M. APPROVED : Cp kas. �� RECORDER p� ry�� MAYO: • April 12 , 1940 SPECIAL ' . i ' ' At a special meeting of the Mayor and -T.own "Council of the town of Leesburgr in -Virginia held in the 'Council Chamber Chamber on Friday, April 12 , 1940 at 7 :30 -P. M, there .were present ; Lucas D. ' Phillips ; Mayor ; Louis T . Titus , . Recorder and R. M. Flippo , J. T. Hourihane , J . L. Oliver , L. C.' Rollins and J. H. Turley , Councilmen . The Mayor stated-that the purpose of the meeting was to consider and adopt a resolution authorizing payment to G. Shirley Myers and Elijah F. Myers the 'sum of ^175.00 for an easement through their property , located on Loudoun Street between the property of H.. C. Littlejohn and the Town of Leesburg. • On motion of Councilman Oliver , seconded by Councilman Turley and carried (all members present voting FOR except Councilman _ Rollins who did not vote) the followine Resolution was, adopted ; WHEREAS , there has been a dispute between H: C. Littlejohn and G. Shirley Myers regarding the ownership of a part of the • land in and through which the sewer pipe line from West Loudoun Street to . the lot or parcel of land owned by the Town of Leesburg , In Virginia ; and . WHEREAS , the Town has already-secured from H. C . Littlejohn the right to maintain said sewer pipe line through his interest in said land in and through which the said pipe line has been constructed ; and WHEREAS , the Town has agreed to pay the - said G. Shirley Myers and Eli-jeh •F. Myers the sum of One Hundred 'Seventy-five Dollars ($175.00 ) for the right to maintain said •sewer pipe line in and through ang and all the interest they have in the land in and through which said sewer pipe line.-and three man-holes have been constructed : NOW , THEREFORE , BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that Rcscoe B. Rhoads , Auditor-Treasurer , be and he is hereby authorized , instructed and directed to draw • a check for One Hundred Seventy-five Dollars ( S175.00) in full- . payment for the right to maintain said sewer pipe line and three man-holes in and through the interest the said G. Shirley Myers and Elijah F. Myers have in the aforesaid land for a distance aggregating approximately 857 feet ; and the said G. Shirley Myers and Elijah F. Myers shall be paid simultaneously .with the delivery 264 • to the Town by them an agreement or deed to be signed by them and . their wives granting and conveying to the Town the right to - maintain the said sewer pipe line and three man-holes iii and • through any and all interest said G. Shirley Myers arid Elijah F. Myers have in said land , which said agreement oto deed shall be approved by Stilson H. Hall , Town Attorney. There being no further business , on motion duly made , seconded and carried , the Council adjourned .at 747 /�FF.. M. APPROVED: Zeet.:d t RECORDER !/ MA R • May 13 , 1940 • At a regular meeting of the Mayor and Town Council of the town of Leesburg , in Virginia held in the Council Chamber on Monday May 13 , 1940 , at 8 : P. M. there were present , Lucas D. Phillips ; Mayor , Louis T. Titus , Recorder and R. M. Flippo , J. T. Hourihane , J. L. Oliver , L. C. Rollins , J. D. Taylor and_ J. H.Turley , Council- men. The minutes of the last regular meeting held on April 8th and those of a special- meeting held on April 12 , 1940 were read and upon motion duly made , seconded and carried , were 'approved as read. . . The Auditor-Treasurer read his monthi;i report for the '. month of April 1940. • The Auditor-Treasurer presented the current bills and upon motion of Councilman Oliver , seconded by Councilman Turley - and unanimously carried , the following Resolution was adopted ; BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia that the Auditor-Treasurer be and he is hereby authorized ; and instructed to pay the following bills ; : 'Virginia Public 'Service Company • Mayor ' s Office and Fire House •- - - 7. 50 • General Pumping _ - .
