HomeMy Public PortalAbout10-01-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, OCTOBER 1, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, October 1, 2007, in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR KLOSE President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Al Glover, Gil Klose and Diana Pappin. Absent was Larry Parker. APPROVAL OF MINUTES Councilor Sharp moved to approve the minutes of the meeting of September 17, 2007, with a second by Councilor Glover. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • Sim Hodgin Parkway will be closed October 2 & 3. • October is "Cash for Cans" month. Please recycle all cans — especially this month. Richmond has been the leader in this effort the past two years. • The intersection of US27 and 170 will be closed for approximately 6 months. Alternate routes will be posted. • Harry Phillips of Richmond Power and Light represented the Environmental Council and spoke of "easy" ways to save electric energy: use appliances with the Energy Star logo; turn off computers when not in use; utilize programmable thermostats; use power strips for entertainment devices with remote controls and turn off the strip when not in use, etc. • October 7 -13 is Fire Prevention Week. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the September 13 & 20 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS - None Common Council Minutes October 1, 2007 Page 2 of 4 MISCELLANEOUS BUSINESS • Councilor Wissel moved to amend the Agenda to move Ordinance Nos. 58 & 60 -2007 to the October 15 meeting, with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. • Councilor Sharp asked that the Richmond Police Department limit the time frame in which "comp" time can be used. He stated that Federal Law allows a change in policy if a City is experiencing financial problems. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 65, 66, 67, 69, 70, & 72 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 65 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET (Street) The Clerk read Ordinance No. 65 -2007 on first reading by title only. This Ordinance would allow a transfer within the 2007 Street Department Budget. Councilor Welch moved to advance Ordinance No. 65 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Glover. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 65 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 65 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 65 -2007 with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 65 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 65 -2007 on third reading by title only. Ordinance No. 65 -2007 was adopted with an 8 -0 roll call vote ORDINANCE NO. 66 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Productivity Fabricators) The Clerk read Ordinance No. 66 -2007 on first reading by title only. This Ordinance is a request of Productivity Fabricators, Inc. for a 10 -year tax abatement for equipment valued at $123,380. Ordinance No. 66 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 67 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET (RPD) The Clerk read Ordinance No. 67 -2007 on first reading by title only. ORDINANCE NO. 69 -2007- A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (CDMAssociates) The Clerk read Ordinance No. 69 -2007 on first reading by title only. This Ordinance is a request of CDM Associates, LLC. for a 10 -year tax abatement for real estate valued at $3,000,000. Ordinance No. 69 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 70 -2007 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY BROWNFIELDS CLEANUP GRANT PROGRAM (Gas Building) The Clerk read Ordinance No. 70 -2007 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application and to accept said grant funding in an amount up to Two Hundred Thousand Dollars to assist with the costs associated with environmental remediation at the old Indiana Gas Building located at 16 East Main Street. The City of Richmond would be required to match up to a maximum of Twelve Thousand Dollars. Councilor Wissel moved to advance Ordinance No. 70 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 70 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 70 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 70 -2007 with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 70 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Welch. The Clerk read Ordinance No. 70 -2007 on third reading by title only Ordinance No. 70 -2007 was adopted with an 8 -0 roll call vote Common Council Minutes October 1, 2007 Page 4 of 4 ORDINANCE NO. 71 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (AQuMed Mfg.) The Clerk read Ordinance No. 71 -2007 on first reading by title only. This Ordinance is a request of AQuMed Manufacturing LLC for a 10 -year tax abatement for equipment valued at $35,000. Ordinance No. 71 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 72 -2007 — A GENERAL ORDINANCE AMENDING CHAPTER 54 OF THE MUNICIPAL CODE (Sewer Usage) The Clerk read Ordinance No. 72 -2007 on first reading by title only. This Ordinance is an amendment to Chapter 54 of the Richmond City Code. This amendment addresses the limits of copper discharge into local streams. The proposed amendment is needed to keep the City in compliance with its National Pollutant Discharge Elimination System permit. Ordinance No. 72 -2007 was held on first reading.
