BE IT RESOLVED, by the Council of the town of Leesburg , in
•
Virginia , •that -the verbal understanding this day had with
Edwin E. Garrett at an informal meeting at the office of the Mayor ,
be and the same is hereby ratified , approved and confirmed . The
-•town agrees to pay to Edwin E. Garrett for the .easement defined
, in the recent condemnation proceedings brought in the Circuit
Court of Loudoun County, Virginia , at the same rate per lineal
foot of said pipe line - that is the equivalent of the. paymen,t of
• Four Hundred 'Fifty Dollars ( $450.00) heretofore padd-fer e"
lineal footage• across the property now occupied by John T . Grimes ,
front Loudoun Street to Fayette Street in Leesburg , .which according
. to an 'agreed computation is Seven Hundred Thirty-Nine Dollars and
. Ten Cents ($739.10) .
The town shall have the right of entry and re-entry forever
as set forth in the condemnation proceeding , except that the same
shall be confined to an area within sive feet next adjacent to
said pipe line and on either side thereof. _
In all other respects , the terms of the proffered agreement
served on Edwin E. Garrett in said-proceedings shall apply.
• Upon - tender of a deed Two Hundred Dollars ($200.00) shall be
paid and the balance shall be paid on or before sixty days after
delivery of said deed. The Auditor-Treasurer is hereby author-
. ized to draw- a check for Two Hundred Dollars $200.00) against the
"Construction Fund" payable to Edwin E. Garrett for. part pay-
ment for the aforesaid easement and also a check against said fund
to have said deed recorded . .
BE IT FURTHER RESOLVED, by. the said Council of the town of
- Leesburg, in Virginia , that Louis T . Titus , Recorder , be ,and he
is hereby authorized and directed to transmit a certified copy,
1 . of this Resolution to The Peoples National `Bank of Leesburg ,
Leesburg , Virginia.
There being no further business , on motion duly made , •
seconded and carried , the Council adjourned.

• At a regular meeting of the Mayor and Town Council of the
Town of Leesburg , in Virginia held in the Council Chamber on Monday ,
May 8 , 1939 at 6 :00 P. M. , there were present , Lucas D. Phillips ,
Mayor ; Louis T. Titus , Eecodder and Eoy. M. Flippo , J . T . Hourihane ,
L. L. Oliver , L. C.' Rollins , J . D. Taylor ans J . H. Turley , Council-
. men .
The minutes of •the regular meeting held mn Aprtl 24th and
illa special meeting held on April 28 , 1939 were read and upon motion -
duly made seconded and carried , were approved as read .
The Recorder read an agreement and deed in connection with •
the easement through the property of Edwin E. Garrett .
Upon motion of Councilman Hourihane seconded by- Councilman
Turley and unanimously carried the following Resolution was adopted ;
WHEREAS , by a resolution passed by the Council of the Town
of Leesburg , in Virginia , on the 28th day of April , 1939 , the
Town agreed tc pay Edwin E. Garrett and Agnes D. Garrett Seven
Hundred Thirty-Nine Dollars and Ten Cents ($739 .10) for the

right to lay out , construct and maintain a sanitary sewer pipe

line eight inches in diameter through and across their land located
in said town between West Market Street and hest Cornwall Street ;
and
WHEREAS , an agreement between the said town and the said
Edwin E. Garrett and Agnes D. Garret , his wife , dated May 5 ;
1939 , and signed by the said Edwin E. Garrett and Agnes D. Garrett ,
his wife , describing said easement and the right of the town in
details , has this day been.presented and read to the Council :
NOW , THEREFORE, BE IT RESOLVED, by the Council of the Town
of Leesburg , in Virginia , that the said agreement , dated May 5 ,
1939 , be and the same is hereby approved and Lucas D. Phillips ,
Mayor , is hereby authorized and directed to sign the said agree-
ment for and in behalf of said town.
BE IT FURTHER RESOLVED , by the said Council of the Town of
Leesburg , in Virginia , that Roscoe B. Ehoads , Auditor-Treasurer
be and he is hereby authorized and directed to draw a check for
Two Hundred Dollars ($200.00) against the "Construction Fund" in
the Peoples National Bank Of Leesburg , Leesburg , Virginia , pay-
able to the aforesaid E®win E. Barrett for part payment on the
purchase price of the aforesaid easement ; and the said Roscoe .
B. Rhoads , Auditor-Treasurer is further authorized and directed
to have the aforesaid agreement recorded in the Clerk' s Office
of LoudounLCounty , Virginia and to draw a check payable to E.O.
Russell , Clerk, against the said "Construction Fund" in the
aforesaid bank for the amount of the costs for recording the
said agreement:
BE IT FURTHER RESOLVED, by the said Council of the Town of
Leesburg , in Virginia , that Louis T. Titus , Recorder , be and he
is hereby authorized and instructed to transmit a certified copy
of this Resolution to the Peoples National Bank of Leesburg ,
Leesburg , Virginia. '
On motion of Councilman Flippo , seconded by Councilman
Oliver and unanimously carried the following Resolution was adopted ;
WHEREAS , the Leesburg Grain & Feed Company , Inc . , has pre-
pared a deed conveying to the Town of Leesburg , a certain strip
or parcel of land Sixteen feet wide between Loudoun and Alco
Streets in consideration of the town ' s agreement to accept and
maintain the same as a public street ; and
WHEREAS , the members of the Council of the Town of Leesburg ,
in Virginia , think it advisable for the town to accept the said
land from the Leesburg Grain & Feed Company , Inc. , and to im-
prove and maintain same as a public street :
NOW, THEREFORE, BE IT RESOLVED , by the Council of the Town
• of Leesburg in Virginia , that the town hereby accepts the
aforesaid sprip or parcel of land and hereby egrees to maintain
. same as a public street.
. BE IT FURTHER RESOLVED; by the . said Council of the Town .
of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-Treasurer ,
be and he is hereby authorized to draw a check for Five Dollard
($5.00) against the "Construction Fund" in the Peoples National
Bank of Leesburg , Leesburg , Virginia , payable to the said
Leesburg Grain & Feed Company , Inc. , upon the signing and
delivery of said deed to the town ; and the said Roscoe , B.
Ehoads , Auditor-Treasurer is further authorized and directed
to have said deed recorded in the Clerk' s Office of Loudoun
County , Virginia , and to draw a check payable to E. 0. Russell ,
Clerk , against the aforesaid "Construction Fund" for the amount
of the costs of recording said deed.

BE IT FURTHER RESOLVED, by the said Council of the Town of
Leesburg, in Virginia , that Louis. T. Titus , Recorder , be and
he is hereby authorized and instructed to transmit a certified
copy of this Resolution to the Peoples National Bank of Leesburg ,
Leesburg , Virginia, -

On motion of Councilman Turley , seconded by Councilman
Taylor and unanimously carried the following Resolution was adopted ;
WHEREAS , E. 0. Russell , Clerk of the Circuit Court of
Loudoun County , Virginia , has presented to the town a bill
for ;84.65 for the total costs in the condemnation proceedings
.of the Town of Leesburg , in Virginia against John T. Grimes ,
et, als . , which condemnation suits are numbered 153 , 154 , 155
' and 156 , which said bill includes court . costs , Sheriff' s fees
and compensation due the Commissioners or viewers :
NOW, THEREFORE , BE IT RESOLVED, by the Council of the
Town of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-
Treasurer, be and he is hereby authorized and directed to draw
- a check for $84:65 payable to E. 0. Russell , Clerk, against
the "Construction Fund" in the Peoples National Bank of
Leesburg , Leesburg, Virginia , in payment of the aforesaid
bill for costs in the aforesaid condemnation proceedings.
BE IT FURTHER RESOLVED , by the said Council of the: Town
of Leesburg . in Virginia , that Louis T. Titus , Recorder , be
and he is hereby authorized and directed to transmit a certi-
fied copy of this Resolution to the People-9 National Bank of
Leesburg , Leesburg , Virginia.
Mr. L. T. Fry appeared and stated that he had been invited
to come before the Council. and ask that the Council consider moving •
the public toilet from its present location to a room in the rear
of the Leesburg Fire Company Recreation Room, so as to make room
for an extention of the Fire House in the rear of the present
building . -
• . On motion of Councilman Rollins , seconded by Councilman
Oliver and unanimously carried the Council agreed to act as 'a •
committee to investigate the matter brought before the Council by
Mr. L. T. Fry.
, The Auditor-Treasurer read his monthly report for the
month of April.
On motion fo Councilman Turley , seconded by Councilman
Hourihane and unanimously carried the Following Resolution was adopted ;

On motion of Councilman Tuffley seconded by Councilman
Flippo and unanimously carried the Auditor—Treasurer was instructed
to investigate the possibility of obtaining a sprinkler for the
purpose of sprinkling the streets of• the town. - •

On motion of Louncilman Rollins , seconded by Councilman
Flippo and unamimously carried the following Resolution was adopted ;
BE I'T RESOLVED , by the Council of the Tovm of Leesburg , in
Virginia , that the Auditor-Treasurer be and he is hereby
authorized and instructed to purchase ,and have .installed ,an
awning for the town office , the cost of which shall not exceed
$14 .00.
There being no further business, on motion duly made ,
seconded and carried , the Council adjourned at 9 P:` M.

town of Leesburg , in Virginia , held in the Council Chamber on Monday ,
May 22 , 1939 at 8 :00 P. M. there were present ; Lucas D. Phillips , Mayor ,
Louis T . Titus , Recorder , and Roy M. Flippo , John T. Hourihane , J. L.
Oliver , L. C. Rollins , J. D. Taylor and Joseph H. Turley , Councilmen.
The minutes of the last regular meeting were read and upon
motion duly made seconded and carried , were approved as read .
On motion of Councilman Flippo seconded by Councilman
Oliver and unanimously carried the following .Ordi-Ziance was passed ;
BE IT ORDAINED, by the Council of the Town of Leesburg,
in Virginia , that from the date of this ordinance , the Recorder
be and he .ishereby authorized , instructed . and directed to record
each ordinance and resolution having the effect of law or con-
taining a provision or provisions for a permanent regulation or
proceedings of the council by spreading same upon the General
} Ordinance Book as soon as passed or adopted ; and the said Recorder
is further authorized, instructed and directed to record all
b other resolutions and minutes of proceedings of the Council in
k �' the Current Minute Book.
BE IT FURTHER ORDAINED, by.. the Council of the Town of
Leesburg , in Virginia , that the Recorder be and he is hereby
authorized , instructed and directed to. record this Ordinance in
the General Ordinance Book and also in the Current Minute Book. •
BE IT FURTHER ORDAINED., by the Council of the Town of
Leesburggi in Virginia , that the Recorder be and he is hereby
authorized , requested and required to read the minutes recorded
in the Minute Book at the next regular meeting of .the Council
following each regular meeting and intervening special meetings:
