Councilman - Taylor and. unanimously carried the following Resolttion
was adopted ;
BE IT RESOLVED, by the Council of the Town of Leesburg ,
in Virginia , that the Auditor-Treasurer be and he is hereby •

• At a regular meeting of the Mayor and Town Council of the
Town of Leesburg , in Virginia held in the Council Chamber on Monday ,
January 23 , 1939 , at 7 :30 P. M. there were present , Lucas D. Phillips ,
Mayor ; Louis T.- Titus , Recorder ; EEoy M. Flippo , John T . Hourihane,
Louis C . Rollins and Joseph H. Turley , Councilmen.
The minutes of the last meeting were read and upon motion
duly made , seconded and carried , were approved as read .
The resignation of Councilman James E. Adrain was read and
upon motion of,Councilman Turley , seconded by Councilman Hourihane
and unanimously carried the following Resolution was adopted ;
WHEREAS Council_:,an James E. Adrain has submitted his.
resignation dated January 17th , 1939 , and requested that same be
accepted -to become effevtive as of the date it was signed :
• Now, THEREFORE, BE IT RESOLVED, by the Council of the town
of Leesburg, in Virginia , that the said resignation of James F. Adrain
as Councilman of the said town be and the same is hereby accepted.

The Recorder read the report of the Town Attorney on the
progress of securing easements for the construction of the sewer
- project, said report stating that the Town Attorney believed that
all of the owners of the property through which it will be necessary
to construct said sewer project , will grant easements to the town
except Jphn Grimes , Rhoda Ridgeway , Eva Crough and Edwin E. Garrett ,
for the nominal sum. • -
Mr. L. T. Frye appeared before the Council in behalf of the
Leesburg- Fire Company to ask that the Council have the interkor of
• both the- Fire House and the Fire Company Recreation Room painted as
the Fire. Company contemplated- some improvements to the floors but
did not wish to-make any improvements until the rooms were painted.
• The matter was referred to the Fire Committee for
investigation.
- The Mayor stated that the Town Attorney was present and
if the Council cared to go into an executive session the Town Attorney
would make a detailed report of his findings in regard to• the
securing- of easements for the sewer system. _

- Upon Motion of Councilman Flippo , seconded by Councilman
Turley and unanimously carried the Council was declared in Executive
sessiOnr:and all: present except the Mayor , Recorder , Councilmen ,
Town Attorney and Auditor-Treasurer were asked to retire from the
Council Chamber;
• Stilson E. Hall , Town Attorney , in-detail at length
reported- his findings and progress in securing easements and rights
of way for the new sewer system and disposal plant, including the
property. already acquired from the Heirs of the L. G. Caviness Est .
. Councilman Taylor reported -at 8 :15 P. M.
Town Attorne$ continued his discussion and asked the
Council of it wished to Make formal offers to those who would not
grant easements to the town.
' The Council expreessed a desire to make the said offers.
Upon -motion- of Councilman Hourihane , seconded by
Councilman Flippo and unanimously carried the executive session was
adjourned.
Upon motion of Councilman Turley , seconded by Councilman
Flippo and unanimously carried , the following Resolution was adopted ;
WHEREAS , -by Resolution adopted .by the Council of- the
Town of Leesburg , in Virginia , on theo29th day of November , 1938 ,
Stilson H. Hall , Town Attorney , was authorized , and directed to
communicate With the owners of the real estate through which sewer
lines will have to be constructed of the present sewer project is
completed according to the plans and spscifications ; and

WHEREAS , the said Stilson H. Hall has this day reported to
the Council in writing that he has communicated with the owners ,
their agents or attorneys , of the said real estate through which
it will be necessary to construct said sewer lines and he .believes
all of the owners of the said property except John Grimes , Rhoda
Ridgeway , Eva Crouch and Edwin .E. Garrett will grant unto the Town
easements for a nominal sum:
NOW; THEREFPRE, BE IT RESOLVED , by the Council of the
Town of Leesburg , in Virginia , that Stilson H. Hall , Town Attorney ,
be and he is hereby authorized , instructed amd directed to submit
to Edwin E. Garrett an offer of $40.00 for an easement or the right
and perthission for the Town of Leesburg to construct , maintain
and repair a sewer line across the lot of the said Edwin H. Garrett
from Market Street , to Cornwall Street between Liberty and Ayre
Streets ; to submit to John Grimes a written offer to pay him the
sum of $20.00 for an easement of the right to construct , maintain
and repair a sewer line through his' lot or parcel of land between
Church Street and east of the property owned by Matthew E. Ball on
the east side of Kink Street and South of South Street ; ,and to

submit to the said John Grimes another written offer to pay him the
sum. of $20.00 for an easement of the right to construct , maintain
and repair a sewer line through his lot from Loudoun Street. north-
ward to a lot owned by him, Rhoda Ridgeway , and Eva Crouch; and to
submit to the said John Grimes and Rhoda Ridgeway and Eva. Crouch a
written offer to pay them the sum of $10.00 for an easement or the
right to construct , maintain and repair a sewer line from the lot of
land owned by the said John Grimes onnthe South side of Fayette
Street..

Each of said offers shall contain a stipulation requiring
the town of Leesburg to pay the owner or owners of either of said
properties reasonable damage for any injury the town may do to any
of said properties while inspecting , maintaining or repairing same
after completion of the installation of the sewer project.
The said Stilson H . Hall is hereby instructed and
requested •to report back. to the council of the said town in regard
to reports or communications received by him from the aforesaid
offers , on Thursday , January 26 , 1939 , at. seven thirty o ' clock P.M. ,
at which 'time there will be a special meeting of the council to
receive the said report. •
There being no further business , on motion duly made ,
seconded' and carried , the Council adjourned.

' . At a special. meeting_ of the Mayor and Town Council of the
Town of Leesburg , in Virginia held in the Council 'Chamber on Thursday,
January. 26 , 1939 at 7 :30 P: M. there were present ; LucasyD. Phillips ,
Mayor ; Louis T. Titus , Recorder ; and Roy M. Flippo , John T . Hourihane ,
L. C. Rollins , J. D. Taylor and Joseph H. Turley , Councilmen.
The Mayor stated that the purpose of the meeting was to
receive the. report of the Town Attorney in regard to the offers
he wa's authorized to make in connection with the securing 'of
easements for the sewer linesmthrough the properties of Edwin E.
Garrett , John Grimes , Eva Crouch and Rhoda Ridgewaym and also to
consider such other matters as may properly brought before- the
Council.
The written report of the Town Attorney was read and Said
report -stated that there had been no replies to the Written offers
for the purchase of easements from Edwin F. Garrett , John Grimes ,
Eva Crouch or Rhoda Ridgeway , for a sewer line to be constructed
through their properties. The said report also stated that Payne
Diggs , thrcugh. his attorney , Mr. Kenneth Cromer , has demanded
payment in the amount 'of not less than $80 ,00 for the easement
through the property from Market Street to the Edds property
between Liberty and Ayre Streets.

On motion of Councilman Flippo', seconded by Councilman
Turley and unanimously. carried the following Resolution was .adopted
by the following recorded vote'; FOR Roy M. Flippo , John T . Hourihane',
L. C. Rollins , J. D. Taylor and Joseph H. Turley . AGAINST : • NONE.
