HomeMy Public PortalAboutOrdinance 3369 11 11 1 1 111 11 2018001013721 DEBBIE GILLETTE RECORDER - KENDALL COUNTY, IL RECORDED: 9/21/2018 01:14 PM ORDI: 41.00 RF{SPS FEE: 10.00 PAGES: 6 ORDINANCE NO. 3369 AN ORDINANCE ADOPTING AN AGREEMENT AUTHORIZING REIMBURSEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS BENEFICIAL TO THE PUBLIC FOR THE VILLAGE OF PLAINFIELD PIN #'S 03-25-400-001; 03-25-400-002; 03-25-400-004; 03-25-400-005 WHEREAS, the VILLAGE is authorized by the Illinois Municipal Code (65 ILCS 5/9-5-1 et. seq.) to enter into agreements to provide for the recapture of offsite improvement costs; and WHEREAS, the VILLAGE adopted Ordinance No. 2701, an agreement authorizing reimbursement for the construction of improvements beneficial to the public ("AGREEMENT"), for the construction and of improvements to 127th Street between Ridge Road and Elizabeth Drive, and recorded in Kendall County, Illinois as Document No. 200700033597; and WHEREAS, Section 5 of the AGREEMENT establishes a term of the AGREEMENT; and WHEREAS, the VILLAGE and OWNER wish to extend the term of the AGREEMENT because certain benefitting properties have yet to develop. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: I. That Section 5 of Ordinance No. 2701 is hereby amended as follows: "The term of this Agreement shall remain in full force and effect until the earlier of which occurs (i) such time as the DEVELOPER has been fully reimbursed for that portion of the reimbursement attributable to the BENEFITTING PROPERTY as herein provided, or (ii) the (10) years after the adoption of this ordinance. This Ordinance shall be in full force and effect from and after its passage, approval and filing as required by law. PASSED THIS 6TH DAY OF AUGUST, 2018.
