rescinding an Ordinance of record in the Cur=cent Ordinance Book
• appointeng the Town Sargeant as Health officer for the Town. A copy
of this Ordinance may be found in the current Ordinance Book.
Upon motion of Councilman Fiske , seconded by Councilman Oliver
and unanimously carried there was an Ordinance passed appointing the
County Health Officer as Health officer for the Town of Leesburg, A
copy of this Ordinanc may be found in the current Ordinance Book.
There being no further business, on motion. duly made , seconded
and carried , the Coundil adjourned at 7 :55 P. M. fat.

JANUARY 2, 1942 • SPECIAL
At a Soecial meeting of the Mayor and Town Council of the Town
of Leesburg , in Virginia held in the Council Chamber on Friday ,
January 2 , 1942 at 7 :P. M. there were present ; Lucas D. Phillips ,
Mayor and Louis T. Titus , Recorder and C. W. Fiske , - R. M. Flippo ,
J. L. Oliver , L. C. Rollins and J. H. Turley., Councilmen.
The Mayor stated that the purpose of the meeting was to
consider a resolution regarding the purchase of a Lot belonging to
the Heirs of the Late Ward Loveless and to take up such other
' matters as might come before the Council.
The Recorder read the Resolution and upon motion of Councilman
Flippo , seconded by Councilman Fiske and unanimously carried the
said Resolution was laid on the table until Monday January 5 , 1942 ,
at 7 : P. M. when • there would- be a Special meeting for further
consideration of laic: Resolution.
There being no further business , on motion duly made , seconded
and carried , the Council adjourned at 7 :35 .P. M.

January 5, 1942 SPECIAL
At a Special meeting of the I.ayor and Town Co4ncil of the Town of
Leesburg , in Virginia held in the Council Chamber on Monday , January ;
' 5th 1941 at 7 P. M. , there. were present ; Lucas D. Phillips , Mayor,
Louis T. Titus , recorder and C. F. Fiske ; R. M. Flippo , J . T. Hourihane ,
J. L. Oliverm L. C. Rollins and J. . H.Turley Councilmen.
The minutes of the last regular meeting held December 8th 1941 an d
those o a special meeting held on January 3 , 1942 were read and upon
motion duly made , seconded and carried sere approved as read. '
The Auditor-Treasurer read his monthly statement for the month
of December 1941 and his Quarterly statement for the quarter ending
December 31 , 1941.

Upon motion of Councilman Oliver , seconded by Councilman
Hourihane and unanimously carried the following Resolution was adopted ;
WHEREAS , the Auditor-Treasurer has this day presented to
the Council of the Town of Leesburg , in Virginia , a quarterly
statement of all receipts and an analysis of all disbursements
for the months of October , November and December 1941 ;
NOW, THEREFORE , BE IT RESOLVED , by the Council of the
Town of Leesburg , in Virginia that the said quarterly report
of the Auditor-Treasurer be and the same is hereby unanimously
approved and accepted by the said Council .
BE IT FURTHER RESOLVED , by the Said Council that the
Auditor-Treasurer be and he is hereby authorized and directed
to have a copy of the said quarterly report published once in
a newspaper published in said town and also post a copy of
. said quarterly report in front of the courthouse in the said town.
The Auditor-Treasurer presented the current bills and
upon motion of Councilman Oliver , seconded by Councilfian
Hourihane and unanimously carried the following resolution
was adopted ;
BE IT RESOLVED , by the Council of the Town of Leesburg ,
in Virginia that the Auditor-Treasurer be and he is hereby •

Upon motion of Councilman Oliver , seconded by Councilman
Hourihane and unanimously carried by a recorded vote , all for , the
following Resolution ,which was introduced on January 2 , 1942 and
laid on the table , was adopted ;
WHEFWAS , Ward Loveless died seized and possessed of a
lot or parcel of land situate , lying and being in the Town of
Leesburg , Loudoun County , Virginia , adjoining Market Street on
the north, Wirt Street on the west , the Tally-Ho Theater and
Lambert Garage on the east and the property owned by Fling and
others on the south; and

WHEREAS , there is a deed of. trust on the said land dated
July 23,, 1937 , of record in the Clerk ' s Office of Loudoun County ,
Virginia in Liber 11 M, Folio 468 , to secure the payment of a
debt of $7 ,000.00; and it is contempalted that the estate of the
said Ward Loveless will not be settled until one year after his
"death, so as to enable his heirs to convey a free and unencumber-
ed title to the said land ; and
WHEREAS , the Town of Leesburg desires to purchase the said
lot and is' willing to pay $10 ,000.00 therefore by paying
$1 ,000.00 upon the siginig and delivery of the contract signed by
the heirs of the said Ward Loveless , including his three sons-
in-law, which said sum of $1 ,000.00 , if this offer is accepted ,
is to be deposited in escrow in the Loudoun National Bank of
Leesburg , Leesburg , Virginia , and same , together with any accrued
interest. thereon is to be paid to the heirs of the said Ward
Loveless upon the delivery to the Town of Leesburg a general
warranty deed conveying said land to the Town, and upon the -
delivery of the said deed the Town will pay the said heirs of
Ward Loveless the Balance of the purchase price of $9 ,000.00 :
NOW, THEREFORE , BE IT UNANIMOUSLY RESOLVED by .the Council
of the Town of Leesburg , in Virginia that the Town does hereby
submit an offer of $10 ,000.00 to the heirs of Ward Loveless for
• the aforesaid lot or parcel of land , and if this offer is
accepted , the Town agrees to pay the said '10 ,000.00 by depotis-
ing $1 ,000.00 in escrow in the Loudoun National Bank of Leesburg ,
Leesburg , Virginia , upon the signing and delivery of an agree-
ment between the Town and the Heirs of Ward Loveless , which
agreement is to be signed by his widow, three daughters and
three sons-in-law, and the balance of $9 ,000.00 to be paid one
• year after the death of Ward Loveless , or as soon thereafter as
his estate is settled , and the said lot or parcel of land can
be conveyed to the town, free from all encumberances including
the release of the aforesaid deed of trust dated July 22e,1937 ,
to secure the payment of a debt of 57 ,000.00 , which offer is
also conditioned upon the Town' s having immediate possession of
said lot upon the signing and delivery of said agreement , and
the right and privelege of omproving said lot by. removing the
standing trees thereon , grading and surfacing same , and that in
the event the sale. lot cannot be conveyed to the Town free from
all encumbrances within two years after the date of the death
of the said Ward Loveless , the said $1 ,000.00 which is to he
deposited in the said . bank, if this offer is accepted , shall
be refunded to the Town if the Town elects to have same done .
This offer of $10,000.00 is for the said lot or parcel of land
and- also all the brick and other materials now on the same ,
excepting the lumber , and the- Town is to pay the taxes- on said
land for the year 1942 .
BE. IT -FURTHER RESOLVED that Stilson H. Hall , Town Attorney ,
be ,and he is , hereby instructed to draw an agreement between
the Town and the Heirs of the said Ward Loveless , including
his widow, three daughters and three sons-in-law , for the
purchase of said lot or parcel of land by the Town , pursuant
to the terms of this Resolution , and said agreement shall
provide that the deed to the said ltt or parcel of land shall
convey same to the Torun or to whomsoever the Town may in
writing designate.
BE IT FURTHER RESOLVED, that Lueas D. Phillips , Mayor ,
be , and he is , hereby authorized and directed to sign the said
agreement for and on behalf of the said Town; and Roscoe B.
- Rhoads , AuditorsTreasurer , is authorized to draw a check
against the General Fund of the "own for 01 ,000.00 to make
the aforesaid paymen$ of $1 ,000.00 , provided the aforesaid
offer is accepted.

In the absence of the Recorder Ctuncilman Flippo acted
in his stead.
Upon motion duly made , seconded• and carried the following
Resolution was adopted ;
•
WHEREAS, the Leesburg_ Volunteer Fire Company has pur-
chased an ambulance and has offered to give it to the Town
of Leesburg ; and
WHEREAS , the Council of the Town of Leesburg is of the
opinion that the ownership of the said ambulance by the Town
would require unjustifiable expenditure of money , whChhwould
have to be paid by the taxpayers of the town , from which they
would not derive benefits commensurate with the expenses
incidental to the operation thereof; and
WHEREAS , the Council is of the further opinion that the
cost of maintaining the said ambulance out of the Treasury
of the Leesburg Volunteer Fire Company is justified , provided
said Company desires to do so , in view of the fact that the ,.
said ambulance is useful to the said Fire Company in going
to and from fires and other emergencies out of town and in
remote sections of Loudoun County :
40W, THEREFORE , BE IT RESOLVED , by the Council of the
Town of Leesburg, in Virginia , that the Leesburg Volunteer
Fire Company be ,and it is , hereby authorized to keep the said
ambulance in its own name , or in the name of the Town , and
operate the same in connection with fighting fires , or for
the purpose of taking firemen to and from fires , or anyone
injured at a fire to a hospital or other place within the
county for necessary treatment , or other emergencies justify-
ing the use of the same for charitable purposes , - provided ,
as long. as , the Leesburg Volunteer Fire Company will pay
all the expenses incidental to keeping , maintaining and
operating said ambulance.
