M. In the absence of the Mayor the Recorder acted in his stead . Upon motion of Councilman Turley, seconded by Councilman Rollins and unanimously carried , the following Resolution was adopted; • BE IT RESOLVED , by the Council of the Town of Leesburg , - in-Virginia , that the .Auditor-Treasurer be and he is hereby authorized , instructed and directed to purchase a new uniform for the day policeman , the cost , to the Town ,of which shall not exceed thirty dollars ($30.00) . The Auditor-Treasurer presented several bills and upon motion of Councilman Hourihane , seconded by Councilman Flippo and unanimously -carried , the following Resolution was adopted ; BE IT RESOLVED , by the Council of the Town of Leesburg , in Virginia , that the Auditor-Treasurer be and he is hereby, _authorized , instructed and directed to pay the following bills ; Virginia Public Service Company • (Mayor' s Office & Fire House ) - - $ 8.58 ( Harrison Pumping) - - 7120 ( Street Lighting) - • 118.36 ..(White Way Lighting) - - - - - - 89.50 _( General Pumping) 111.19 • Total .- - -$ 334.83 The minutes of a regular meeting held on Monday February 13 , -1939 , and those of a special meeting held on Saturday February 16 ; 1939 were read-, and upon motion duly made seconded and carried , were- approved as read . OF • March 6 , 1939 SPECIAL At a special meeting of the Mayor and Town Council bfi.the 'TAwnhofCLeesburftOineVirginia , held in the CouncilmChamber on Monday • .March 6 , 1939• at 8 :15 P. M. there were present ; Lucas D. Phillips , Mayor; Louis T. Titus , Recorder ; Roy Iii? Flippo , Louis C. Rollins , J. D. Taylor and Joseph H. Turley , Councilmen. The Mayor stated that the purpose of the meeting was to consider and adopt Resolutions to authorize institution of condem- nation proceedings to acquire certain easements necessary for the completion of the sewer project now in progress, and also to consider such other matters as might be properly brought before the Council. Mr. Y. E. Ball was present in the interest of an easement • through -his property on South King Street. He stated that he did not wish the sewer to be constructed through his property. Upon motion of Councilman Rollins , seconded by Councilman Turley and unanimously carried , Mr. M. E. Ball was offered the sum of $50:00 for the easement or right to construct ,maintain , repair and inspect a sewer pipe line through his property on South King Street. 2.O6 • Mr. Ball replied verbally that he would not accept $50.00 for the said easement. Mr. Ball agreed for the contractor Ieir. W. C. Spratt to proceed with the construction of the said sewer pipe line pending • • •an agreement between the Town of Leesburg and himself in regard to the easement . • On motion of Councilman Flippo , seconded by Councilman Turley and unanimously carried ; the following Resolution was adopted ; WHEREAS , by a resolution adopted by the Council of the Town •of Leesburg , in Virginia , on the 18th day of February , 1939 ; a cartified copy of which has • been served on Edwin E. Garrett , the said town offered the said Edwin E. Garrett the sum of Fo,t'y Dollars ( $40.00) for an easement to construct and maintain a 'sewer pipe line in and through his lot or parcel of land , situate , lying and being in the said town north of West Market Street and South of West Cornwall Street between Liberty and Ayre Streets , the location of which said proposed easement is • described with more particularity in said resolution of February 18 , 1939 ; and • WHEREAS , among other things , said resolution provided that "said offer of Forty Dollars ( $40.00) to the said Edwin E. Garrett is final , and in the event same is not accepted or rejected on or before the 25th day of February , 1939 , the said council will consider negotiations between the Town and the said EdSvin E. Garrett as having been completed ; " and WHEREAS , the said Edwin E. Garrett has written Stilson H. Hall , Town Attorney, a letter dated Bebruary 21st , 1939 , but failed to either accept of reject said offer of Forty Dollars ($40 .00) for the said easement ; and • WHEREAS , the Council is informed that the said Edwin E. Garrett is in Fla. ; and has not been advised just when he will return to Leesburg ; and WHEREAS , because the -Town has entered into an agreement with W. C. Spratt whereby he agreed to construct a sewerage system for the said town and- -has already started construction work and it is apparent that it is necessary for the Town to proceed as expeditiously as possible to acquire the said easement through the said lot of the said Edwin E. Garrett : NOW , THEREFORE, BE IT RESOLVED , by the Council of the Town of Leesburg , in Virginia , that Stilson H. Hall , Town Attorney , be and he is hereby authorizedm instructed and directed to institute and-prosecute the•mecessary and proper condemnation proceedings in the Circuit--Court of Loudoun County , Virginia , for the purpose of enabling the Town of Leesburg , in Virginia; to acquire the aforesaid easement or the right to construct and maintain a sewer pipe line in- and through the aforesaid lot or 51: 3 parcel ofland owned by .the said Edwin E- Garrett in the said Town between West Market Street and West Cornwall Street in accordance with the•provisions of Chapter 176 of the 1936 Code of Virginia and all other provisions of law applicable to the institution • . andprosecttion of condemnation proceedings for the purpose of enabling the Town to acquire the aforesaid easement and to do all acts that are necessary and incidental to the prosecution of such proceedings and which are not actually expressed or implied by the terms of this resolution. BE IT ALSO RESOLVED, by the Council of the 'Town of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-Treasurer , be and he is hereby authorized to draw the necessary check or checks against the Construction Fund in the Peoples National Bank of Leesburg , Leesburg, Virginia , to pay the costs of instituting and prosecuting the said condemnation proceeding• s BE IT FURTHER• RESOLVED , by the Council of the Town of Leesburg , in Virginia , that Louis T . Titus , Recorder , be and he • 207 • is. hereby authorized, instructed and directed to present to the—said Stilson H. Taylor , Councilmen . • The minutes of meetings held on February 27 , 1939 and March 6, 1939 were read and upon motion duly made seconded and carried , were aglproved as read . • Councilman Turley reported at 8 :10 P. M. Upon motion of Gouncilman Turley seconded by Councilman Flippo and unanimously carried the following Resolution was adopted ; • WH1IEAS , the Commissioners in the condemnation prodeedings of the Town of Leesburg , in Virginia , against John T . Grimes , individually , and John T. Crimes , Eva Crouch and Rhoda Ridgeway have aial m,=.' the damages to the lot owned by the said John T. Grimes west of Church Street and east of a lot or parcel of land owned by Matthew E. Ball at $50.00 and the damage to another lot owned by the said John T . Grimes , adjoining Loudoun Street on the • south and_ a lot owned by him and the said Eva Crouch and Rhoda Ridgeway on the north at $350.00 and the damage to the said lot owned jointly by the said John T. Grimes , Eva Crouch , Rhoda Ridgeway and the heirs and/or devisee of C. A. Grimes , adjoining Fayette Street on the north at $109.00 for easements to construct a sewer pipe line in and through said lots.; and WHEREAS , the report of the said Commissioners was filed in the Clerk' s Office of Loudoun Couirty , Virginia on the day of . February , 1939 ; and WHEREAS , the members of the Council of the Town of Leesburg ; in Virginia , believe that the said peport should be approved and the respective owners of the above mentioned properties should he .paid the amount of damage assessed as aforesaid by the said Commis- sioners , provided the said property owners agreed o accept same ' in full payment of said damages or fail. to A*,cept7said report within the time prescribed by law; • NOW, THEREFORE , BE IT RESOLVED, by the Council .of the Town of Leesburg, in Virginda , that Roscoe B. Rhoads , Auditor-Treasurer , be and he is hereby authorized to draw one check for 5350.00 and • another check for $50.00 and also another check for $25.00 payable to John T. Grimes , and a check for .{25 .00 payable to Eva Crouch , and a check for $25.00 payable to Rhoda Ridgeway and another check for $25.00 payable to George F.
