the end of each month during the said 12 months period and '' the said Fisher and. Scott shall be required to haul and remove the said garbage and rubbish to a point or -place outside of the said-town and deposit same so that- it will not create a nuisance or-- annoyance to anyone within or without the said town and the said garbage and rubbish shall be removed on Friday of each week during regular working-hours from the streets and/or sidewalks within the said town-and the officials of the said town shh11 have the right to- determine what is to be considered as garbage and rubbish; and Stilson H. Hall , Town Attorney, is hereby authorized and instructed- to prepare a proper contract for the purpose of carrying this Resolution into effect and the said Fisher-and Scott and the .Town -of Leesburg shall be made parties thereto and the same shall be signed by the Mayor for the Town and it shall also be signed by the said Fisher and Scott and shall 'contain .a clause or stipulation requiring the said Fished -and- Scott to indemnify and save harmless the town- from 'any liability to any .person for any injury caused- by them in the performance of said contract to any .person,- persons-, or: property or and also servants , employees or agents they may employ in carrying out ,the terms of the said contract which shall, be made - : :pursuantdtorthis Resolution and the said Stilson H. Hall is . further authorized and directed to include such other provisions in said contract as he may deem necessary and wise ',for the protection of the town and epecifying what shall be done by the said Fisher and Scott ;and the said Fisher and Scott ' shall be required to give bond in the sum of $900.00, to be approved by the Mayor and the said town attorney, ' within 5 days from the passage of this Resolution for the purpose of insuring the faithful performance of the aforesaid contract tobe executed pursuant to the provisions of this Resolution.
