Phillips , Mayor ; Roy M. Flippo, John T. Hourihane , L. C. Rollins , J. D Taylor and Joseph .H. Turley , Councilmen. S • Others present were; H. H. Williams, Kenneth Cromer, Thomas Kivlighan, N. P. Nielsen, G. S. Myers, George- R. Hughes and Roscoe B. Rhoads. ' Mr. H. H. Williams of the McCrary Engineering Company of Atlanta, Georgia , was recognized and gave a resume ' .of the workings of the P. W. A. in regard to sewerage systems and ' disposal plants. He also explained numerous details relative to • installation of sewer systems- and disposal plants. • There was a general discussion of the matter of a' • • sewer system and disposal plant for the Town of Leesburg after which Mr. Williams stated that the town could not look to save more than from 8% to 10% were the contracts let to private bids for•' the construction of a sewer system and disposal plant for the ' town. There being no further- bu'siness , on motion= duly • made-, seconded and carried the Council adjourned; • • v MAYOR. . July 11, 1938 • At a regular meeting of the Mayor and Town Council of ' the Town of Leesburg , in Virginia held in the Council Chamber. on Monday, July 11 , 1938 at 8 :007'. M. there were present ; Lucas D. Phillips ,Mayor; Louis T. Titus, Recorder ; Roy M. Flippo , John T. Hourihane , L. C. Rollins , J . D. Taylor and Joseph H. Turley , Councilmen. The minutes of meetings held on June 27th, June 29th and July 7 , 1938 were read and approved. The Recorder read a letter , estimate and bid in .regard to the proposed sewerage -system and. disposal plant to beconstructed by the Town of Leesburg. • • On motion of Councilman Turley , seconded by Councilman Flippo 'and unanimously carried by the following recorded vote; Roy M. Flippo.,mJohn T. Hourihane, Louis C- Rollins , John D. Taylor , and Joseph H.. 'Turley ; the following Resolution was passed; WHEREAS, a large number of the citizens and residents of the Town of Leesburg have no sewage facilities and ••the 'Town has no disposal plant;' and WHEREAS, the present sewerage is- emtied in' what.-is:.-known as the Town Branch, a short distance above where the said branch enters the land belonging to the heirs of-the- L. G. Caviness Estate- and the said heirs have notified the Mayor- and Council in writing that they expect to institute proceedings to enjoin the emptying of sewerage into the said branch or stream in the event the town does not institute the necessary proceedings for the purpose of constructing a disposal plant to treat sewerage- before emptying same in- the said stream; and WHEREAS , the Council is informed that there is a possibility of securing a 45 per cent grant from- the Federal Emengency Administration of Public Works with which to finance the install&lation and construction of a modern sewer system and disposal plant , provided the Town will finance the remaining 55 149 per cent 'of the costs of installing end erecting said sewer system ' and disposal plant ; and . • -WHEREAS, . it is the opinion of the Council that mapy of the unsanitary-:conditions which exist in the Town are caused by or the • 1 result of the lack of a proper sewer system and disposal plant; and :WHEREAS, the Council recognizes that , if the Town should I be enjoined ,from emptying sewerage into' the. said,stream, the same would cause those in the !own who now hate sewerage facilities great inconvenience and put them to heavy expense in providing . means for the disposing of sewerage and that the same would make 4he present unsanitary conditions worse ; . and • . WHEREAS, the Council is of the further opinion that , because ofthe possibility of securing the aforesaid ' grant from the Federal Emergency Administration of Public Works and the and the unsanitary conditions which exist today and the possibility of the Town 'being enjoined from continuing -to empty sewerage in the said stream, it is to the best interest of the citizens , inhabitants and ppeperty owners in the Town, individually and collectively, to install , erect and construct a sewer system and disposaliplan:t_ so as to make sewerage facilities available- to each residemt in the Town; . . :,NOW THEREFORE, . • BE IT UNANIMOUSLY RESOLVED, by the Mayor and Council of the Town of Leesburg, in Virginia , that Stilson H. Hall , Town Attorney, be and.he is .hereby authorized, instructed-- and directed to institute the necessary proceedings;in the Circuit Court- of Loudoun County , Virginia , for the purpose -of. calling and holding a special -election for the purpose of submitting- to' the voters of . the Town .the question of a bond issue or the issuing of bonds for the purpose of raising sufficient funds or money with -which to pay for 55 per cent of the costs of installing , erecting,& constructing a sewerage system and disposal plant- for- the said Town of Leesburg, in Virginia, and the said Stilson H. Hall , Town Attorney, is•- furtherJauthorized , instructed and directed to prepare- all the . necessary notices , petitions , orders and other papers for the ' purpose`of submitting the question or proposal-to the:voters- of the said town- to raise the necessary funds with which to pay 55 per cent of the costs- of- installing, erecting and- constructing- the said sewerage 'System• and disposal plant, and Roscoe B-. Rhoads, Auditor- Treasurer, is hereby authorized to draw a check or checks for the paymenjr of`all necessary and- incidental costs in connection- with the submitting—of -the said question--or proposal for -a bond issue to the voters of the Town. - BE IT FURTHER UNANIMOUSLY RESOLVED; by the said- Mayor and Council of the Town of Leesburg , in Virginia, that the said Stilson H. Hall', Town Attorney, be and he is. hereby selected, ,appointed . and authorized to represent the Town of Leesburg as its attorney and he is hereby authorized , instructed and directed to prepare , execute and file an application for the grant from the Federal Emergency Administration of Public Works , an- agency of the Government of the -United States -of America, for the purpose of • inStallation, obtaining a grant from the United States of America to aid in the erection, construction and establishment of a sewer system and disposal plant for the bald Town of Leesburg, in Virginia, for the purpose of making available to' the residents ; inhabitants and property owners in the said town ample sewerage facilities ;_ but the acceptance of the said grant -shall be contitioned upon -and made subject to the approval of a bond issue by the voters of the said- town for the purpose of raising 55 per cent of the funds with which to pay the costs of constructing said sewer system and disposal plant; and the said- Town shall notbeliable to the -said Stilson H. Hall for any charges for Services rendered to the Town pursuant to this resolution until the voters of the said Town shall by a majority vote in -favor of a bond issue to raise tTeprovide sufficient funds for the installation and 150 • construction• of the said sewer system and disposal plant; but the said town shall be liable to said--Stilson H. Hall , Town- Attorney , for Mich services as he performs in carrying out the •instructions embodied in this resolution in the sum. of one ter ' cent (1 o/o) of the total amount of the costs of installing and - constructing said sewer system and disposal plant and such: . travelling expenses and other costs as he may incurr in expediting and promoting construction work _on the said sewer system and disposal plant , but the said sum shall not be paid the said Sfllson .H. Hall' until after the said sewer system- and. disposal plant shall have been completed. ' . • • . BE IT FURTHER UNANIMOUSLY RESOLVED, by- the said Mayor . . • and Council of the Town of Leesburg, in Virginia, that the Rust • Engineering Company, a Corporation oftWashington, D. C. , be and it is hereby designated and appointed by the said Council as engineer to perform all necessary services in connection with the . aforesaid proposed sewer system and disposal plant in and for the Town- of Leesburg , in Virginia, which services are to be performed in compliance, with and subject to the: following terms and. conditions : If AND• when the said" Federal Emergency Administration of : public Works makes or approves a 45 per cent grant to the Town, • and a 55 per cent loan with which to construct the said sewer system and dosposal plant , or when the said Federal Emergency Administration of Public Works approves or makes a 45 percent grant and• 55 per cent of the costs necessary to complete the in- stallation and construction of said. sewer system. and disposal . plant shall become available. by bond issue or .otherwise , then . the, said town of Leesburg , in Virginia , shall be liable to the-said- . Rust Engineering Company , Inc. , for six percent ( 6 %) of the total cost• of the sewer system and disposal plant to be installed and constructed as aforesaid ( if same shall be completed) .and " • the said' Rust Engineering Company, Inc. , shall prepare preliminary . ' and complete plans of the specifications for the construction of . t••. - the said proposed sewer system and disposal plant; make application - to the Federal Emergency Administration of Public Works for a loan and grant or grants; secure the approval of the State Board • of Health; secure the approval of the Federal Emergency Administration of Public ,Works ; secure bids for the work of constructing said . proposed sewer system and disposal plant;' furnish all necessary " engineering services necessary to supervise said construction work; a complete plan of the work. as installed ; and in addition::: to the- allowance heretofore set out , if same shall become necessary, the council. hereby gives its consent and authorizes.'the ' engineer in charge of the work to make any out-ofttown trips • which may be necessary to secure approval of the State Boatel or :other . governing bodies to expedite the work and the said council shall authorize the payment of: bills for such expenses. BE IT FURTHER RESOLVED; by the said Council of the said Town of Leesburg; in Virginia:;; that Louis T. Titus , Recorder for the said Town be , and he is hereby authorized , instructed .and - - directed to furnish the said Stilson H. Hall and the Rust Engineering Company , Inc. , with as. many certified copies of this resolution as they may need in carrying out the duties imposed by said Resolution. On motion of Cou4cilman Flippo seconded by Councilman Turley. and unanimously carried the following Resolution was passed ; BE IT RESOLVED, by the Council of the Town of Leesburg.; • in Virginia ,that Lucas D. Phillips , Mayor , be and he is hereby authorized and- instructed to call a meeting of the voters , citizens and taxpayers of the Town to be: held in the Court House or auditorium of the Town Hall at such time: as he may deem appropriate for the purpose of giving the officials of the Town : and the voters , taxpayers and citizens an opportunity to discuss and present' their views on the proposal to construct a new sewer system and dthsposal plant for the Town of Leesburg and notice of said meeting shall be published by one ( 1) insertion in each of the two ( 2) weekly newspapers in the Town of Leesburg , Virginia. kIt•i.. r-. • 151 Th'e Auditor-Treasurer read .his monthly report- for the month of June.' • On motion .of Councilman Hourihane , seconded by Councilman Turley and unanimously carried:, the following Resolution was passed ; BE IT RESOLVED , by the Council of the Town of Leesburg , in 'Virginia that the Auditor-'Treasurer be and he is hereby II authorized ; instructed and directed to pay the following bills ; Virginia Public Service Company . • j (Mayor' s office & Fire . K. Wilson, Jr. 'be employes to paint . the roof 'of the town .water tank and _also the roofs of the "24, • buildings -and 'reservoir at the :pumping station:
