HomeMy Public PortalAboutOrdinance 3367 111111111111111111 201800013719 DEBBIE GILLETTE RECORDER - KENDALL COUNTY, IL RECORDED: 9/21/2018 01:14 PSI ORDI: 43.00 RHSPS FEE: 10.00 PAGES: 8 ORDINANCE NO. 3367 AN ORDINANCE ADOPTING AN AGREEMENT AUTHORIZING REIMBURSEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS BENEFICIAL TO THE PUBLIC FOR THE VILLAGE OF PLAINFIELD PIN #'S 06-03-05-100-005; 06-03-05-300-005; 06-03-06-100-005; 06-03-06-100-007; 06-03-06-100-011; 06-03-06-100-014; 06-03-06-100-016; 06-03-06-200-002; 06-03-06- 200-003; 06-03-06-200-007; 06-03-06-200-008; 06-03-06-200-009; 06-03-06-400-002 WHEREAS, the VILLAGE is authorized by the Illinois Municipal Code (65 ILCS 5/9-5-1 et. seq.) to enter into agreements to provide for the recapture of offsite improvement costs; and WHEREAS, the VILLAGE adopted Ordinance No. 2614, an agreement authorizing reimbursement for the construction of improvements beneficial to the public ("AGREEMENT"), for the construction and oversizing of sanitary sewer improvements located generally south of 135th Street and west of Meadow Lane, and Recorded in Kendall County as Document No. 200700011910; and WHEREAS, Section 5 of the AGREEMENT establishes a term of the AGREEMENT; and WHEREAS, the VILLAGE and OWNER wish to extend the term of the AGREEMENT because certain benefitting properties have yet to develop. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: I. That Section 5 of Ordinance No. 2614 is hereby amended as follows: "The term of this Agreement shall remain in full force and effect until the earlier of which occurs (i) such time as the DEVELOPER has been fully reimbursed for that portion of the reimbursement attributable to the BENEFITTING PROPERTY as herein provided, or (ii) ten (10) years after the adoption of this ordinance.
