HomeMy Public PortalAbout19900913CCMeetingTybee Island, Georgia September 13, 1990 The regular monthly meeting of the Tybee Island City Council was held at Tybee City Hall beginning at 7:30 p.m. on Thursday, September 13th. Mayor Charles J. "George" Hosti presided, with the following members of Council present: Jeff Dukes, Jimmy Brown, Bill Walsh, Jack Youmans and Patrick Locklear. Councilman Paul Jackson was absent due to illness in his family. John Foster attended in City Attorney's absence. Mr. Mahoney was representing Tybee at an annual seminar of city attorneys at the University of Georgia. Mayor Hosti began by calling on Councilman Locklear who delivered an Invocation. This was followed by the Pledge of Allegiance to the American flag, led by the mayor. Mayor Hosti then opened the meeting for a public hearing on a variance petition for 115 Second Avenue, Fitz Simmons, owner. Mr. Simmons spoke for himself, explaining that the setback is already nonconforming, and that this plan does not extend the setback, but merely allows him to make an addition to his home. There were no other speakers, pro or con. Mayor Hosti called on Jim Kluttz, Chairman of the Planning Commission, who reported that their discussion lead to the conclusion that nothing pertaining to the setback line is being changed, and that the group voted unanimously in favor of granting the request. Mayor Hosti said the vote would be taken later in the meeting. Bonnie Gaster spoke for the committee working on the 103rd Birthday Festival which will be a two -day event, October 12th & 13th, with the art show continuing through Sunday, the 14th. She said the Tybee Arts Association will host the art show inside City Hall, and that the other events will be in Memorial Park. A non - profit beer & wine license has been applied for. The grand finale is fireworks on the beach, and she said the Chamber of Commerce has applied for the permit and insurance and will take care of clean up, by reimbursing the city for the costs. She asked the Fire Department to take charge of the actual performance of the fireworks. Councilmen Locklear & Youmans asked for continuance of complimentary booths in the park for churches, clubs & nonprofit groups. Tybee Island, Georgia September 13, 1990 Page Two Danny Weatherly spoke for the MDA, thanking the city for the use of Memorial Park on Labor Day and reporting that 70% of the money raised will stay in Chatham County. He demonstrated a wheel chair that might be bought with the donations received. He said that next year the MDA would like to move the telethon to 16th Street and would like to make it a larger, longer - lasting event, citing the positive publicity this would bring to the island at large. Gary Lescak, who owns the house at 13 Dogwood Lane, spoke to ask City Council to schedule a nuisance hearing on the property next door to him, known to Council as the site of the former Mays home and lawn mower repair. The property has frontage on both Pulaski and Dogwood Streets and has become a wildlife refuge, overgrown with weeds and with piles of trash. There are two buildings with windows out. Mayor Hosti said he'd check with the City Attorney about a hearing, and asked Council - members to look at the property in the meantime. Ted Solomon spoke about Veterans Day, asking a donation for a city advertisement in their annual program. The cost is $30.00, and helps support the Veterans' Day Parade. Steve Yekel spoke as a candidate for House District #125, saying he is for a lottery provided the funds are used for education and correction. The meeting was opened for business legally presented. Minutes from the meeting of August 8th were approved unanimously on motion of Councilman Brown, seconded by Councilman Walsh. Bills for the month of August were approved as follows: General Government Other Govt. Police Fire 1st Response Public Works Sanitation $ 6,197.40 $18,833.15 (Chamber - $13,467) $14,913.45 $15,164.76 (Pumper - $12,482.64) $ 264.40 $14,506.30 $17,479.05 Tybee Island, Georgia September 13, 1990 Page Three Bills (continued) Parking Services $ 1,686.21 Recreation $ 3,753.26 Lifeguards $ 605.14 General Fund Total $93,403.12 Water /Sewer $23,603.11 These bills were approved unanimously on motion of Councilman Brown, with second by Councilman Dukes. Mayor Hosti remarked that the total is above $117,000.00, and asked cooperation from Council in holding down expenses. Councilman Dukes moved, and Councilman Locklear seconded, that a voting delegate be appointed for the upcoming GMA Fall Legislative Conference. Councilman Youmans was designated. The 18th Street Area Drainage Study was next discussed, with Mayor Hosti saying that he needs guidance from the Council before he talks again to Burke Day. Councilman Walsh suggested providing access only to each lot, when building permits are issued. Councilman Youmans seconded. Mayor Hosti said that a grant application for DCA's Local Development Fund has been completed, asking for two increments of $10,000 each to help fund the south end drainage. Councilman Dukes said that Councilman Walsh's suggestion may be the best way to go, but that the drainage report is so complicated and includes so many large figures that it should be at a work session with the engineer, studied individually by all members of Council prior to acting. Mayor Hosti said the study was intended to keep the city from putting in pipe that's too small. Councilman Brown asked that the width of a driveway be specified, and this was decided to be 20 feet, with 2Z feet of flare either side, for a total of 25 feet. The vote was 4 - 1 in favor of the motion, with Councilman Dukes casting the dissenting vote. A letter from Christopher Chandler dated July 24th petitioning the city to sell 703 A First Street, PIN #4 -03 -01 -021 was read. Councilman Brown moved to deny the petition, the motion was seconded by Councilman Youmans and the vote was unanimous in favor of denial.. Tybee Island, Georgia September 13, 1990 Page Four A letter from John L. Hunter, Jr. petitioning for purchase of land located west of his property at 1701 Butler Avenue. Councilman Dukes moved to deny the request and Councilman Brown seconded. The vote was unanimous in favor of the motion, and the petition was denied. A vote to allow the Chamber of Commerce to hold Tybee's 103rd Birthday Festival was approved on a motion of Councilman Locklear, seconded by Councilman Walsh. There were no dissenting votes. The MDA Telethon for '91 was approved, with details to be provided later, for the 16th Street Area. The motion was made by Councilman Youmans with a second by Councilman Dukes, and the vote was unanimous in favor. It was the consensus of Council that problems of nuisance abatement (two examples: property adjacent to Gary Lescat, and the old garages in the city right -of -way in Fort Screven) will be handled after consultation with the city attorney. Ted Solomon's request for a $30 advertisement for the Veterans' Day Parade was considered on a motion to approve by Councilman Youmans, seconded by Councilman Brown. Council Walsh said he doesn't believe the city should pay for this. Mayor Hosti says there is no budget allocation for this, but the individual Councilmembers donated toward the bricks for the Vietnam Veterans' Memorial, and can do the same here. The motion was defeated by a vote of 2 - 3 with Councilmen Dukes, Locklear and Walsh voting against the motion, and Councilmen Youmans and Brown voting in favor. Donations were taken and Mr. Solomon's ad was purchased. The variance for Fitz Simmons, 113 Second Avenue, was granted unanimously on motion of Councilman Dukes, seconded by Councilman Walsh. A Resolution for Rails and Trails was unanimously adopted after reading and motion of Councilman Dukes. Tybee Island, Georgia September 13, 1990 Page Five A Resolution concerning an optional, contributory plan for deferred compensation for employees was adopted unanimously on motion of Councilman Dukes, seconded by Councilman Youmans. A Proclamation honoring the Bicentennial of the Constitution was adopted on motion of Councilman Brown, seconded by Councilman Youmans. The second reading of Code Section 6 -1 -15, concerning cut fees for water /sewer was read. Councilman Walsh moved its adoption, seconded by Councilman Brown and the vote was unanimous in favor. It was announced that a special Planning Commission meeting to discuss the Northshore development has been set for Monday, September 17th at 7:00 p.m. Mayor Hosti said that he has been invited to Legislative Night by Glynn County, and thinks they want him to speak about Tybee's Beach renourishment. He doesn't think it will cost more than $100. Councilman Brown moved the Council approve this trip, and Councilman Youmans seconded. Councilman Locklear said he'd like to go, too, but will pay his own way. The vote was unanimous in favor. The meeting was adjourned. R E S O L U T I O N III WHEREAS, The Chatham County Rails into Trails Committee has been formed to work in concert with the Georgia Rails into Trails Society and the National Rails into Trails Society, and WHEREAS, the primary purpose of these groups is to convert abandoned railroad rights of way into trails for public use with due respect for conservation and preservation as well as public recreation, and WHEREAS, the work of these groups will serve to preserve the integrity of our nation's railroad corridor system against a possible future transportation need, and WHEREAS, the Chatham County Rails into Trails Society is working with the Chatham County Parks, Recreation and Cultural Affairs Department and other public agencies and citizen groups to build a four -mile recreation trail on the segment of railroad right of way extending from the vicinity of Fort Pulaski to Elba Cut, to be known as the "McQueen's Island Multipurpose Trail Project," and WHEREAS, the government of Chatham County and the City of Savannah have declared themselves in support of this project, IIINOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the City of Tybee Island, Georgia hereby support the endeavors of the Chatham County Rails into Trails Committee in creating the "Mcqueen's Island Multipurpose Trails Project." Mayor Charles J. ti 1 1 R E S O L U T I O N WHEREAS, The City of Tybee Island has considered the establishment of a Deferred Compensation Plan to be made available to all eligible city employees and elected officials pursuant to Federal legislation permitting such Plans; and WHEREAS certain substantial tax benefits could accure to employees and elected officials participating in said Deferred Compensation Plans; and WHEREAS such benefits will act as incentives to City employees to voluntarily set aside and invest portions of the current income to meet their future financial requirements and supplement their City retirement and Social Security (if applicable), at no cost to the City; and WHEREAS The Georgia Municipal Association has established a master prototype deferred compensation program for cities and political subdivisions permitting its member cities and their employees to enjoy the advantages of this program; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TYBEE ISLAND, GEORGIA DOES HEREBY RESOLVE AS FOLLOWS: The City Council hereby adopts the Georgia Municipal Association Deferred Compensation Program and its attendant investment options, hereby appoints the Board of Trustees of the Georgia Municipal Employees Benefit system as plan administrator and hereby establishes the City of Tybee Island Deferred Compensation Plan for the voluntary participation of all eligible city employees and elected officials. The City Treasurer, Patricia B. Pagan, is hereby authorized to execute for the City, individual participation agreements with each said employee requesting same, and to act as the "Contract Administrator" of the Plan representing the City, and to execute such agreements and contracts as are necessary to implement the Program. It is implicitly understood that other than the incidental expenses of collecting and disbursing the employee's deferrals and other minor administrative matters, that there is to be no cost to the City for the Program. C3rk, ty of Tybee Island Mayor Charles Hosti 1 1 1 P R O C L A M A T I O N WHEREAS, We the People did ordain and establish a Constitution for the United States of America to secure the blessings of liberty for ourselves and our posterity; and WHEREAS, it is important that all citizens fully understand the provisions, principles and meaning of the Constitution so they can support, preserve and defend it against encroachment; and WHEREAS, the Bicentennial of the Constitution provides an historic opportunity for all Americans to learn about and to reflect upon the rights and privileges of citizenship and its responsibilities; and WHEREAS, the President and the Congress of the United States have designated September 17 as Citizenship Day and the week of September 17 - 23 as Constitution Week; and WHEREAS, the people of the City of Tybee Island do enjoy the blessings of liberty, the guarantees of the Bill of Rights, equal protection of the under the Constitution, and the freedoms derived from it; NOW, THEREFORE, I Charles J. Hosts, Mayor of the City of Tybee Island, in cooperation with the Commission on the Bicentennial of the United States Constitution, do hereby proclaim September 17 as Citizenship Day and the week of September 17 - 23 as Constitution Week, and invite every citizen and institution to join in the national commemoration. BE IT ORDAINED, AND IT IS HEREBY ORDAINED BY THE MAYOR AND COUNCIL IN OPEN MEETING ASSEMBLED, THAT THE TYBEE ISLAND CODE OF ORDINANCES BE AMENDED BY THE DELETION OF SECTION 6 -1 -15 AND REPLACED BY A SECTION TO BE NUMBERED THE SAME, AND READING AS FOLLOWS: 6 -1 -15. Delinquency; Cutoff and Cut -in Fees. (a) Bills for water service shall be rendered bimonthly and shall be due and payable in the Treasurer's office on the first of the =it,ri;h. These bills shall set forth a separate charge for water servico and for sewer service and the total thereof. The total charge must be paid. No discounts for prompt payment are allowed, but a fee of $10.00 for delin- quency shall be assessed on all bills not paid by the 20th day after billing. (b) When any service is discontinued due to delinquency, it shall not he restored to the delinquent customer until the delinquent bill is paid in full, including a service charge totaling $10.00 of which $5.00 shall be considered for water and the same amount for sewer reconnection (cut -in) fees.
