A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL
FROM R-3 (One to Eight Family Residence District) TO R-3 (Special Use)
Whereas, the Zoning Map designates certain property commonly known as 136 Northwest H
Street, Richmond, Indiana and legally described as follows, to wit:
Lot 36 H A L (Hannah Leeds Addition), Parcel No.
46-32-140-229.000-29 (0.1004A )
as an R-3 as outlined on Exhibit A; and
Whereas, it is desirable to change the above described real estate's zoning designation to
an R-3 Special Use District in order to allow the owner to use said real estate as a
daycare business,
Whereas, A sign no larger than 2'x3' be allowed to be placed in the front yard,
Whereas, The sign may not be internally illuminated,
Whereas, Staff parking must be on the cement slab at the rear of the property,
Whereas, Any change of business plan that alters the nature of the business would require an
amendment to the rezoning ordinance,
Whereas, The site must meet all child care facility requirements of the Indiana Family Social
Services Agency,
Whereas, Pursuant to IC 36-7-4-921, these commitments shall be binding upon:
the owner of the parcel;
a subsequent owner of the parcel; and
a person who acquires an interest in the parcel,
Whereas, In the event that any of the aforementioned restrictions or requirements of the Richmond
City Code are not met in full, the Special Use Rezoning is at that moment in violation of
the Richmond City Code.
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that
the zoning designation for the above described property is changed to a R-3, Special Use District.
Passed and adopted this 15th day of October, 2007, by the Common Council of the City of
Richmond, Indiana.
