• BE IT FURTHER RESOLVED , by the said Council that the
• • Auditor-Treasurer be and he is hereby authorized and directed
to have a copy of the said quarterly report published once in
• a newspaper , published in said town and also post a copy of the
said quarterly report in front of the courthouse in the said town.
On motion of Councilman Hourihane seconded by Councilman
Oliver and unanimously carried the following Resolution was adopted :
. BE IT RESOLVED , by the Council of the Town of Leesburg ,
in Virginia that the Auditor-Treasurer be and he is hereby
authorized and instructed to pay the following bills ;

July 12 , 1939 SPECIAL
At a special meeting of the Mayor and Town Council of the •
town of- Leesburg., in Virginia held in the Council Chamber on
Wednesday , July 12 , 1939 at 7 :30 P. M. there were present , Lucas D.
Phillips , Mayor; Louis T. Titus , Recorder ; and R. M. Flippo , J . L.
Oliver , L. C. Rollins , J . D. Taylcr and J. H. Turley , Councilmen.
The Mayor stated that the purpose of the meeting was -to
consider a proposed Resolution regarding some easements in connection
with the new sewerage system and also to take action-upon the report
of the election officials of the election held on June 13 , this year,
and to consider such other matters that might be properly brought
before the meeting. -
On motion of Councilman Flippo , seconded by Councilman
Turley and unamimously carried the following Resolution was adopted ;
WHEREAS , a Regular Election of Officials for the Town was
held on the 13th day of June , 1939 ; and

WHEREAS , the following named persons , were candidates for
the respective Town Offices : -

WHEREAS , according to the certificate of the Judges ; W. W.
Titus , R. H. Ashton and J. E. Ddrain ,
Lucca D. Phillips received 128 votes for Mayor ;
Louis T. Titus received 132 votes for Recorder ;
Roy M. Flippo received 130..votes for Councilman ;
John T . Hourihane received 137 votes for Councilman ;
John.D. Taylor received 122 votes for Councilman ;
L. C. Rollins received 122 Votes for Councilman;
Joseph H. `Hurley received 111 votes for Councilman
. Joseph L. Oliver redeived 98h'votes for Councilman ;

NOW; THEREFORE , BE IT -RESOLVED by the Council of the Town
of Leesburg , in Virginia , that the Council hereby .decides that
the aforesaid election held on the 13th day of June 1939 , was
held in accordance with the provisions of law and that the
followimg persons were duly elected and are qualified to hold
office :

On motion of Councilman Turley , seconded by Councilman
Oliver and unanimously carried , the following Resolution was adopted ;
WHEREAS , the Town of Leesburg , in Virginia , has constructed
' a sanitary sewer pipe in and through the land of Matthew E. Ball
beginning on the west line of King Street at a point 10 feet
North of the property line between Atwell and the land of said
Matthew E. Ball ; thence .in an easterly direction 217 . 5 feet to
a point ' in the division line of the lands of the said Matthew
.E: Ball and John T. grimes , which said point is 13 feet North
of the Southeast corner of the lands of the said Matthew E. Ball
and also a manhole in said sewer pipe approximately six - feet
West of saidndivision line between said Matthew E. Ball and
• .John T. Grimes , which said .sewer pipe extends through the lands
acquired by the said Matthew E. Ball by deed from Eliza A.
Etcher , dated March 23, 1911 , which deed is of -record on the
Clerk' s Office of the Circuit Court of Loudoun County , Virginia ,
• in seed Bbnk 8 'N' s , page 151.

The said sanitary sewer pipe shall be maintained at a
'depth of not less than 5 feet inder the existing surface on
a straight line between the points mentioned in the preceeding
paragraph, and on regular grade ; and. ,
• WHEREAS , the Town of Leesburg, in Virginia , has constructed
a sanitary sewer pipe in ans through the land owned by Hattie
F. Titus , Henry J. Fadoley , Marie F. Plaster , Margurite F.
Whitmore and Edna F. Connor , the heirs of Henry J . Fadeley ,
from a point in the division line between the Washington Coca-
Cola Bottling Works , Incorporated ; and the land owned by -said
heir8 395 feet from the center line of Royal Street , thence
N 71 W. 300feet and parallel with Royal Street to a point
in the line between the land of the said heirs and the Town of
Leesburg , in Virginia ; and

Also from a: point in the south property line of Royal
Street , said point being in the centerrline of Wirt Street •
projected; thence .South 380 feet and along center line of Wirt
Street projected , to A, a manhole in the Town Branch out-fall
line , that is the sewer line referred to in the foregoing
paragraph, and also the manhole at said point A , the inter-
section of the said two pipe lines in and through the land
owned by said Fadeley heirs.
The said sanitary sewer pipe shall be maintained at a
depth; of not less than 3 feet inder the existing groung
surface on a straight line between the points mentioned in the

two preceeding- paragraphs , and on regular grade ; and
: WHEREAS , the Town of Leesburg, in Virginia ; =has constructed •
a sanitary sewer pipe in and through the "_land owned by H. C.
Littlejohn beginning at A , a point in the'Tproperty line of
the Town of Leesburg , in Virginia , and , the property of H. C.
• Littlejohn; which point is°395 feet from the center line of
Royal Street , thence N. 71 W 61 feet to B, a manhole ; thence
N 36° W 300 feet to C , a manhole ; thence N. 11° 55 ' W •269 .-
feet to D, a manhole ; thence N. 50 . 5' W. 226.3 feet to E. a
point in the South line of Loudoun Street ; and also manholes
at said points B, C and D.

The said sanitary sewer pipe shall be maintained at'a
depth of not less than 4 feet from A to B, 3. 76 feet from B;
to C , 4. 5 feet from:C to D-and 2.65 feet from D to E trader the
existing groung surface on a straight line between the points
mentioned in the preceding paragraph , and on regular grade ; and
WHEREAS , the respective ovnlers •of the, said properties in
and through which the said sanitary sewer pipe and manholes
have already been constructed permitted the Town to construct
• same with the understanding that the permission to do so should
not be taken to theor prejudice; and
WHEREAS, the said Town has been unable to purchase from'
the owners of the said respective properties easements to
maintain or repair said sanitary sewer pipe and manholes over ,
in and through said properties :
NOW , THEREFORE , BE IT RESOLVED, by the Council df the
Town of Leesburg . in Virginia ; that Matthew -E. Ball , be and
he is hereby offered the sum of One Hundred Dollars (000.00)
for a perpetual easement to maintain or repair the said sanitary
sewer pipe and one manhole in and through his land hereinbefore
• described; that the aforesaid heirs of Henry J. Fadeley be and
they are hereby offered the sum of one Hundred Dollars ($100.00)
for a perpetual easement to maintain or repair the said sanitary •
sewer pipe and one manhole in and through their land herein-
before described , and that D. C. Littlejohn be and he .is hereby
offered the sum of One Hundred Dollars ($100.00) for a perpet-
ual easement to maintain or repair. the said sanitary sewer pipe
and three manholes in and: through his landhereinbefore
described ; and that the. Town will pay for any of the aforesaid
resaid
easements within thirty days from the date any of the said offers
are accepted and a proper agreement is delivered to the said
Town granting to it a perpetual easement to maintain or repair
said sanitary sewer pipe- and manholes in and through and of
said properti•eS.
BE IT FURTHER RESOLVEDm that Stlisdn 'H. Hall. 'Town •
Attorney, be and he is hereby authorize& and directed to trans-
mot to the respective owners of said properties the offers -
contained in this Resolution by letter , a copy of this Resolution ,
and also. a copy of the prepared agreement between the said
Town and the respective owners of said properties. •
BE IT FURTHER RESOLVED , that Louis T. Titus , Recorder , be
and he is hereby instructed and directed to transmit to Stilson
H. Hail , Town Attorney , ten certified copies of this
Resolution.

On motion of Councilman Oliver , seconded by Councilman
. Turley and unanimously carried , Auditor-Treasurer , Roscoe B. Rhoads
was authorized to take a vacation of two weeks with regular pay. The
• time to be selected by' the Auditor-Treasurer. ,

At a regular meeting of the Mayor and Town Council of the
. town of Leesburg , in Virginia , held 1'n the Council Chamber on Monday ,
July 24 , 1939 at 8 F. M. there were present , Lucas D. Phillips ,
Mayor ; Louis T. Titus , Recorder ; and R. M. Flippo , J. T. Hourihane .
J. L. Oliver , L. C. Rollins , J . D. Taylor and J. H. Turley , Council-
men.
The minutes of a regular meeting held on July 10th and a
Special meeting held on July 12 , 1939 , were read and upon motion
duly made seconded and carried were approvedas read.
Margurite Diggs Chapman appeared in the interest of having
• an adjustment made in her water bill on which the Council took no
action.

Jones '()colored) appeared to ask for a permit or
license to operate a portable snow-ball stand on the streets of
There was no action taken on this matter . Moved and carried
that the matter be taken up at the nest meeting.
The Auditor-Treasurer presented several bias and upon motion
of Councilman Flippo , seconded by Councilman Eourihane and unanimous-
ly carried the following Resolution was adopted;
BE IT RESOLVED, by the Council of the Town of Leesburg, in
Virginia that the Auditor-Treasurer be and he is hereby author-
ized and instructed to pay the following bills ;

On motion of Councilman Rollins , seconded by Councilman
Eourihane and unanimously carried the following Resolution was
adopted; .
WHEREAS , there are eleven ( 11) One Thousand Dollar
($1 ,000.00) Water Bonds out-standing at the present time ; and

WHEREAS , each of said Water Bonds is callable and payable
at any time:
. NOW, 'TEEREFORE, BE IT RESOLVED , by the Council of the
Town of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-
Treasurer , be and he is hereby authorized , to call and pay. one
(1) , One Thousand Dollar ($1 ,000.00 ) Water Bond and to draw a
check for One Thousand ($1 ,000.00) Dollars plus accrued
interest due on the `bond to be paid 'off and discharged , against
the General Fund.
