On Motion of Councilman Hourihane and seconded by • Councilman Oliver and unanimously carried , the following Resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg , in -Virginia that the Auditor-Treasurer be and he is hereby authorized and instructed to call for bids 4qr hauling of slops , for the coming year. MA_OR June 26 , 1939 At a regular meeting of the Mayor and Town Council of the town of Leesburg , in Virginia held in the Council -Chamber on Monday June 26 , 1939 at 8 :00 P. M. , . there were present; Lucas D. Phillips , Mayor ; Louis T. Titus , Recorder ; and R. . M. Flippo , J. T. Hourihane ; J. L. Oliver , L. C.-Rollins , J. D. Taylor and Joseph H. Turley , Councilmen .. The minutes of meetings held on June 12th and 14th 1939 , were read and upon motion duly made seconded and carried were approved as read . Upon motion of Councilman Flippo , seconded by Councilman Taylor and unanimously carried , the following Resolution was adopted ; WHEREAS, the Town of Leesburg , in Virginia , entered into an agreement with W. C. Spratt , Contractor , whereby the said W.. C. Spaatt agreed to construct a sewer system and disposal plant for the town of Leesburg , in Virginia , within 180 Calender days from December 15 , 1938 , and said contract- contains a provision whereby the said W. C. Spratt agreed to pay Twenty- five Dollars ($25.00) per day for the time required to construct said sewer system and disposal plant in excess of 180 callender days from December 15 , 1938 ; and WHEREAS , it appears to the Council that the said W. C. Spratt.has endeavored to complete the said sewer system and disposal plant projects as -expeditiously as was reasonably pos- sible and that he had been delayed primarily because of excess rock in ditches due to changes in grade and also by inclement weather; and %HEREAS , it is the further opinion o the8 Council that thh said W. C. Spratt should have a 60 -day extension of time in winch 223 - to complete the construction of said projects : • • NOW; THEREFORE, BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the said W. C. Speatt be and he is hereby granted an extension of 60 days from June 12 , 1939 , in which to complete the construction of a sewer system and disposal plant for the Town of Leesburg , in Virginia , pursuant to - the terms of the aforesaid contract dated December 5, 1938 , between the said town and the said W. C. Spratt ; without being required to pay a penalty of $25 .00 per day ; but the said contract dated December 5, 1938 , shall in all other respects remain in full force and effect and the said penalty shall be enforced after the expiration of said 60-day period , it being understood that the only change or alteration in the terms thereof is that the said W. C. Spratt shall have an additional period of 60 days in which to- complete said projects in accordance with the -terms of the said contract without being required to pay the said town $25 ,00 per _day during said 60-day period as a penalty for fadlure to complete same by June 12 , 1939 : • • Upon motion of Councilman Flippo , seconded by Councilman Oliver and unanimously carried , an Ordinance was passed relating to Fire Works which may be found in the current Ordinance Book. On motion of Councilman Flippo , seconded by Councilman Turley and unanimously carried the following Resolution was adopted ; WHEREAS , an agreement between Payne Diggs and Anna Diggs , his wife , Bruce McIntosh and the Tom of Leesburg , dated June 16-, 1939 , has this day been presented and read to the Council; and WHEREAS, in the said agreement , the. said Payne Diggs and Anna Diggs grant unto the Town the right to maintain a, seWer' pipe line -in and through a certain lot or • oarcel of land located onthe south side of West Market Street for the sum of Four Hundred Six Dollars and Sixty-four Cents($406:64) : NOW, THEREFORE , BE IT RESOLVED by the Council of the Town of'Leesburg, in Virginia , that the said agreement , dated June 16 , 1939 , be and the same is hereby approved and Lucas D.' Phillips , Mayor , be and he is hereby authorized , instructed and directed to sign the said agreement for and on behalf of the Tann ofLeesburg, in•Virginia ; and Roscoe B. Rhoads , Auditor-Treasurer, is hereby authorized and directed to draw a check for Four Hundred Six Dollars and Sixty-four Cents ($406.64) payable_to Payne Diggs against the General Fund after the said agreement has been signed by all the parties thereto and the said Roscoe B. Rhoads , AuditorTreasurer , is further authorized and directed to draw a check against the General Fund , payable to E. 0, Russell , Clerk of the Circuit Court of -Loudoun County , Virginia , for the amount of the costs of hav- ing said agreement recorded. Bids • received and read for the removal of slop are as follows: • Thomas S. Alexander - - - - $40 .00 per month. Cli£ton, Coates_ - - - - _ 30 .00 per month. D. H. Cooley - - - _ 37 . 50 per month . After some discussion of the awarding of the contract for the removal of slop , upon motion of Councilman Rollins , seconded by CouncilmanFlippo and unanimously carried , the matter of awarding the aforesaid contract was postponed: , • Upon motion of CouncilmanTurlay , seconded by Councilman Hourihane and unanimously carried the following Resolution was adopted ; t'HETEAS there is a point approximately. 300 feet south of Market Street on Liberty Street from which water will not flow except through private .property; and WHEREAS , in order to eliminate the necessity of the Town 224 from having to run water from the said street onto private ' property , it is necessary to construct a pipe line from the said point on Liberty Street 'to an add man-hole at the intersection of Liberty and Market Streets ; and • WHEREAS , W. C. Spratt , Contractor , has offered and agreed to construct a pipe -line 8 in. in diameter from the aforesaid point in Liberty Street approximately 300 ft. south of Market Street to an old man-hole at the intersection of Liberty and Market Streets at a depth from two to eight feet at a price ' not to exceed Four Hundred Twenty-Five Dollars ( $425:00) : NOW, THEREFORE, BE IT •RESOLVED, by the Council of the Town of Leesburgm in Virginia , that the said W. C. Spratt , Contractor , be and he is hereby authorized to construct the aforesaid pipe line 8 in. in diameter in Liberty Street at *a depth from two to eight feet , beginning at a point approximately 300 feet south of Market Street to an old man- hole at the intersection of Liberty and Market Streets and • after the same has been constructed the Town will pay the said W. C. Spratt a sum not to exceed Four Hundred Twenty-five • Dollars ( $425:00 ) for said construction work. • Upon motion of Councilman Hourihane seconded by Council- man Flippo and unanimously carr ied .andOrdinance was passed regarding SEWERS which may be found in the current ORDINANCE BOOK. • Upon motion of Councilman Flippo seconded ,by Councilman Oliver and unanimously canoed, an Ordinance was passed •entitled SANITATION which may be found in the current ORDINANCE BOOK. On motion of Councilman Flippo , seconded by Councilman Turley and unanimously carried , an Ordinance was passed regarding a Town Health Officer , which may be found in the Current ORDINANCE BOOK. ' • Bids were opened and read for the purchase of a truck for the hauling and removal of trash and upon motion of Councilman Turley , seconded by Councilman Flippo and unanimously carried ,. the Mayor was instructed to appoint a committee to study •the bids and purchase a truck on the basis of the _bids- read . The following weteappointed on the committee; J. D. Taylor; R. M. Flippo and F. B. Rhoads . On motion of Councilmanfiourihane , seconded by Council- man Flippo and unanimously carried the Auditor-Treasurer was authorized to sell three ( 3) sections of used fire hose to the Town of Middleburg , Virginia for $12 .00 : Upon motion of Councilman Turley , seconded by Councilman Oliver and unanimously carried the following Resolution was adopted ; BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia that the Auditor-Treasurer be and he is hereby authorized and instructed to pay the following bills ; • Garlock Packing Company ., $ 7 .19 C. &• P. L. Hough was selected for duty at the disposal plant upon its completion. • There being no further business , on motion duly made , seconded nod carried, the Council adjourned at 9 :52 P.M.
