Onmotion of Councilman Turley , seconded by Councilman
Bourihane and unanimously carried , the following resolution was adopted ;
BE IT RESOLVED , by the Council of the Town Of Leesburg ,
in Virginia that the Auditor-Treasurer be and he is hereby
authorized , instructed and directed to purchase the necessary
paint and other materails with which to paint the Fire
Company Recreation Room and the Fire House on the interior.
BE IT FURTHER RESOLVED , by the said Council that the
Auditor-Treasurer be and he is hereby authorized , instructed
and directed to employ Mr. Allen M. Adrain, a member of the
Fire Company , to paint the said rooms.

February 18 , 1939 SPECIAL
At a special meeting of the Mayor and Town Council of the .
Town of Leesburg, in Virginia held ih the Council• Chamber on Saturday ,
February 18 , 1939 at 3 :00 P. M. , there were present; Lucas P. Phillips,
Mayor ; Louis T . Titus , Recorder and John T. Hourihane , Louis C.
Rollins , J. D. Taylor and Joseph H. Turley , Councilmen.
- The Mayor stated that the purpose of the meeting was to
consider and adopt a resolution to instigate negotiations with
Edwin E. Garrett for the purpose of acquiring an easement through
. • property of said Edwin E. Garrett , and to consider any other matters •
that may be properly brought before the Council.
A letter from Stilson H. Hall, Town Attorney was read in
which said attorney reported that he had not secured an easement
from Edwin E. Garrett pursuant to a Resolution adopted at a special
meeting of the Council held on January 26 , 1939 . Said report also
stated that petition to appoint appraisers for the purpose of
condemin an easement in and through the lands of Edwin E. Garrett
was dismissed by the Circuit Court of Loudoun County, Virginia
on the 18th day of January 1939 , the Court Euling that the Council
had not given notice of a meeting which was held. for the purpose of
fixing a price for an easement in and through the said lands . -.. .
The Town Attorney , Stilson H. Hall was present and made
an oral report • to the Council in regard to the petitions• for
easements in and through the lands of John Grimes ; John Grimes ,
Rhoda -Ridgeway and Eva Crouch and Edwin. E. Garrett. He stated that
appraisers had been appointed to condem easements in and through

.the lands of Gohn Grimes ; John Grimes , Rhoda Ridgeway and Eva Crouch
and he also stated that the petition had been dismissed •by the
Circuit Court of Loudoun County , Virginia for the purpose of
condeming an easement through the lands of Edwin E. Garrett.
On motion of Councilman Turley , seconded by Councilman
Hourihane and unanimously adopted by- the following recorded vote :
FOE : John T: Hourihane , Louis C. Rollins , John D. Taylor and Joseph
E. Turley ; AGAINST : NONE , the following Resolution was adopted ;
WHEREAS; by Resolution passed" by the Council of the Town
of Leesburg , in Virginia , on the 23rd day of January , 1939 ,
Stilson• E. Hall , Town Attorney ,• was authorized , instructed
and directed to• submit to Edwin E. Garrett an offer of $40.00
for 'an easement .or right and permission for the said town of
Leesburg to construct , maimtain and repair a sewer pipe line
across the lot of :thb said Edwin E. Garrett from market Street
to Cornwall Street between Liberty and Ayre Streets ; and
WHEREAS , by Resolution passed by the said Council of the
Town of Leesburg , in Virginia , on the 26th day of January , 1939 ,
the said Stilson H. Hall , Town Attorney , was authorized , instructed
and directed to institute- condemnation proceedings to acquire
an easement through the said land of the said Edwin F. Garrett ;
and- - . . .
WHEREAS , the said condemnation_proceeding was filed in
the Circuit Court of Luudoun County , Virginia , on the 7th day
of February , 1939 ; and
WHEREAS , the said proceedings were dismissed by the said
Court on the 18th day of February, 1939 ; and
WHEREAS , the Council deems the said easement to be neces-
ary for the purpose of completing the construction of the
sewer project which has already been started in the said town
of Leesburg ; in Virginia :

NOW, THEREFORE , BE IT RESOLVED, by the Council of the .
Town of Leesburg , in Virginia , that Stilson H. Hall , Town Attorney ,
be and he is hereby authorized , instructed and directed to
submit to the said Edwin E. Garrett a new offer of 840.00 for
the Said easement to construct , operate and, maintain a sewer
pipe eight inches in diameter through and across his said lot
or parcel of land , not less than three and one-half feet• below
the surface , from the north side of West Market Street to the
south side of West Cornwall Street , between Ayre and Liberty
Streets , as is shown on a plat of the entire sewer system filed
in the Clerk' s Office of Loudoun County , Virginia on the 7th
day of February, 1939 , to the' extent of showing all easements
necessary to complete the construction of a sanitary sewer
system for the said town ; and the location of said easement
• which the town is seeking to acquire is described with more
particularity as follows : Beginning at a point mil-the north
• side of West Market Street in the line of the land conveyed to
the said Edwin E. Garrett by W. C. Orr and M. Page Orr by
deed bearing date of July 23 , 1912 , bf record in the Clerk' s
office of Loudoun County , Virginia , in Deed Book 8 Q' s , at
page 325, which said point is aprnx#mately ten feet west of
the southeast corner of said lot conveyed to said Garrett by
said W. C . Orr and M. Page Orr ; thence N 19° E 418 feet to a
point in the south line of Cornwall Street and the North line
of said lot conveyed to said Garrett by said deed dated July 23,
1912 , of record as. aforesaid , and said• last mentioned point is
approximately ten feet west of the northeast corner of said lot
conveyed •to said Garrett as aforesaid ; and the said lot or parcel
of land which was conveyed to the said Garrett as aforesaid by
deed dated July 23 , 1912 , is located in the Town of Leesburg,
Loudoun County , Virginia , and said offet of $40.00 to the said
• Edwin E. Garrett is final , and in' the event same is not accepted
or rejected on or before the 25th day of February , 1939 , the
said Council will consider negthtiations between the Town and
the said Edwin E. Garrett as having been completed.

BE IT FURTHER RESOLVED, by the said Council of the Town of
Leesburg , in Virginia , that the said Council deems the acquisi -
tion of said easement necessary to eneble the town to complete
the construction of a sanitary sewer system for the said town
of Leesburg , in Virginia.

BE IT FURTHER RESOLVED , by the said Council of the Town of
Leesburg , in Virginia , that Louis T. Titus , Recorder , be and he
is hereby authorized , instructed- and directed to forthwith
present to the said Stilson E. Hall , Town Attorney , four certi-
fied copies of this Resolution.
BE IT FURTHER RESOLVED, by the said Council of the Town of
Leesburg , in Virginia , that Stilson H. Hall-, Town Attorney, be
and he is hereby authorizedm instructed and directed to have
• the Sheriff of Loudoun County , Virginia , or one of his . Deputies ,
serve a certified copy of this Resolution on the said Edwin E.
Garrett. and such other papers or letters as he deemS advisable
and necessary.
There being no further fastness , on motion duly made ,
• seconded and carried , the Council adjourned..

At a regular meeting of the Mayor and Town Council of the
town of Leesburg , in Virginiam held in. the Council Chamber on Monday
February 27 , 1939 , at 7 :30 F. M. there were -present ; Lucas:iD. Phillips;
Mayor; . Louis T. Titus , Recorder ; and Roy M. Flippo , E. C . Rollins ,
J . D=- Taylor and Joseph H. Turley , Councilmen.

The Recorder read a letter from Mr. E. F. Garrett to Town
Attorney. Stilson B. Hall in which he stated that he would be very glad
to discuss the matter of an easement through his property with -the
Council upon his return from Florida . The letter also stated that
he (Mr. Garrett) was sorry that it was not the plensure of the Mayor
to call a meeting of the Council so as to give him (Mr. Garrett) an-
opportunity to discuss the matter of an easement with them.
After the above mentioned letter was read Mayor Phillips
stated that he wished to mkke it clear to, the Council that he had not
been requested to call a meeting of the Council by anyone in regard
to any easements and that therefore had not called a meeting.
A proposed Resolution authorizing condemnation proceedings
in the Circuit Court- of Loudoun County , Virginia for the purpose of
agquiring an easement through the lands of Edwin E. Garrett between
Market and Cornwall Streets between Wirt and Ayer Streets .
iJo action was taken on this matter .
On motion of Councilman Turley seconded by Councilman •
Flippo and unanimously carried the follwoing Resolution was adopted ;-
BE IT RESOLVED , by the Council of the Town of Leesburg,
in Virginia , that Roscoe B. Rhoads , Auditor-Treasurer be and
he -is hereby -authorized to pay Robert Atwell $90.00 per month
Waite he works regularly as night watchman.
Mr. t9. C. Whitmore , PostMaster appeared in regard to a
sewerage connection for the United States Post Office in Leesburg.
Mr. Whitmore Stated that he wished to know just how far that the
town would lay latteral connections to the new sewer.
