' APPROVED: �- F.ECORDEP 61a November 8 , 1938 v At a Special meeting of the Mayor and Town Council of the Town of Leesburg , in Virginia held in the Council Chamber on Tuesday, November 8; 1938 at 7 :00 P. M. , there were present ; Lucas D. Phillips , Mayor , Louis T. Titus , Recorder; Roy M. Flippo , John T. Hourinane , Louis C. Rollins , John D. Taylor and Joseph H. Turley , Councilmen. The' Mayer statedtthat the purpose of the meeting was to open and consider sealed bids for bonds in the amofnt of $82 , 500:00 to aid in the construction of the proposed sewersystem and disposal plant in connection with a grant from the P.W.A. of 4,67 ;500.00, and any Other business that might properly come before the meeting. _ On motion of Councilman Turley, andcdnly b,pcandedi8ndn carried , nominations were made in order; by the Mayor , for a - Councilman due to the resignation of Councilman Lawrence S. Hutchison. II . Councilman Turley nominated Mr. James E. Adrain and this nomination was seconded by Councilman Rollins. There being no further nominations , on motion duly made , seconded and carried., nomination were closed. . On motion of Councilman Turley , seconded by Councilman Rollins and unanimously carried the follwwing Resolution was adopted ; . WHEREAS, Lawrence S. Hutchison, Councilman has resigned his office as such and hie said resignation has been accepted by the Council : N0W,THEREFORE, BE IT RESOLVED , by the Cluncil of the Town of Leesburg , in Virginia , that James E. Adrain be and he is hereby seledted , appointed and elected Councilman of the Town of Leesburg , in Virginia to fill the unexpired term of said Lawrence S. Hutchison. Mr. .James E. Adrain was summoned to the Council Chamber and informed of the Council ' s action and asked if he would accept the appointment of Councilman to fill the unexpired term of Lawrence S. ' Rutchison. Mr. Adrain stated that he would accept and was duly qualified by Mayor Phillips seting as A Commissioner in Chancery for the Circuit Court of Loudoun County , Virginia. . . • On motion of Councilman Hourihane , seconded by Councilman . Turley and unanimously carried , the following Resolution was adopted ; 176 WHEREAS , the Judge of the Circuit Court of Loudoun County , Virginia;, has entered an order , a certified. copy • . - of which has been presented to the Council of the Town' of Leesburg , in Virginia , authorizing the Town to issue and sell or negotiate the sale of bonds amounting to Eighty- Tvo Thousand Five Hundred Dollars ($82 ,500:00) to finance the construction of a sewerage system and disposal plant ' for the said Town : NOSY,- THEREFORE , BE IT RESOLVED , by the Council of the Town of Leesburg , in Virginia , that the Recorder be and :he - - is hereby authorized , instructed and directed to spread the said order of the Circuit Court of Loudoun County , upon the record book of the Town Council. . IN RE : TOWN OF LEESBUEG, IN VIRGINIA A certificate of the Clerk of the Circuit Court of Loudoun County , made in accordance with Section 3087 of the Code of Virginia , setting forth the result of a special electionrheld in the. Town of Leesburg , in Virginia ; in the county of Loudoun on the 16th . day of August , 1938,. on the question of whether or. not bonds• . of the said. town should be issued was filed on the 17th day of August , 1938: And it appearing that the certificate is in accordance with the laws of the State' of Virginia , in shch cases made and provided , and that a majority of the vitesz cast- . at the said special election are for the proposed bond issue. of. Eighty;Two Thousand Five Hundred Dollars , the bonds to be• payable as set out in an ordinance of the Town Council of Said town of Leesburg , in Virginia , passed on the 19th day of July, 1938, and• to bear interest at a rate not to exceed four per cent per•:annum, payable semi-annually , two hundred seventy -.one votes having been cast for the said bond issue and nthnety- ,six votes having been cast against the said bond issue ; whereipon , it is ordered that the said special election be and the same is 'r; hereby approved , and it is further- ordered that the Clerk of ; the Circuit Court of Loudoun County be and he is hereby . directed to forthwith certify a copy of this order to the Council of the Town of Leesburg , in Virginia , whereupon the said Town of Leesburg , in Virginia , shall be fully authorized and empowered to issue and to sell or negotiate bonds upon the • faith, credit and property of the said town , to the amount of Eighty-Two Thousand Five Hundred Dollars as authorized by the said special election held in -the said town of Leesburg , in Virginia , the 16th day of August, 1938 , in accordance with. the laws of this State governing such elections and in issuingsaid bonds the said Council shall be governed by the provisions of Chapter 122 of the Code of Virginia as amended. WHEREAS, • pnrsuant to resolution heretofore adopted by the Council, Roscoe B. Rhoads , Auditor-Treasurer , ordered 100 water meters from the Neptume Meter Company. and has received a bill for same ; and WHEREAS , the Officials of the Neptune M IIWHEREAS , Company have informed the Officials of the Town that by paying for said meters within 30- days from the date of shipment the town, will be allowed 5 per cent discount.: . NOW, THEREFORE, BE IT RESOLVED, • by the Council of the Town of Leesburg , in Virginia , that Roscoe B. •Rhoads , Auditor- Treasurer , be- and he is hereby authorized ,- instructed and directed to draw a check to the order of the Neptune Meter Company in the sum of $855.00 in payment of the said bill for .100 Neptune water meters. The bids received for the $82 ,500.00 Sewerage Syatem and Treatment Plant Bonds of the Town of Leesburg , in Virginia were opened and read. . Upon motion of Councilman Hourihane seconded by Councilman Turley -and unanimously carried , the Council went into Executive Session for the purpose of determining a successful bidder: After discussion and careful consideration the bidders were recalled to the Council Chamber to explain details of the bidding and then were askdd to retire. IAfter further discussion and careful consideration of the bids upon motion of Councilman Turley seconded by Councilman Flippo and unanimously carried the Council adjourned the Executive • Session. The bidders were again recalled to the Council Chamber and upon"motion' o_` Councilman Turley , seconded by Councilman Flippo and unanimously carried by the following voting aye.; Louis C. . Rollins , John T. Eourihane,, Joseph H., Turley ,• Roy M. Flippo and. John D. Taylor ; voting nay; None ; the following Resolution was adopted ; A RESOLUTION ACCEPTING BID FOR THE SALE OF THE ISSUE OF EIGHTY-TWO THOUSAND FIVE HUNDRED DOLLAES($82 ,500:00) . SEWERAGE SYSTEM AND TREATMENT PLANT BONDS OF THE TOWN OF LEESBURG , IN VIRGINIA. . . • WHEREAS, by revolution heretofore adopted , Louis T. Titus , Recorder, was instructed to advertise for bids for $82 , 500:00 Sewerage Syatem and Treatment Plant Bonds,, Series of 1938 , dated December 1 , 1938 , and payable as set out in anOrdtnance passed' by the Council on the 19th day of July, 1938; and WHEREAS , the said Louis T . Titus , Recorder , advertised that bids would be received for said bonds and a meeting held in the Council Chambers of the Town Hall Building , Leesburg , Virginia , at 7 :00 P. M. , November 8 , 1936 , at which time the bids would be opened .by the said Louis T. C. 82 ; 713:68 - @ 2 3/4 % And whereas , the Council deems it most advantageous for the Town to accept the bid of Scott , Horner & Mason , Inc. ; which is for $82 ,639 . 79 with an interest or coupon rate of 2 3/4 per cent : t . N047, THEREFORE , BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia:, that the bid of Scott , Horner and Mason, Inc. , for $82 , 500.00 Sewerage System and Treatment Plant Bonds at $82 ,639 .79- with a coupon rate of 2 3/4 per cent be and the same is hereby accepted and approved and the Auditor-Treasurer is hereby authorized , instructed and directed to deposit the check of the said Scott , Horner &. Mason• Inc. in one of the depository banks in the Town of Leesburg in -a- special account and the Recorder is hereby authorized, instructed and directed to return immediately the checks of the other bidders for said bonds. • There being no further business , on motion duly made , seconded and carried , the Council adjourned . M. , there were present , Lucas D. Phillips , Mayor:; Louis T. Titus , Recorder ; J. E. Adrain , Eby M; Flippo , Louis C. Rollins ,- John Ti- Hourihane,, J . D. Taylor and . Joseph H. Turley , Qouncilmen. The minutes of a special meeting held on October 26 , Spl of October 31 , and a special meeting held on November 8th. were read and upon- motion duly made , seconded and carried were approved as read. • The recorder read a letter from Mr. Robert E. Lee , Agent for the Sinclair Refining Company in regard to connecting to the town water system for the Sinclair Filling Station on the South of the Corporate limits/ . On motion of Councilman Turley seconded by Councilman' Hourihane and unanimously carried the matter was laid on the table. • • The Auditor Treasurer read his monthly statement for the month of October .
