M. , there were present ; Lucas D.. Phillips ; Mayor ; Louis T . •Titus , Recorder and J. T. Hourihane , J. L. Oliver ; L. C. Rollins , J . D. .Taylor and J . H. Turley , Councilmen . . The Mayor ,aRecorder and members of the Council having been previously , sworn proceeded. to act in their respective capicities . The minutes of the last meeting were read and upon motion duly made seconded and carried , were approved .as read. Mr. A. B. Richard appeared , heading » committee from the Leesburg Methodist Church, in regard to -an adjustment on the water bill of the said Church . After some discussion of the matter of an adjustment on the above mentioned bill, upon motion of Councilman Rollins , seconded by Councilman Oliver and -unanimously carried , the matter was laid on the table until the next meeting. Mr. Tom Spratt appeared 2ndregard to additional improve- ments to the storm sewers at the corners of King and Market Streets . • On motion of Councilman Oliver , seconded by Councilman - Taylor and unanimously carried the following Resolution was adopted ; • BE IT RESOLVED , by the. Council of the Town of Leesburg , in Virginia that W. C. Spratt , Contractor be and he is hereby authorized and directed to make improvements to the storm - sewers at the oorner of King and Market. Streets as per plans shown and discussed on this date , at a cost not to exceed $275.00 . Mr. Lane .of H. T. Potts Company , demonstrating or showing and discussing fencing for the disposal plant displayed samples of fence and posts of the Page Fence Company. - Bids were read for the fencing of the disposal plant as follows; Anchor- Fence Cpmpany - -Ne.-1- - $1050.00 - No. 2- - 60 .00 Cyclone Fence Company 1215.00 • - Page Fence (H:T.Potts Co. ) - - - 1164.00 Upon motion of Councilman Hourihane , seconded by Councilman Oliver and unanimously carried the following Resolution wa3 adopted ; • BE IT RESOLVED , by the Council of the Town of Leebburg , in Virginia , that the contract for furnishing and erecting a ` fence around the recently completed disposal plant be and it • is hereby awarded to H. T. Potts Company , which. company is to furnish and erect a fence manufactured by the Page Fence Co. according to the manufacturer ' s specifications , set in concrete at a cost to the town of $1164:00. BE IT FURTHER. RESOLVED , by the said Council that the • Mayor be and he is hereby authorized and directed to sign the contract ,for the furnishing and erection of the above - mentioned fence , for the Town . II On motion of Councilman Hourihane , seconded byhCouncilman Taylor and unanimously carried the following- Resolution was adopted ; BE IT RESOLVED, by the Council -of the Town of Leesburg , in Virginia , that the Loudoun County Hthspital , Inc. , be and it is hereby granted permission to connect said Hospital sewer with the sanitary sewer of the Town on West Cornwall Street , provided said Hospital shall pay the Town Fifteen Dollars ( $15 :00) annually from September 1 , 1939 , for the right to empty the sewerage from . said Hospital into said sanitary sewer of the Town which shall be payable Seven Dollars and Fifty Cents (& . 50 ) semi-annually . 234 • On motion of Councilman Turley , seconded by Councilman . Oliver and unanimously carried the following Resolution was adopted ; . B.E. IT ORDAINED, by the Council of the Town of Leesburg , in Virginia , that Section 7 of the Water Ordinance of record in the Curient Record Book, page 200, and in the Ordinance Record Book at page 33 . be and the same is hereby recinded and re- ordained to read as follows : II That the minimum water rate within the corporate limits of the Town shall be $1.00 per month and $2 .00 per month out- side the corporate limits of said town and the rate per - quarter shall be 45V per 1 ,000 gallons for the first 50 ,000 , 30yV per 1 ,000 for the second 50 ,000 and 20V per 1 ,000 gallons for all over 100 ,000 , and the •rate for all uses beyond the corporate limits shall be 75V per 1 ,000 gallons , except charitable , - institutions which shall be required to pay the regular rate {'aid . - within the corporate limits. • This Ordinance shall become effective as of September 1 , 1939 . On motion of Councilman Oliver , seconded by Councilman Hourihane , and unantmoysly carried , the following Resolution was adopted ; . • BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the Auditor-Treasurer , be and he is hereby authorized to pay Moore-Clemens & Company , Fifty-Seven Dollars and Eighty-Seven Cents ($57.87 ) for a premium on an insurance policy for coberage fo the Dodge pick-up truck which is used in cleaning the streets and by the Police Department , and the Chevrolet truck for protection for personal injury in the ' amounts of Ten Thousand Dollars ($10 ,000.00) and injuries to one of more persons for Twenty Thousand Dollars ($20,000:00) maximum in any one accident and Five Thousand Dollars ( $5 ,000.00) property damage , but the said premium shall not be paid until the Town Attorney approves the policy giving the aforesaid protection to the Town . On motion of Councilman Oliver , seconded by Councilman Hourihane , and unanimously carried the following Resolution was adopted ; • BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that this Town become a member of the League of • .Virginia Municipalities for one year from. the date hereof and that the Town Treasurer be and he is hereby instructed to draw a check not later than September 15 , 1939 , for $75.00 in favor of the League of Virginia Municipalities in full for the Town ' s membershJ:p dues for one year from date , which dues shall include subscriptions to the Virginia Municipal Review for -each town official , • nd it is further understood that the adoption of this Resolution does not bind the Town fo continue its membership after one year from date unless the Council shall so direct. On motion of Councilman Oliver , seconded by Councilman Hourihane , and unanimouily carried the Following Resolution was adopted ; BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the sum of Thirty-Five Dollars ( $35.00) be and the same is hereby appropriated to send representatives from the Town Officials to the Annual Convention of the League • of Virginia Municipalities to be held at Old Point Comfprt on the 18th and 19th of September , 1939 , and the Auditor Treasurer is authorized to draw a check for $35.00 and deliver same to the representatives which attend said convention. 'On motion of Councilman Turley seconded by Councilman , Oliver and unanimously carried , the following Resolution was adopted ; - 238 BE IT RESOLVED , by the Council of the Town of Leesburg ; in Virginia , that J. Austin Wright be and he is hereby con- tinued in the employment of the Town at a salary of Eighteen Dollars ( $18.00) per week , subject to hi-s acceptance. • Upon motion of Councilman Rollins , seconded by Councilman E. T . Hourihane and unanimously carried , the following Resolution was adopted; • BE IT RESOLVED, by the Council of the Town of Leesburg , IIin Virginia , that Raymond Hough , be and is hereby continued in the employment of the Town at 'a salary of One Hundred Dollars 4 $100.03 ) per month. Upon motion of Councilman Turley , seconded by -Councilman Oliver and unanimously carried the follwotng Resolution was adopted , WHEREAS , the town has constructed a sewer pipe and one man-hole in and through the land of the heirs of H. J . Fadley , • adjoining the lands of the Washington Coca-Cola Bottling Works. , Inc : , the Washington & Old Dominion Railway Company Co: and others , situate West of King Street in the Town of Leesburg , Loudoun County , Virginia; and WHEREAS , the town has agreed to pay said heirs $225.00 for an easement to maintain said sewer pipe and one man-hole in and - through said land : - • BOW THEREFORE, BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia ; that the Town hereby agrees to pay said heirs of H. J. Hadeley, or Charles F. Harrison, their Attorney , $225.00 for said easement to maintain said sewer.-pipe and one man-hole in and through said land , which shall be paid , as soon as the same is -available in the Construction Fund and a proper deed is signed and delivered conveying said easement • to the town . • • On motion of Councilman Oliver , seconded by Councilman Hourihane and unanimously carried the Following Resolution was - adopted ; . as - adopted ; • WHEREAS , the town has constructed a sewer pipe for a distance of 857 feet in and through the land of H. C. Littlejohn located South of Luddoun Street and adjoining the lands of the .Town, G. Shirley Myers , and others , which land was conveyed to said H. C. Littlejohn by deed of record in the Clerk' s Office of Loudoun County ,Virginia , in Heed Book 10V' s , at page 108 ; and -WHEREAS , the Town agreed to pay said H. C. Littlejohn the sum- of Seven .Hundred Dollars ( $700.00) for an easement to maintain said sewer pipe and three (3) man-holes in and through his said land : VOW, THEREFORE , BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginiam that the Town hereby agrees to pay said H. C. Littlejohn Seven Hundred Dollars ($700.00) for an easement to maintain said sewer pipe and three (3) man-holes in and through his said land , the said sum of Seven Hundred Dollars ($700.00) shall be paid -as soon as the same is available in the IIConstruction Fund and a proper deed is signed and deliveryd conveying said easement to the Town . Upon motion of Councilman Oliver , seconded by Councilman Hourihane .and unanimously carried , -the following Resolution was adopted ; WHEREAS , the population of Arlington County and the vicinity of Falls Church has greatly increased in recent years ; and - WHEREAS , the motor vehicle traffic by automobiles , busses and trucks over Virginia Route 7 between Clark' s Gap , a point three miles West of Leesburg , Virginia , and Falls Church , Virginia , has rapidly increased within the last few 239 • years and is still increasing rapidly as a resul, and con- sequence of the increase of thepopulation in Arlington County and the vicinity of Falls Church as well as the increase of travel and traffic over the said route Virginia No , 7 from various points in the nation West of Leesburg ; and .WHEREAS , a great deal of the said highway between Clark' s gap and Falls Church is narrow, rough, crooked and the surface is rough and uneven ; and IIWHEREAS , bebause of the large amount of traffic and travel over the said highway , it is apparent that steps should betaken or arrangements be made to improve the said highway as soon as possible : NOW,. THEREFORE, BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the State Highway Department of the Commonwealth of Virginia be and it tis urged to consider improving. the said highway as soon as possible for the purpose of accomodating the constantly increasing traffic and travel on and over Virginia Route No._ 7_ between Clarks Gao and Falls Church , ,Virginia . BE IT FURTHER RESOLVED, ,that .a copy of this Resolution be mailed to the following persons : Honorable Henry G. Shirley , Chairman of the _State Highway _Commission, and to each of the other members of said commission , Honorable Thomas Glascock, Honorable John Rust , Honorable H. C. Thompson , Honorable Francis Miller , .the Mayors and Town Council of Falls Church , Furcellsille , Round Hill , .Hamilton , and Vienna , Virginia , • George Hughes , President of the Leesburg Rotary Club , Douglas N. Myers , President of the Leesburg Lions Club , J. S. Whitmore , President of the Loudoun County Chamber of Commerce , Mrs : Randolph Tillett, President of the Waxpool Citieens Association , Howard Li. Armfield , President of the Loudoun County Jinior Board of Trade , Dr. E. C. Schull , President of the Herndon Rotary Club, Albert --F. Anderson, President of the Purcellville Lions Club , the Chairman of -the Board of Supervisors of Fairfax and Loudoun Counties. • BE IT FURTHER RESOLVED, by the said Council , that the ,Chairman of the State Highway Commission ne and he is hereby urged to arrange for a. public hearing of all governmental bodies , . civic organizations , or representatives thereof, and the - citizens interested in improving said highway for the purpose 'of discussing the urgent necessity of improving same and that all of/ said officials ,. civic leaders and citizens be and they are urged to attend said hearing if and when same is granted by the Honorable Henry G. Shitleyr, Chairman of the State Highway Commission: On motion of Councilman Turley seconded. by Councilman Taylor and unanimously carried the foll wotng Resolution was adopted ; BE IT .RESOLVED, by the Council of the Town of Leesburg , in Virginia that the Auditor-Treasurer be and he is hereby authorized , instructed and directed to purchase Chlorine for the disposal treatment plant from the Virginia Carolina Chemical Company at the price quoted in their bid presented and read to the Council on 'this day. BE IT FURTHER E SOLVED,, that 'the Mayor be and he is hereby authorized and instructed to sign the contract for the Chlorine for the' disposal treatment plant , for and •in behalf 'of the town. On motion of Councilman Oliver , seconded by Councilman Hourihane and unanimously carried the following Resolution was adopted ; BE IT RESOLVED , by the Council of the Town of Leesburg , in ' Virginia that the Auditor-Treasurer be and he is hereby author- ized , instructed and directed to purchase a heating kettle for the use of the street department at a cost not to exceed $'160 .00. 240' The Auuitor-Treasurer presented and read his monthly statement for the month of August. Oliver and unanimously carried, the following Resolution was adopted ; WHEREAS , the Town of Leesburg entered into an agreement dated December 5 ,],938, with W. C. Spratt , Contractor of 'red- ericksburg , 'Virginia , whereby said Spratt agreed to construct a sewer system and disposal treatment plant for the said .town ; and WHEREAS , it appears to the Council that the said W. C . Spratt has carried out his part of the said agreement by constructing said sewer system and: disposal tteatment plant in accordance with the terms of said contract. - ' NOW, THEREFORE, •=BE IT RESOLVED, by the Council of the Tom of Leesburg , in Virginia , that the Town does hereby accept said sewer system and disposal treatment plant as having been con9 strutted in accordance with the plans , specifications , contract - documents and all approved change orders ; and BE IT .FURTHER RESOLVED , by the said Council of the Town of Leesburg , in Virginia , that ,Louis T . Titus , Recorder , be and he is hereby authorized and instruc•t6d to send a certified copy of this Resolution to W. C. Spratt, Contractor , and the necessary certified copies to G. L. Dubber ; Resident Engineer Inspector of F. W. A. , Leesburg , Virginia , Upon motion of Councilman Turley , seconded by Councilman Hourihane and unanimously carried , the following Resolution was adopted ; A • 241:: WHEREAS , the Town of Leesburg ; in Virginia , made application -. for and received a grant from F.W.A. in •the, sum of $67 , 500 :00 representing 45 per cent of. ^4150,000.00 - for the costs of a sewer System and treatment plant for the Town of Leesburg , in Virginia ; 'and • Tillir ,EAS , said project which is designated as Va-1353-F has been completed ; and . VvEEhEAS , ,the total costs for constructing said project , preliminary costs , interest during construction , engineering • services , attorney fees , and the costs of obtainthing the necessary :land , right-of-ways and easements amounted to ;152 ,086.78 ; and WHEREAS , the total costs of constructing said project and incidental costs thereof overrun the original estimate by . $2,886 . 78: NOW, THEREFORE , BE IT RESOLVED , by the Council of the Town of Leesburg , in Virginia , that Lucas D. Phillips , Mayor,and Stilson H. Hall , Town Attorney , be and they are hereby authorized ; instrucjzed and directed to make an amendatory application to F.W.A. for 45 per cent 'of S 2 ,086.78 which • said 45 per cent amounts to 00939.04 to finance the overrun in the costs of the aforesaid project. • • BE IT FURTHER RESOLVED; by the Cpuncil of the Town of Leesburg , in Virginia , that Louis T. Tittle , Recorder , be and heds hereby authorized , instructed and directed to furnish Lucas D. Phillips , Mayor 'and Stilson H. Hall , Town Attnrney , .as malty certified copies as they 'may need of this Resolution. d , On motion of Councilman Turley , seconded by Councilman Hourihane and unanimously carried , the followutng Resolution was adopted ; WHEREAS , there is the sum of $1 ,120 .49 in the Construction Fund that should be transferred to the General Fund; and • WHEREAS , before the town will ,be rhea position to secure the final payment of $15 ,000.00 from PWA on the grant of $67 ,500 .00 it will be necessary for the town to make available in the • Construction Fund $2 ,86. 78: . • NOW, THEREFORE, BE IT RESOLVED, by the Council of the Toan of Leesburg , in Virginia , that Roscoe B. Rhoads , Auditor-Treasurer , be and he is hereby authorized and directed to draw a check for $1 ,120 .49 against the Construction Fund and deposit same in the General Fund and also drama check for $2 ,086. 78 against. the General Fund and deposit same in the Construction Fund. On motion of Councilman Turley , seconded by Councilman Oliver and unanimously carried the Following Resolution was adopted ; • • VHEREAS , the Town has recently completed the construction of a sewer system and disposal treatment plant by• the use of funds aggregating $82 , 500.00 provided by the Town and a grant of 67, 500 :00 from the Public Works Administration of the United ' States Government ; and WHEREAS , W. . C. Spratt , contrsctor , of Fredericksburg , Virginia , did the construction work ; and WHEREAS , the Rust Emgineering Company , Inc . , did the engine- ering work in connection woth the said projects , the plans and _specifications having been made by R. F. Cutler , 0. M. Rutledge and E. Marshall Rust , Vice-Presi,dent of the Rust Engineering Cpmpany , Inc. , and the construction work having been supervised. • by F. P. .Eltonf. and WHEREAS , the Honorable Harold L. Ickes , Secretary of the Interior , and Administrator for the F. W.A. of the United States Government , H. T. Cole , Regional Director for Region No. 3 , and 42 H; A. Wortbam, Acting Regional Director for Region Ido. 3 , Stanley H. Wright , Reeional .Engineerm N. L. Webb , Traveling En- . gineer , J . S. Coleman , R. M. ,Elam, Assistant Frojec•t •Auditor , • • C. E. Dexter , Traveling Engineer , G. L. Dubber , Resident Engin- eer Inspector , J . E. Brunner and others , who represented TWA. in making the aforesaid grant as well as seeing that the teams of same were complied with ; and WHLT EAS , Major Richard Messer and E. C. Meredith and others • of the Health Department of the Commonwealth of,Virginia , rendered valuable service to the town in seeing that . the plans and specifications for said projects complied with the requirements of the ,State Board of Health for the Commonwealth of Virginia; c and WHEREAS , all of the representatives of F. W. A. cooperated at all times with the Town Officials , contractor and engineers , and they were prompt and efficient ; and +4HEEEAS , the representatives of.the Rust Engineering Company , Inc. , were at•tentivevto their duties .and cooperated at all times with the representatives of FWA , the contractor and the officials 'of the Town in seeing that said projects were completed in accordance with the terms of the contract between the .contract- or and the Town; and . . WcLTEAS , it appears to the qouncil that W. C. Spratt , Con- tractor , constructed said projects in accordance with the terms of his contract woth the Town in a splendid , efficient , • expeditious and first-class manner from start to finish; and Eiji-TEAS , the employees of said contractor and especially Mr. Thomas Spratt , was at all times cooperative with the repres- entatives of F. W.A.; , the officials of -the Town and the Engineers in Charge and endeavored to see that the said projectsnwere constructed with as little inconvenience as possible to the residents of thw Town; and WHEREAS , the citizens of the Town manifested a spitit of cooperation ,• forebearance , tolerance and helpfulness et all times during the construction of said projects ;. and WHEREAS , it is the opinion of .the. Council that said projects were constructed at a nominal cost in view of the asset that they will be to the Town and that they will eliminate insanitary conditions and, thereby make Leesburg a better place in which to live : . NOW, THEREFORE ,, BE IT UNANIMOUSLY RESOLVED, by the Mayor and Council of the Town of Leesburg , in Virginia , that we hereby express the Town' s appreciation and gratitude to all of the aforesaid officials of F.W.A. , the State Board of Health of the Commonwealth of Virginia ; W. C. Spratt , Contractor , the Rust Engineering Company , Inc. , and the Citizens and Residents of the Town of Leesburg , in Virginia , fox the splendid assistance , aid ; cooperation , interest , forebearance , tolerance and helpfulness each and every one manifested , gave and rendered to the Town during the Conctruction of the aforesaid projects which we. think will be of inestimatable value to the town as a result of eliminating insanitary conditions and thereby providing better . sanitary conditions for the residents and property owners in the Town of Leesburg , in Virginia. , BE IT FURTHER RESOLVED , by the Council of the Town of Leesburg , in Virginia , that LoUi3 T . Titus , Recorder , be and he is hereby instructed to send a copy of this Resolution to H. T. Cole , Regional Director of EWA? J. E. Brunner . G. L. Dubber , Resident Engineer Inspector , E. Marshall Rust , Vice-President - of the Rust Engineering Company , Inc. , and Major Richard Messer of the Health Department of the Commonwealth of Virginia. 243'• - Upon motion of Councilman Rollins , seconded by Councilman Oliver , and unanimously carried , the following Resolution was adopted ; EE IT RESOLVED, by the Council of the Town of Leesburg , • in Virginia , that the Town Hall be leased to the. Fitts Tally Ho Theater Inc. for a period of two ( E ) years at a monthly rental of $25.00. BE IT FURTHER RESOLBED , by the said Council that Stilson H. Hall, Town Attorney , be and he is hereby authorized and directed to draw a rental contract between the Town and The Pitts Tally • Ho Theater Inc. , for the renting of the town hell to the said - Theater, in accordance with paragraph one of this Resolution. On motion of Councilman Oliver , seconded by Councilman Taylor and. unanimously carried , the following Resolution was adopted ; BE IT RESOLVED, by the Council of the Town of Leesburg , in- Virginia , that the Water Committee be and it is hereby Authorized , instructed and directed to employ an inspector to inspect all drainage into the new sanitary sewer system. In the absence of the Recorder , upon motion of Councilman Hourihane , seconded by Councilman Oliver. and unanimously carried , Councilman Flippo was elected to act as Recorder. Upon motion duly made , seconded. and carried the reading of the minutes was dispensed with until the next meeting. Mr. Lloyd Slack and Itr. J. T. 'Hirst appeared as a committee from the Leesburg Rotary Club to ask that the Council request the . .State Highway Department to take over Loudoun -Street in order that traffic congestion might be eliminated on Market Street , and upon motion- duly made , seconded, and carried the following Resolution was passed;
