Wilson Jr. for the said so8d sum of $45.00 in payment • for the aforesaid painting. On motion of Councilman Turley seconded by Councilman Flippo and unanimously carried -that the. following Resolution Was IIpassed; • ' BE -IT- RESOLVED, by the Council of the Town of Leesburg, in Virginia , -that the-Auditor-Treasurer be and he is hereby authorized , instructed and directed to purchase the necessary paint, oils and other materials , to paint the roof of the Town Water tank -and the foofs of the buildings and the reservior-at the pumping station. . - • Co1.P. M. Anderson- was present and addressed the Council in regard to a -Municipal-Power System and Distribution. System and made an oral-- offer to make the necessary preliminary survey in connection with the said- project , if the Town was interested in such a project-;for the sum of $150.00 and would do the engineering of the •project- for- 6%eof- the total cost. - • • The Council took no action on this matter. Turley , Couflcilmen. • Councilman Turley presented an Ordinance in regard to the issuing of bonds in connection with the proposed sower system and ' disposal plant for the town of Leesburg. -and• requestedtthat same be laid on the table for further consideration. . --•-• - - There being no further business , on motion duly made, seconded and carried , the coulcil adjourned-. flea 05.0•14. • . M. there were present ; Lucas D. Phillips , Mayor; Louis T. Titus , Recorder; -Roy M. Flippo , 'John T. Hourihane , L. S. Hutchison, L. C. Rollins, J. D. Taylor, and -Joseph H. Turley , Councilmen. 153 On motion- of Councilman Hourihane , seconded by Councilman Turley and unanimously carried by the following recorded affirmative vote; Roy- L Flippo , John T. Hourihane, Lawrence S. Hutchison., L. C. 'Rellins , J. D. Taylor and Joseph H: Turley , the following Ordinance was adopted; • AN ORDINANCE PROVIDING FOR THE ISSUANCE OF BONDS FOR THE TOWN OF LEESBURG; IN VIRGINIA , IN THE SUM OF $82 ,500.00, FOR TEE' DONSTRUCT ION BY SAID TOWN. OF A SEWERAGE SYSTEM AND ERECTION OF A DISPOSAL PLANT IN ORDER TO SECURE A GRANT -FROM .THE UNITED STATES OF AMERICA IN AID THEREOF. WHEREAS,- a lerge part of the Town .of Leesburg, in Virginia, and the residents thereof have no sewerage facilities; and WHEREAS , the saidittown and the residents thereof have no disposal plant with which to dispose of the sewerage from said* town which is -now- emptieddinto--the -Town Branch; mid- ' WHEREAS, there are numerous unsanitary conditions in the Town as a result of the lack of an adequate sewerage :systed `and- disposal` plant ; and - WHEREAS, the council Os of the opinion that- it- -is • necessary and expedient to establish a sewerage system and erect a disposal plant for the said town of Leesburg , in Virginia , for the purpose of furnishing said town and the inhabitants • thereof- with ample sewerage facilities and a disposal plant; and WHEREAS, under the- provisions of -Section- 127 (b) of the Conctitution and- the- Statutes of -the Commonwealth of -Virginia , theCsaid town of Leesburg, in Virginia , is authorized to issue its genera/ obligation bonds payable from the revenue of tts sewerage system and disposal. - plant and ad valorem taxes :' • - - NOW, •THEREFORE, BE •IT UNANIMOUSLY ORDAINEDbythe Council of the Town of Leesburg, in Virginia , that it is deemed necessary .and expedient for the twan to borrow the sum of $82 ,500.00 for the purpose-of constructing a sewerge system and the",erecting of a disposal plant for the said. town and the inhabitants thereof and to issue general obligation bonds of the town to borrow the- said sum of $82 ,500.00 to pay the cost of constructing said sewerge systeo and `--the�eredt30n_tif, said -disposal plant and to secure the necessary real estate , easements and right-of-ways to be used':in Constructing said sewerage system and erecting said disposal plant, in - order to secure-- a grant from- the United States Government. • - BE IT FURTHER UNANIMOUSLY ORDAINED,.-by the Council of the said Town of Leesburg , in Virginia, that-, subject- to the approval of the necessary -number of--voters of the said town voting in the election -heretofore and-hereby authorized , the, borrowing- of the sum of $82 ,500.00 to be used for the, purpose of constructing a sewerage system and disposal plant` be and the same is-hereby authorized , and Stilson H. Hall , Town Attorney. for the said town, be and he is hereby • • authorized, .instructed and directed to in titute and-prosecute the necessary proceedings in the Circuit Court of .Loudoun -County, Virginia , for the purpose of holding- an- election to submit to the voters-of said town 8^.proposal - for-a bond 'issue to borrow the sum of $82 ,500-:00 to- be used in con- structing said sewerage system and ereoting said disposal plant and the - said bonds shall be general obligation bonds,,,•; . of the said town of Leesburg, in Virginia, -for- the sum of -- $82-,500.00, and 82 of which bonds are to be of the denomination of $1 ,000.00 each and one of said bonds is to be in the denomination of $500.00 and all of said bonds shall be dated December let , 1938 , and said bonds shall bear interest at a rate not to exceed4 per annum, 154 • • with •interest payable on the lst day; of June , 1939 , and semi-annually . thereafter on the 1st day of June and December in each year until maturity, and shall be serial .: coupon bonds maturing over a period of 24 years. on DeoezDer 1st of each pfathe years as follows : L ; 1939 $1;500.00 1950 $4,000.00 1940 , 2 ,000.00 1951 4,000.00 1941. . 2,000.00 1952 4,000.00 1942 2 ,000.00 1953- 5,000.00 1943 2 ;000.00 1954 5,000.00 1944 2 ,000;00 1955 5,000.00 1945 . 2 ,000.00 1956 5;000.00 1946 3,000.00 1957 5,000.00 n : c 1947 3 ,000.00 1958 5,000:00 1948 3 ,000.00 1959 • 5,000.00 1949 3,000.00 1960 5,000.00 1961 5,000.00 But said bonds shall contain a' clause .permitting same, to, - - em''(i✓) be called/find paid at any interest payment date after 5 years from the date of their issuance and the said bonds and the interest thereon shall be payable at the office . . • of the Treasurer of the said Town of Leesburg, in Virginia•; and the holder shall have- the- option of registering said bonds as to principal only. - BE IT FURTHER UNANIMOUSLY ORDAINED, by the' Council -of the Town of.Leesburg , in Virginia, that a certified copy . - of this Ordinance be forthwith presented to the Circuit Court of Loudoun County, Virginia, or the Judge thereof in Vacation, by Stilson H. -Hall, Town Attorney, with the request that the said Court.;. or. Judge , thereof, enter an order . directing the proper election officials to take such •steps and prepare such means as may be necessary to submit tb the qualified voters in the Town of Leesburg, Virginiawthe question or proposal as to whether or not the bonds her-ein- before authorized shall be issued , at a special election,. . :and the said Judge be further requested to enter such order as may be-proper - or necessary-to- give due publicity to said election; -, • BE IT FURTHER UNANIMOUSLY ORDAINED, by "the said Council of the Town of Leesburg, in Virginia, that this Ordinance shall be effective from its adop.tion. - • • • ( Signed) _ -. In compliance with a Resolution passed by the Council on July 11 , 1938 the Mayor announced that July 28 , 1938 had'been set as the date for a public meeting to be held- in the Couit: House at Leesburg•, Virginia for the purpose of giving the Town Officials , citizens , tax-payers and voters to present and discuss their views on the proposed sewerage system and disposal plant. A proper notice was sent to the two newspapers published in the Town` of Le'eaburg; for publication in one issue of each.
