ORDINANCE NO. 06 -907
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
AMENDING THE TEMPLE CITY ZONING CODE RELATIVE TO OFF STREET
PARKING REQUIREMENTS FOR DIFFERENT TYPES OF RESTAURANTS,
FAST FOOD RESTAURANTS, DRIVE THRU RESTAURANTS, TAKE OUT
RESTAURANTS, CONVENIENCE STORES, RETAIL STORES, LIQUOR
STORES, AND MARTIAL ARTS STUDIOS
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS:
SECTION 1. Based upon information contained in the Staff Reports to the Planning
Commission dated April 25, May 9, and May 23, 2006, and based upon information and discussion in
regard to the draft Negative Declaration as well as information which was provided in the City Council
Staff Report dated July 5, 2006, and based on testimony received at the Planning Commission meetings
of May 9, and May 23, 2006, as well as testimony which was received at the City Council meeting of July
5, 2006, the City Council hereby amends the Zoning Code of the City of Temple City as described in
Section 4 below based upon the findings set forth in Section 2 below and based upon the Environmental
Assessment which is discussed in Section 3 below.
SECTION 2. The need for a Zoning Code amendment is based upon the following findings:
1. The City is in need of modernizing and clarifying certain areas of our Off Street
Parking Requirements section of the Zoning Code. In particular, there needs to be a
distinction of parking standards for restaurants, fast food restaurants, drive thru
restaurants, and take -out restaurants. Additionally, other uses are in need of text
modernizing, in particular convenience stores, retail uses, and martial arts studios.
2. Currently, the City requires 1 parking space for every 100 square feet of floor area for
all types of food establishments (i.e. restaurants, fast food, etc.); however, from a
practical standpoint, a take -out restaurant and drive -thru restaurant would have less
of a demand for parking, compared to a sit -down restaurant.
3. Currently, the Zoning Code is silent relative to parking requirements for take -out food
establishments. Therefore, this Code Amendment would establish certain parking
standards for take -out restaurants.
4. Overall, the above - mentioned code changes would allow practical parking standards
for different types of restaurants. The updating of the outdated and ineffective
verbiage contained in the Zoning Code due to the ambiguity regarding parking
requirements for various types of food establishments, the Planning Commission
wishes to recommend a Zoning Code Amendment to further clarify the subject
matter.
SECTION 3. This project (amendments to the Temple City Zoning Code) shall result in no
significant effects upon the environment and a Negative Declaration has been prepared in accordance
with the State CEQA Guidelines. The initial study as prepared indicates that there is no potential for
adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and
related ecological communities, including the habitat upon which the wildlife depends for its continued
viability.
SECTION 4. The following amendments are hereby made to the Temple City Zoning Code:

1 parking space for each 100 square feet of gross floor
area, but there shall be no less thanl0 parking spaces
provided. Outside dining areas shall also be included into
the gross floor area.
1 parking space for each 200 square feet of gross floor
area.
1 parking space for each,150 square feet of gross floor
area, but there shall be no less than 5 parking spaces
provided. Outside dining areas shall also be included into
the gross floor area.
1 Parking space for each 400 square feet of gross floor
area, plus 1 parking space for each employee.
Number of Parking Spaces Required
General commercial; retail stores, 1 parking space for each 250 square feet of gross floor
service shops, and general area
offices.
Liquor Stores 1 parking space for each 250 square feet of gross floor
area.
Take -out restaurants without a
drive -thru and without customer
tables (e.g., delicatessens, take-
out pizza establishments,
bakeries, etc).
1 Parking space for each 200 square feet of gross floor
area, but there shall be no less than 5 parking spaces
provided.
SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance and to its
approval by the Mayor and shall cause the same to be published according to law.
