HomeMy Public PortalAbout1939_08_04SPEC 232 • August 4, 1939 SPECIAL At a special meeting of the Mayor and Town Council -of- Town of Leesburgl. in Virginia held -in the Council Chamber on Friday , August 4 , 1939 , at 7 :30 P. M. there were present , Lucas D. Phillips , Mayor and R. M. Flippo , J. T. Hourihane , J. L. Oliver , • L. C. Rollins , J . D. Taylor and J . H. Turley , Councilmen . The Mayor stated the purpose of the meeting was to consider and adopt a proposed Resolution in regard to easements through the properties of H. C. Littlejohn , M. E. Ball and the Reors of H. J. Faleley . Upon motion of Councilman Oliver , seconded by Council- man Rollins and unanimously carried the following Iesolttion was adopted ; WHFEAS , by a Resolution adopted by the Council of the Town of Leesburg , in Virginia , on the day of July , 1939, - the Town offered Matthew E. Ball the -sum of One Hundred Dollars ($100.00) for an easement to maintain and -repair a sewer pipe line in and through a lot or parcel of land •between East King Street .andJohn T. Grimes and to maintain a man-hole tear -the ' east side of his said land ; the Town offeres the Heirs of H.J. Fadeley the sum of One Hundred Dollars ( 3100.00 ) for an easement tomaintain and repair a sewer pipe line in and through their . land west of King Street and South of Royal Street and -a man-; hole in said land ; the Town offered H. C . Littlejohn the sum ' of One Hundred Dollars (3100.00) for an easement to maintain and repair a sewerpipe in and through a tract or parcel of land owned by him and located south of Loudoun Street and West of property owned by the Town of Leesburg and Shirley Myers and three ( 3) man-holes in said land ; and the location of the land • and the sewer pipes in and through each of the said properties IIis described with more particularity in the aforesaid Resolution adopted by the •Council of the _ day of July , 1939 ; and - WHEREAS, Stilson H. Hall , Town Attorney , has reported to the Council that he has ' communicated the aforesaid offers to the • respective owners of said properties by mailing a copy of -the aforesaid Resolution and writing a letter to the respective - owners of the aforesaid properties ; Matthew E. Ball has informed him, Stilson H. Hall , that he will not accept the offer of the Town for said easement in and through his propertyl that H. C. Littlejohn has: made no response to said offer and thatbCharles F. Harrison, Attorney fur the Heirs of the H. J; Fadeley , has writtem a letter to Lucas DY Phillips , Mayor , stateing that the said Heirs will accept for an easement in and threugh their • aforesaid lot one half (2) per lineal foot of the amount paid by the Town of Leesburg to Edwin E. Garret for an easement in and through a lot or parcel 'of land owned by him and located between Market and Cornwall Streets ; and WHEREAS , the Council is of the opinion that the amount requested by the Heirs of H. J . Fadeley is more than the Town should pay for an easement through their aforesaid lot;' NOW, THEREFORE, BE IT RESOLVED, by the Council of the • Tom of Leesburg , in Virginia , that Stilson H. Hall , Town Attorney, ' be and he is hereby authorized , instructed and directed to institute and prosecute the necessary and -proper •condemnation ' proceedings in the Circuit Court of Loudoun County , Virginia , for the purpose of enabling the Town of Leesburg , in Virginia to acquire the aforesaid easements to maintain and repair a sewer pipe in and through the aforesaid lots or parcels of land and man-holes therein in accordance with the provisions of Chapter 176 of the 1936 Code of Virginia , and all other prov- isions of Law applicable •to the institution and prosecution of condemnation preceedings for the purpose of -enabling the Town to acquire the aforesaid easements in and through the said properties and do all acts that are necessary and incidental to the institu- tion and prosecution ofdsuch proceedings which are not actually 233 expressed or implied by the terms of this resolution. BE ,.IT FURTHER RESOLVED, by the Council of the Town of Leesburg , in Virginia , that Roscoe B. Ehoads , Auditor- Treasurer , be and the is hereby authorized and directed to ' - draw a check or checks against the Construction Fund in the Peoples National Bank of Leesburg , Leesburg , Virginia , to pay the costs of instituting and prosecuting the aforesaid . condem- ' nation proceedings . . - - BE IT FURTHER :RESOLVED, by the Council of the Town of Leesburg, in Virginia , that Louis T. Titus , Recorder , be and he is hereby authorized , instructed and directed to present to rhe said Stilson H. Hall , -Town Attorney , as many; certified copies of this Resolution as he may need for the purpose of instituting and prosecuting the aforesaid condemnation proceedings and thetPebples National Bank of Leesburg , Leesburg, Virginia , one copy thereof. There being no further business , on motion dilly made , seconded and carried , the Council adjourned: : . PSA OF • ✓ ; AUGUST 14 , 1939 • At a .regular meeting of the Mayor and Town Council of the Town of -Leesburg , in Virginia held in the Councdl Chamber on Monday Audust 14 , 1939 at 8 : P. F.S. there were present ; Lucas D. Phillips , ' Mayor; Louis T. Titus , Recorder and R. M. Flippo , J. T. Hourihane , J. L. Oliver , L. ,C. Rolfine , J. Di Taylor and J. H. Turley ,Councilmen. ▪ The minutes of a regular meeting held on July 24th and • a special meeting held on August 4th 1939 were read and upon motion duly made seconded and carried , were approved as read . - -- -Dr. Matthew Pulliam appeared, representing the Leesburg • Fire Company, and read a motion passed by the said Fire Company, in regard to the Town withholding the annual compensation to any Firemen who may resign or who 'may be asked to 'resign from the said , Fire Company , until such a member shall return keys and uniform to the proper Fire Company Officials. No -action was taked was taken on this metter . Mr. E. C. Meredith of the State Health Department was present and made a few remarks in regard to the Sewerage System and Disposal Plant which he was inspecting at this time and which he found to be • very satisfactory. - Others who made remarks in regard to the Sewerage System end Disposal plant are ; Mr. Rutledge , of the Rust Engineering Company and Mf. Elton of the same Company and Mr. Tom Spratt of W. C. Spratt Construction Engineers who installed the system and plant. The Auditor-Treasurer-read his monthly Report fot the Month of July. The ,Auditor-'Treasurer presented the current bills and . upon motion of' Councilman Turley , seconded by Councilmen Rollins and • unanimously carried , the following P.esolution was adopted ; BE I2 RESOLVED, by the council of the Town of Leesburg , on Virginia , that the Auditor-Treasurer be and he is hereby authorized , and directed to pay the following bills; Virginia Public Service Company Mayor ' s office I- Fire House $ 7.49 General Pumping 98/951 Harrison Pumping 12 :96 Street Lighting 118.36 . White Way Lighting - - - - 89 .50 ( over ) Sewer Plant - - - - - - - - 1.67
