(A copy of this Ordinance may be found • on page 59 in the current Ordinance book) An invitation was extended to the Mayor and Council by the Leesburg Darden Club to visit the homes in Leesburg on Saturday, May 17, 1947. • - -- - ' un motion of Jas. L. McIntosh, seconded by C .W.Fiske and unanimously carried, the mayor was authorized and directed to ap- point a Committte of- two to investigate the matter of a new truck for the Town, with power to purchase if necessary. The Mayor ap- pointed Jas. L. McIntosh and C .W.Fiske as the Committee. The Town Hall Building Committee through the Mayor re- ported that a representative from the National Recreation__. As- sociation of New York, N.Y. had been in Leesburg and had gone over the matter of converting the Town Hall into a Community Center. Upon motion of Thelma J . Smoot, seconded by Jas. L. Mc- . intosh and unanimously carried the mayor was authrrized, instruct- ed and directed to appoint a five-mah board tit citizens of the Town, to be known as a Board of Recreation. Upon the secdnd_reading of the Telephone Franchise. Ordi- , . nance now under consideration, discrepancies were found to exist with the one now in force, and upon motion of C .W.Fiske, seconded by Jas. L. McIntosh and unanimously carried, the Town Attorney was instructed to render an apion on same. An application from Lr. H C.ittlejo to connedt his residence adjoining the Corporate imitT cera referred to the Sewer Committee for consideration and reccomendation. II . Letters of resignation from Roger F. Powell, Town Serg- eant and S. C. Bell, Night watcman, . effective June 1, 1947, were read to Council. No action taken. The minutes of the last meetings were read and upon motion of C .W.Fiske, seconded by J.L.Oliver and unanimously carried, they were approved as read. Oliver, and unanimously carried, the following Ordinance was adopted: N ORDINANCE GRANTING A FRANCHISE TO • ITS SUCCESSORS AND ASSIGNS, TO USE THE STREETS AND OTHER PUBLIC PLACES OF THE TOWN OF LEESBURG, VIRGINIA, FOR ITS POLFS, WIRES, CONDUITS, CABLES AND FIXTURES. BE IT ORDAI_NED by the Council of the Town of Leesburg, Lou- doun County, Virginia, that , its successors and assigns, for a period of thirty (30) years be and is hereby auth- orized and empowered to construct, •maintain and operate its pots, poles, conduits, manholes, ducts, cables, wires and all other necessary over- . head and underground apparatus on, over, along, in, under and through the streets, alleys, highways and other public places withinn the limits of the Town of Leesburg, in the county of Loudoun, and the state of Virginia; and to use the property of other companies and permit other companies to use its property Upon such arrangements as the two cam- panies may agree; PROVIDED: SECTION 1. That all poles erected by said Company shall be neat and symmetrical, and shall be so located as in no way to in- terfere with the safety and convenience of persons traveling on or • over the said streets, alleys, highways, and other places ; and in the installation and maintenance of its underground system, said Company shall not open or encunber more of any street, alley, . highway, or other public place than will be necessary to enable it to perform the work with proper economy and efficiency. • SECTION 2. That the erection of poles and construction of conduits, under the provisions of this ordinance, shall be subject to the supervision of the Chairman of the Street Committee or some other representative appointed by said council, and said Company shall replace and properly relay any sidewalk or street pavement which may have been misplaced or damaged by it in the construction and mainten- ance of its system. SECTION 3. That on one (1) crossarm of the poles erected or in one (1) duct of the conduits constructed,' un_der the provisions of this ordinance, shall be reserved, free of charge, for the purpose of acrrying wires of any fire alarm or police telegraph system owned and maintained by said Town, provided the said wires are placed and maintained in such a manner as may be prescribed by the said Company, . and in no case used to carry electric light or high-tension currents. SECTION 4. That the said Company shall maintain its lines in good and safe order and condition; and shall at all times fully indemnify., protect and save harmless the said Town from and against all claims arising from the erection, construction or negli- 431_ gent maintenance of its said lines. . SECTION 5. That nothing in this ordinance shall be con- strued to grant unto the said Company any exclusive right or to pre- vent a grant of similar privileges to other companies. SECTION 6. That no...poles or overhead wires or construct4- . ion shall be allowed along King street extending from Loudoun Street to Cornwall Street and along Market Street extending from the Pres- byterian Church to Church Street, except as now located, and that - said Company shall at all times be subject to the Town Ordinances now in existence, or which may be. hereafter passed relative to the use of streets by telephone companies. 1 SECTION 7. Recorder Adopted June 9, 1947. • Approved June 9, 1947 Mayor • BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF LEESBURG, LOU- DOUN COUNTY, VIRGINIA, that the annexed ordinance, entitled "AN ORD- INANCE GRANTING A FRANCHISE TO, , ITS SUCCESSORS AND ASSIGNS, TO USE THE STREETS AND OTHER PUBLIC PLACES OF THE TOWN OF LEESBURG, VIRGINIA, FOR ITS POLES , WIRES, CONDUITS, CABLES AND - FIXTURES," be advertised once a week for four successive weeks in the Loudoun Times-Mirror, a newspaper published in the Town of Leesburg, Virginia, and having a general circulation ifi the Town of Leesburg; and that. said advertisement shall invite bids for the franchise pro- posed to be granted in said Ordinance, which bids are to be in writing and delivered to the presiding officer of the Town in open session, to be held in the Council Chamber in Leesburg, on the 14th day of July, IMI 1947, at 8:00 o' clock, P.M. , the right being reserved to reject any and all bids. BE IT FURTHER RESOLVED, that the invitation for bids to be published with said Ordinance shall be as follows: The Town of Leesburg, Loudoun County, Virginia, hereby in- vites bids for the franchise proposed to be granted in the following Ordinance, duly passed by the Council and approved by the Mayor on the 9th day of June, 1947, which bids are to be in writing and de- livered to the presiding officer of the Council of said Town in open session, to be held in the Council Chamber in said Town on the 14th day of July, 1947, at 8:00 o' clock, P.M. , the right being reserved to reject any and all bids . C.W.Fiske, and unani- mously carried, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the State Auditing Department be, and it is hereby re- quested to audit the records of the Auditor-Treasurer of the Town c6n- cerr_ing._the Town' s finances for one year, from July 1, 1946 through June 30, 1947, and that the said Town will pay the Commonwealth of Vir- ginia for caking said audit; and ueorge E. Ward, Recorder, is autho- rized and requested to execute a certified copy of this Resolution to be mailed to .the Auditing Department of the Commonwealth of Virginia. On recommendation of the Light Committee, the Auditor- Treasurer was authorized and directed to have lights installed in the ''sown Garage near the Pumping Station and also a street light on sot h King Street, near tile Laundry. • . 432 On motion of C .W.Fiske, se'onded by Thelma J. Recorder Regular July 14, 1947' At a regular meeting of the Mayor and Town Council- of the Town of Leesburg, in Virginia, held in the Council- Chamber on Monday, :July 14, 1947 at 8:00 o'clock P.M. , there were present: . The Auditor-Treasurer. read his monthly report for the month of June, 1947, his Quarterly report for the quarter ending dune 30, 1947 and his Annual statement for the fiscal year ending . —June 30, 1947 and upon motion of C.W.Fiske, seconded by J.L.Oliver and unanimously carried the following resolution was adopted: : • - WHEREAS, the auditor-Treasurer has this day presented to the Council of the 'Twin of Leesburg, in Virginia, a quarterly statement of all receipts and analysis of all disbursements for the months of April, May and. °une , 1947; NOW, THEREFORE, BE IT RESOLVED, by thenCouncil of the Town of Leesburg, in Virginia, that the said quarterly report of the Auditor-Treasurer be and it is hereby approved and accepted by said Council; BE IT FURTHER RESOLVED, by the Council that the Auditor- Treasurer be and he is hereby authorized and instructed to have a copy of the said quarterly report published once in a newspaper, published in said town and also post a copy of said report in front of the Court House in the said town.
