At A special meeting of the Mayor and Town Council of the
Town of Leesburg held in the Council Chamber on Tuesday November 29 ,
1938 at 12 O'Clock Noon , there were present ; Lucas D. Phillips , Mayor ,
Louis T. Titus , Recorder; James E. Adrain, Roy M. Flippo , John T: -
Hourihane , Louis C. Rollins , John D. Taylor-and Joseph H. Turley,
Councilmen. -
At the above hour the Recorder read the following questions ;
Are all bids in?
Are there any objections to the plans and specifications
or method of procedure?
Has any person been denied the right or ppportunity to
bid on this work?
Having read the above questions the Recorder proceeded to
open the bids on the proposed sewerage system and disposal plant.
The bids were read by items by Mr. R. R. Cutler of the
Rust Engineering Company. (The bids may be found in the files of
the Recorder. )

On motion of Councilman Flippo , ' seconded by Councilman
Taylor and unanimously carried by the following Recorded vote :FOR
James E. Adrain, Roy M. Flippo , Louis C. Rollins , John D. Taylor',
and Joseph H. Turley , AGAINST : NONE, the Followimg Resolution was
adopted ;

RESOLUT'ION ORDERING THE FILING OF BIDS •
I WHEREAS , pursuant to advertisement , bids for the con-
struction of Sewer System and Disposal Plant for the Town
of Leesburg , in Virginia , have been filed by the following
Bidders : W.. C. Spratt , Fredericksburg, Virginia ; Ligon and
Ligon, Baltimore , Maryland ; Biekelhaupt , Inc. , 1737 Summit
Avenue , Richmond , Virginia ; F. L. Showalter , Inc: , Lynchburg ,
Virginia ; David A. Calabrese , Arlington, Virginia ; A. G.
Pinkston and Company , Norfolk , Virginia ; Marocco Construction
Company , Inc. , 231 South Exeter Street , Baltimore , Maryland ;
that said bids have been duly received , opened and publicly •
read : .
NOW,- THEREFORE , BE IT RESOLVED That the bids listed in:
the preamble hereof be filed and presented to E. R. Cutler ;
representing the Rust Engineering Company , Inc. , Consulting
Engineer , and that the Said H.. B. Cutler , is hereby directed
forthwith. to tabulate said bids , and at the earliest
practicable moment , report to this Council , his findings as
to the bowest and best bid.
Passed this 29th day of November , 1936.
Olmotion of Councilman Turley seconded by Councilman `
Flippo and nanimously cesried the Council recessed at 1 :30 P. i•i.
to reconvene at about 4 : 00 t. M.
The Mayor and Council reconvened at 4 :15 P. M.
Mr. R. E. Cutler , of the Rust Engineering Company,
Consulting Engineers , was asked to report his findings on making
the tabulations of the bids and also to Make recommendations as
to the best bid.
Mr. Cutler made a few explanatory remarks and recommended
that the council accept the bid of W. C. Spratt , of Fredericksburg ,
Virginia for $136 ,165.25 subject to a change order of the P.W.A.
Mr. Cutler was granted permission to call via phone , the
P.W.A. office in Atlanta , Ga. for confirmation of that chhnge order.

The Recorder read a proposed Resolution Awarding .the
Contract.
Upon motion of Councilman Turley seconded by Councilman
Hourihane and unanimously carried by the following .Eecorded Vote ;
• FOR : James E. Adrain,Roy M. Flippo , John T. Hourihane , .Louis C.
Rollins , John D. Taylor and Joseph H. Turley ; AGAINST : NONE , the
following Resolution was adopted ; .
. ' . RESOLUTION AWARDING CONTRACT
WHEREAS , E. R. Cutler , representing the Fust Engineering
Company , Inc . , Consulting Engineer , pursuant to a Resolution
heretofore adopted , has tabulated and considered all bids
heretofore received for the construction of Sewer System and
Disposal Plant and has duly made his recommendations to this
Council , and it appearing from said recommendations and
repott that W. C. Spratt is the lowest and best bidder for
the construction of Sewer System and Disposal Plant , in the
sum of f136 ,165.25; . and that„this Council , after considering
said report and recommendations and all bids heretofore filed , ,:
finds ,that the bid of W. C. Spratt is the lowest and best bid :
NOW, THEREFORE, BE IT RESOLVED BY THY COUNCIL OF THF.
TOWN OF LEESBURG; IN VIRGINIA , AS FOLLOWS :
Section 1. That the bid of W. C. Spratt , for . the
Construction of Sewer System and Disposal Plant in. the sum of
$136 ,165.25 ; is hereby accepted , determined and- declared to
be the .lowest and best bid ; however , this award shall not be
effective until the awardee shall have been notified in
writing by the Mayor of this Council of such award . That •
upon the awardee being so notified in writing a contract for •
the construction of said work , as heretofore prescribed by
the ,plans , specifications and contract documents , shall be
forthwith executed for said construction.
Section 2. That Lucas D. Phillips , Mayor , is hereby
authorized and directed to execute said contract in the name •
of and .for. and on behalf of Town of Leesburg , in Virginia .
On motion -of Councilman Flippo seconded by Councilman
Hourihane and unanimously carried the following Resolution was
adopted ;

WHEREAS , the plans -and specifications prepared by the
Rust Engineering Company , Incorporated , for the construction
of a proposed - sewerage system and disposal treatment plant for
the Town of Leesburg , in Virginia , show that it will be
necessary for the Town to acquire certain properties and
easements before the said sewerage sysyem and disposal
treatment . plant can be constructed :
NOW; THEREFI#E , BE IT RESOLVED , by the Council of the
• Town of Leesburg , in Virginia , that Stilson H. Hall , Town
Attorney , be and he is hereby authorized , instructed and
directed to communicate or negotiate with the owners of the
property or properties which will have to be- purchased and
the easements and rights .of way which it will be necessary
to acquire over and through. certain properties .for .the
purpose of determining the costs of said property or
properties and easements and rights of way and report to
;,,, ,the Counci-1 as soon as it is convenient to do so .
Upon motion duly made seconded and carried the Council adjourned.
