At a regular meeting of -the Mayor and Tovn -Council - of the
Town of Leesburg , in Virginia , .held in the Council Chamber on Monday
February 13 , 1939 at 7 :30 P. M. there were present ; Lucas D. Phillips ,
Mayor ; Louis T . Titus , Recorder and John T . Hourihane , L. C. Rollins ,
J. D. Taylor and Joseph H. 'Hurley , Councilmen.

The minutes of the last regular meeting held on January 26 , •
1939 and those of special meetings held on January 26 , and February
4 , 1939 were read and upon motion duly made seconded and carried , were
approved as read.
Upon motion of Councilman Taylor , seconded by Councilman
Turley and unanimously - carried the following Ordinance -was passed ;
WHEREAS , the Council has heretofore adopted a resolution
authorizing and directing the Auditor-Treasurer to install a
water meter at each residence , business establishment or place
where water is -used -from the Town' s Water Works or supply; and
WHEREAS, the Auditor-Treasurer has installed said meters
pursuant to the provisions of said resolution :

tNOW—THFFEFOR-E, BE IT ORDAINED , by the Council of the Town
of Leesburg , in Virginia , that each -business establishment , resi-
dence , boarding house or user of water supplied by the town shall
be required to pay a meter rate , and shall be required to conform
to the following provisions of this Ordinance , on and after
March 1 , 1939 : -
. FIRST : There shall be placed at the cost of the town on
each new service pipe supplied with water from the - town ' s water
system, to any business establishment , building or premises where
water is used one or more water meters .
SECOND: All water will be furnished by meter measurement ,
at the rate hereinafter prescribed , or such tates as may be
hereafter prescribed by the Council , and all water passing
through any meter shall be paid for according to meter reading
at . the prevailing rate specified by • the Council , whether used
or wasted. -
THIRD: -Each meter is the property of the town and at all
times subject to its control and inspection , and where any
meter is located on any private property , buildingdor premises ,
the town shall have the right to enter into aot upon the same at
all reasonable hours for the .purpose of inspection, repairing ,
replacing , or removing said meter , or to take meter readings.
FOURTH: Any meter injured from any cause directly or in-
directly attributable to the negligence -of the owner or occupant,
will be renewed or repaired by the town at ' the expense of the
said ,owner or occupant . -
FIFTH: If at any time a meter shall .be found to have been
tampered with , or for any reaso& fail to register , or shall
be found defective in registering since the last previous reading ,
the water consumption for such period may be estimated from other
similar meters and take the average of such readings through the
same period , or from past readings or from similar connections.
- SIXTH : All bills for the use of water shall be a charge
against the user - thereof, except where water is supplied to more
than one owner , family , occupant or 'user through a single service
pipe line on which there is only one meter , in which case the
owner of the property through which said service pipe line first
passes shall be charged for all water passing through said meter.

SEVENTH : That the minimum water' rate within the corporate
limits of. the twan .shall be $1.00 per month' and $2.00 per month
outside the corporate limits of said town , and the rate shall
be forty five cents per thousand for, the first fifty thousand
gallons , -thifty cents per thousand fall.the Secoh'd"fiftynth6naandt cu
gallons and twenty cents per thousand for all over one hundred
thousand gallons , and the rate for all users beyond the corporate .
limits shall be seventy-five cents per _thousan d gallons .
-' EIGHTH : That any property ownen outside the corporate limits
of the town shall. have _.the right , at his own expense , to connect
with the .water system of the town by paying all expenses incidental
thereto and assuming full responsibility for the repairing and
maintaining such additional lines as may be added to the present
water system, but the town reserves the right to shut off the
supply to any such user , in the event the same , in the opinion of
the town, shall become necessary for the purpose of supplying the
present users with water.
NINTH : That no connections with the present water system
shall be made without first making a written application to the
Auditor=Treasurer and obtaining from him a written permit , and
• all such connections shell be made in compliance with such
reasonable regulations as may be imposed bytthe Auditor-Treasurer
- or the Water Committee or such other regulations as may be
imposed by the Council, and all such regulations as may be imposed
shallbe stipulated in the written permit before it . is issued to
the applicant , All applications shall be made by the person or
persons , or in case of a firm , partnership , corporation or
association, by its official-or officials or duly authorized agent,
intending to use water , except where weter is supplied to more
than one owner , family , occupant or user through a single service
pipe line- in which case the owner of the property through which
said pipe line first passes shall-make the application. All
applications shall be made on forms furnished by the town and shall
stipulate that the applicant or applicants agree to pay for the
eater to be used .
TENTH : That the supply of. water to any business establishment,
institution , residence or place where water is used. shall be cut
. off in the event any bill for water is not paid within thirty days
from the date thiessame shall become due and payable. •
ELEVENTH : That each meter shall be read and bills- for the
water used rendered quarterly.

BE IT FURTHER ORDAINED'; by the said Council - of the Town of
Leesburg , in Virginia , that all Ordinances and Resolutions or
parts, thereof which are 'in conflict with the foregoing Ordinance
be and the- same are hereby repealed and recinded .
BE IT FURTHER ORDAINED , by the said Council of the town of
Leesburg , in Virginia , that Eospoe B. Rhoads , Auditor-Treasurer ,
be and he is hereby authorized and instructed to have the fore-
going Ordinance published by one . insertion in a newspaper published
in said town.
THE Auditor-Treasurer read his monthly report for the month
of January .
1 On .motion of Councilman Hourihane , seconded by Councilman
Turley and unanimously carried the following Resolution was adopted ;
BE IT RESOLVED , by the Council of the Town of Leesburg ,
in Virginia that the Auditor-Treasurer be and he is hereby
authorized , instructed and directed to pay the following bills ;

Onmotion of Councilman Turley , seconded by Councilman
Hourihane and unanimously carried , the following resolution was adopted ;
BE IT RESOLVED, by the Council of the Town Of Leesburg,
in Virginia that the Auditor-Treasurer be and he is hereby -
authorized , instructed and directed to purchase the necessary
paint and other materails with which to paint the Fire
Company Recreation Room and the Fire House on the interior.
BE IT FURTHER RESOLVED , by the said Council that the
Auditor-Treasurer be and he is hereby authorized , instructed
and directed to employ Mr. Allen M. Adrain, a member of the
Fire Company , to paint the said rooms.
There being no further business , on motion duly made ,
seconded and carried , the Council adjourned. at 8':53 E. M.

February 16 , 1939 SPECIAL
At a special meeting of the Mayor and Town Council of the •
Town of Leesburg , in Virginia held ih the Council- Chamber on Saturday ,
February 18 , 1939 at 3 :00 F. M. . there were present ; Lucas D. Phillips ,
Mayor ; Louis T . Titus , Recorder and John T. Hourihane , Louis C.
Rollins , J. D. Taylor and Joseph H. Turley , Councilmen.
- The Mayor stated that the purpose of the meeting was to
consider and adopt a resolution to instigate negotiations with
Edwin E. Garrett for the purpose of acquiring an easement through
property of said Edwin E. Garrett, and to consider any other matters •
that may be properly brought before the Council . •
A letter from Stilson H. Hall, Town Attorney was rend in
which said attorney reported that he had not secured an easement
from Edwin E. Garrett pursuant to a Resolution adopted at a special
meeting of the Council held on January 26 , 1939 . Said report also
stated that petition to appoint appraisers for the purpose of
condemin an easement in and through the lands of Edwin E. Garrett
was dismissed by the Circuit Court of Loudoun County, Virginia
on the 18th day of January 1939 , the Court Ruling that the Council
had. not given notice of a meeting which was held. for the purpose of
fixing a price for an easement in and through the said lands .
The Town Attorney , Stilson H. Hall was present and made
an oral report • to the Council in regard to the petitions for
easements in and through the lands of John Grimes ; John Grimes ,
Rhoda -Ridgeway and Eva Crouch and Edwin E. Garrett. He stated that
appraisers had been appointed to condem easements in and through
