HomeMy Public PortalAbout19901108CCMeeting1 1 Tybee Island, Georgia November 8, 1990 The Tybee Island City Council held its regular monthly meeting on Thursday, November 8, 1990 at Tybee City Hall, with Mayor Charles J. Hosti presiding. The following members of Council were present: William C. Walsh, Sr.; John 0 Youmans, Sr.; James Patrick Locklear; Paul Jackson; James C. Brown, and L. Jefferson Dukes. Thomas J. Mahoney, Jr., the City Attorney, was also present. The meeting began with the Invocation by Councilman Locklear followed by the Pledge of Allegiance led by Mayor Hosti. David deBorde was the first visitor to speak. He offered suggestions on recycling, and said that Tybee needs to prepare for the Olympics. He said the public dock facility needs improving, and that the city should approach the Corps and the State about dredging an area near Tybee Marina for a city marina. Steve McCusker spoke on the recommendation of the planning commission concerning restricting building heights. He used a number of arguments to reinforce his view that the proposed ordinance may be unconstitu- tional. Gary Lescak asked for a nuisance hearing on property condemned by the health department three years ago. He gave a history of the frustrations he had over a period of six years, trying to get action. He said there is no consensus among city officials, the attorney, the marshal. He spoke of the file history missing from the marshal's desk. He said that recently a half -way job has been attempted, and that rats disturbed by that activity are now coming into his house. He cited attempts to sell his house which have fallen through with the reason given that the property next door is so unsightly. Mayor Hosti said he knows the owner has cut the grass and repaired the roof. City Attorney Mahoney gave the complainer a method to use in coming to court. There was some general discussion. Mr. Lescak left, abruptly. Curtis Lewis, an attorney representing Ladha, Inc., spoke about the height proposal recommended by the planning commission. He cited probable questionable constitutionality and gave the EconoLodge across the street as an example of a commercial property with no immediate plans to expand, but with an investment in a building that was planned for an eventual four -story height. 1 1 Tybee Island, Georgia November 8, 1990 Page Two Jeanne Hutton spoke as a member of the Master Plan's Neighborhood 7 group. She said the 35 -foot height restriction is on the books now, and has a footnote to take care of Mr. McCusker's objections. Minutes of the October 11 meeting were approved on motion of Councilman Jackson, seconded by Councilman Walsh. Bills were approved as follows: Water /Sewer $31,503.53 Gen. Government $17,353.89 Police $ 8,904.56 Public Works $20,966.29 Sanitation $17,851.89 Fire $ 3,548.68 First Responder $ 56.38 Parking $ 751.01 Recreation $ 3,27 .76 The motion was made by Councilman Locklear, seconded by Councilman Jackson, and unanimously passed. Councilman Jackson reported that the water /sewer depart- ment now has a winch truck which will be a big help when pumps have to be pulled. He said the department has saved for a long time to purchase this piece of equipment. Councilman Dukes said the finance committee has begun its review of the 1991 budget and that a meeting is scheduled for November 20th to review the expenses side of the budget. He reported on a recent meeting with Professor Booton, saying that we are moving ahead on the computer- ization plan. NOAA has joined the Marine Science Center as an exhibitor, bringing some funding with them. The Corps of Engineers will also exhibit. A citizen volunteer group is trying to establish a nonprofit corporation with Mr. John Sugrue acting as attorney on a voluntary basis. He expressed his gratitude to Mr. Sugrue, and all the highly competent volunteers. Councilman Brown announced that the Beach Rules committee will meet on Monday, the 12th of November, to finalize some recommendations for signs and literature. A license transfer for Mrs. Nancy Chalmers of Huntley - Jiffy located at 14th and Butler was brought before the group, with a motion by Councilman Brown to approve. He quoted a letter from Chief McCutchen indicating that calls from that location have not been excessive, and that consumption on premises is not a part of the license, which is for sales 1 1 1 Tybee Island, Georgia November 8, 1990 Page Three only. Councilman Dukes seconded the motion, and the motion passed without dissent after some discussion by Councilman Youmans of the number of police calls to the store's parking lot. Councilman Walsh reported that the 18th Street Drainage project, from the strand to Butler, has been completed. It was recommended by the engineers that the project be extended across Butler, and this is planned for near future. The 15th Street drainage project is in the works, too, with hopes that the pipes can be lined at a cost of approxiamtely $60 a foot, rather than completely replaced, which would cost $400,000, including paving. Councilman Youmans said that the equipment for the latest truck is on order, and that a work order for restrooms for the fire building has been requested. Councilman Locklear said the recreation department is trying to start a soccer program, and two coaches are needed (volunteers). He spoke of a recent letter from Jim Golden, who says the county is going to cease all maintenance of "neighborhood" parks. He said he and Mrs. Solomon are going to attend the County Commission meeting to ask for continued ballfield maintenance, at least. A letter from the Square Dancers asking for permission to have a New Year's Eve dance at City Hall was read. After discussion of the state of the floors - no more sanding can be done - it was recommended that the group use the Community House or Recreation Building. The vote was two for allowing the use, and four against. Councilmen Locklear and Youmans cast the affirmative votes. Mr. Mahoney explained, on the Mayor's request, the law having to do with Uniform Elections. Local legislation will be necessary if Tybee wishes to continue its two -year terms. Councilman Dukes moved that this be requested, and Councilman Locklear seconded. The vote was unanimous. A Resolution confirming the tax millage at 10 mils was read and Councilman Dukes moved its adoption, seconded by Councilman Brown. The vote was unanimous in favor. There was discussion on the delinquent date of December 20th, since our bills say December 31st. Mr. Mahoney explained that the state law sets the date of December 20th. 1 1 Tybee Island, Georgia November 8 , 1990 Page Four An ordinance updating Code Section 8 -2 -13 (Housing Code) was read and accepted on First Reading by motion of Councilman Jackson, seconded by Locklear. The Second Reading of Code Section 8 -2 -15 was discussed. Councilman Locklear moved to send back to a committee, since it may not be needed. He moved that it be tabled for one year, and this was seconded by Councilman Youmans. Councilman Dukes, on a point of order, asked if this is a reasonable and practical period of time and the City Attorney consulted Roberts Rules. The vote, then taken, was unanimous. The subject will be brought up again in November, 1991. Code Section 8- 4 -33D, Building Heights, was discussed, with the idea brought forward by Mayor Hosti that there should be a special meeting with the Planning Commission Chairman to discuss this. Councilman Youmans said this needs to be looked into because we're trying to get our insurance rates lowered and all buildings over 3 stories must be listed on the ISO report. He moved that the matter be considered now, and the motion died for lack of a second. Councilman Dukes thanked and comr.,endpd Mr. Kluttz and the Planning Commission for the work and research done on these ordina.ncos, both the height ordinance and the bed and breakfast ones - a total of eight changes in the Zoning Ordinance. He moved that there be a special work meeting to consider these changes and Councilman Jackson seconded. The vote was 5 in favor, with the one dissenting vote cast by Councilman Youmans. Mrs. Jeanne Hutton from the audience asked if the work session could be in the evening and was answered affirmatively. The date of November 15th, at 7:30 p.m. at City Hall was set. The meeting was adjourned. 1 A RESOLUTION WHEREAS, the fiscal year of the City of Tybee Island begins on January 1 and ends on December 31; and, WHEREAS, Title 3 of the Code of Ordinances for the City of Tybee Island, Georgia, and specifically Section 3 -2 -11 provides in part that the millage rate for annual advalorern tax upon all real and personal property within the City shall be established each year by Resolution of the Mayor and Council; and, WHEREAS, the Mayor and Council desire to set the millage rate for the year beginning January 1, 1990 and ending December 31, 1990 in compliance with the terms of the Ordinances of this City: NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Tybee Island, in open meeting assembled, that the millage rate for the fiscal year January 1, 1990 through December 31, 1990 be set at ten (10) mils.
