Chamber on Monday , March 15, 1939 at 7 :30 F. M. , there were present , Lucas D. Phillips , Mayor ; Louis T . . Titus , Recorder , and Roy M. Flippo , L. C . Rollins , and J . D. Taylor , Councilmen . • The minutes of meetings held on February 27 , 1939 and March 6, 1939 were read and upon motion duly made seconded and carried , were agbproved as read . Councilman Turley reported at 8 :10 P. M. Upon motion of 9ouncilman Turley seconded by Councilman Flippo and unanimously carried the following Resolution was adopted ; WHEREAS , the Commissioners in the 'condemnation prodeedines of the Town of Leesburg , in Virginia , against John T . Grimes , individually , and. John T. Grimes , Eva Crouch and Rhoda Ridgeway have aix:...4tithe damages to the lot owned by the said John T. Grimes west of Church Street and east of a lot or parcel of land owned by Matthew E. Ball at $50.00 •and the damage to another lot owned by the said John T . Grimes , adjoining Loudoun Street on the • south and. a lot owned by him and the said Eva Crouch and Rhoda Ridgeway on the north at $350.00 and the damage to the said lot owned jointly by the said John T . Grimes , Eva Crouch , Rhoda Ridgeway and the heirs and/or devisee of C. A. Grimes , adjoining • Fayette Street on the north at $100.00 for easements to construct a sewer pipe line in and through said lots.; and WHEREAS , the report of the said Commissioners was filed in • . the Clerk' s Office of Loudoun County , Virginia on the day of . February , 1939 ; and WHEREAS , the members of the Council of the Town of Leesburg , in Virginia , believe that the said peport should be approved and the respective. owners of the above mentioned properties should he •paid the amount of damage assessed as aforesaid by the said Commis- sioners , provided the said property owners agreed.�oto accept same • " in full payment of said damages or fail to A'icept/said report • within the 'time prescribed by law; • NOW, THEREFORE , BE IT RESOLVED, by the Council ,of the Town of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-Treasurer , • be and he is hereby authorized to draw one check for $350.00 and • another check for $50.00 and also another check for $25.00 payable to John T. Grimes , and a check for $25 .00 payable to Eva Crouch , and a check for $25.00 payable to Rhoda Ridgeway and another check for $25.00 payable to George F. Weaver , Administrator of the Estate of said C. A. Grimes , against the Construction Fund in the Peoples National Bank_. of Leesburg , Leesburg , Virginia , in Full 208 payment of the aforesaid easements for the damage done thereby to the aforesaid properties and deposit said checks with E. 0. Russell , Clerk of the Circuit Court. of Loudoun County , Virginia , who is`:authorized to deliver same to the respective. payees • thereof when the owners of the said properties and payees of said checks file the necessary answers in the aforesaid condemnation proceedings agreeing to the aforesaid appaisement and also . agreeing to accept the aforesaid sums allowed them by the 'aforesaid Commissioners or when the statutory period for filing exceptions to the report of the said Commissioners expires . BE IT FURTHER RESOLVED, by the said Council of the Town of--Leesburg , in Virginia , that Louis T. Titus , Recorder , be and he is hereby authorized and instructed to transmit a certified copy of this resolution to the Peoples National Bank of Leesburg ; Leesburg ; Virginia , and a copy to the said E. 0. RhoadsT Auditor-Treasurer , has this day presented to the Council a budget showing annual receipts and disbursements for the year 1939 and estimated receipts and disbursements for the year beginning July 1 , 1939 , and ending June 30 , 1940 : NOW THEREFORE , BE IT RESOLVED , byithe Council of .the Town of Leesburg , in -virginia , that Eoscoe B. Rhoads , Auditor- Treas- urer , be and he is hereby instructed , authorized and directed to have the aforesaid budget published by one insertion in a • newspaper published in said town. • BE IT FURTHER RESOLVED , by the said Council ,othat there will be a Special Meeting of the said Council In the Council Chamber of the Town hall Building , in the Town of Leesburg , Virginia , .at 7 :30 P. M. on the 4th day of April , 1939 , for the purpose of giving any citizen of the Town the right to appear before the Council and state his views on the aforesaid proposed budget. • • Mr. R. L. Hough appeared before the Council to ask for • permission to use a portion of the town pumping station lot for a garden . • 209 • Upon motion of Councilman Rollins , seconded by Councilman Flippo and unanimously carried , Mr. R. L. Adrain had resigned his officeas councilman that he wished to nominate Mr. -Joseph L. Oliver to fill the unexpired term of Councilman Adrain. Upon motion of Councilman Rollins , seconded by Councilman Flippo and unanimously carried the following Resolution was adopted ; WHEREAS, James E. Adrain , Councilman has resigned his office as such and his said resignation has been -accepted by the Council : NOW, THEREFORE , BE IT RESOLVED , By the Council of the Town of Leesburg , in Virginia , that Joseph L. Oliver be and he is hereby selected , - appointed and elected Councilman of the Town of Leesburg , in Virginia , -to fill the unexpired term 'of said - James E. Adrain. Mr. Oliver was summoned to the Council Chamber and took the oath of office before Mayor Phillips , a Commissioner in Chancery for the Circuit Court of Loudoun County , Virgeinia .
