Rhoads be, and he is hereby appointed Building inspector for the Town of Leesburg, in Virginia as pre- scribed by the Zoning Urdiance. " On motion of Thelma J. Smoot, seconded by J.L.Mclntosh and unanimously.carried, the Recorder was directed to write a letter of thanks to the Leesburg Garden Club for their invitation to Coun- cil to visit the homes of Leesburg on May 17, 1947 withttibkets of admission thereto. " There being no further business, on motion duly made, I seconded and unanimously carried, the Council adjourned. Recorder " e Regular July 14, 1947 At a regular meeting of the Mayor and Town Councilof the Town of Leesburg, in Virginia, held in the Council-- Chamber on Monday, July 14, 1947 at 8:00 o' clock P.M. , there were present: El N. Bradfield, Mayor, Ueorge B. ward, Recorder, C.W.Fiske, J.L. Mc- Intosh, J.L.Oliver, L.C.Rollins and Thelma J. Smoot, Councilmen. The minutes of the last meeting were read and upon motion J.L.Oliver, seconded by Thelma J. Smoot. and unanimously , carried, they were approved as read. The Auditor-Treasurer, read his monthly report for the month of June, 1947, his Quarterly report for the quarter ending June 30, 1947 and his Annual statement for the fiscal year ending -- June 30, 1947 and upon motion of C.W.Fiske, seconded by J.L.Oliver and unanimously carried the following resolution was adopted: - WHEREAS, the auditor-Treasurer has this day presented to the Council of the Town of Leesburg, in Virginia, a quarterly statement of all receipts and analysis of all disbursements for the months of April, May a nl. 'dune , 1947; NOW, THEREFORE, BE IT RESOLVED, by thenCouncil of the Town of Leeeburg, in Virginia, that the said quarterly report of the Auditor-Treasurer be and it is hereby approved and accepted by said Council; BE IT FURTHER RESOLVED, by the Council that the Auditor- Treasurer be and he is hereby authorized and instructed to have a copy. of the said quarterly report published once in a newspaper, published in said town and also post a copy of said report in front of the Court House in the said town. Smoot and unan mously carried, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia), that the sum of $21.25 be paid Nora matcher, as the -town's share, towards the laying of 17 square yards of cement sidewalk in- front of her -property on North Wir--t Street. Col. E. B. White,, representing the Veterans of roreign Wars, Post No. 1177, appeared before Council and asked that they be per- mitted to hold a carnival in the town during the last week in August without the regular payment of the tax fee. On motion of C.W.Fiske, . seconded by Thelma J. Smoot and unanimously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the veterans. of Foreign wars, Yost No. 1177, be and they are hereby granted permission to exhibit a carnival within the corporate limits of the town during the last week of August, 1947, without being -required to pay the license tax imposed by the Tax Ordinance of the Town. In pursuance of •the advertisement in the Loudoun Times-Mirror inviting bids for the franchise proposed to be granted in said ad- vertisement, the bid of the Chesapeake & Potomac Telephone Co. of Virginia was delivered. On request of the Mayor the recorder read aloud the only bid received, being the bid of the Chesapeake & Potomac Telephone Co. of virginia, in writing, and for She sum of $50; and whereas inquiry was made by the Mayor if any further were received, and..whereas there were no further bids received, the Mayor thereupon declared the bidding closed - ^ The bid referred to is as follows: • Richmond, Va. July 10, 1947 To the Mayor and Council of the Town of Leesburg, Va. :- Gentlemen: • The Chesapeake and rotomac Telephone Company of Virginia bids • the sum of Fifty Dollars ($50.001 for the franchise proposed to be granted in the ordinance, which has been advertised in the Loudoun Times-Mirror) entitled, "An Ordinance Granting a Franchise to its successors and assigns, to use the streets and other public plqces of the Town of Leesburg, Virginia, for its poles, wires , conduits cables and fixtures." And if the said franchise is granted to the Chesapeake and 434 Potomac Telephone Company of Virginia, it will observe and perform all the conditions.and requirements contained in said' ordinance and will re- imburse the Town of Leesburg for the cost -of advertising the same, and will give bond.as required by law. - A certified check for the sum of Fifty Dollars ($50.00.) the bid hereby made, is herewith enclosed. • • 17th. Smoot and unanimously carried, and voting as follows: Fiske, Smoot, Oliver, McIntosh, Rollins, in favor of accepting the bid of the Chesapeake & Potomac Telephone Company of Virginia as submitted•and adpting the said ordinance: Nom, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF LEESBURG, LOUDOUN COUNTY, VIRGINIA, THAT THE CHESAPEAKE AND POTOMAC TFLF.PHONE COMPANY OF VIRGINIA, its successors and •gssigns, for a period of thirty (30) •years be and is hereby authorized and empowered to construct, maintain an& operate its posts, poles, conduits, manholes, ducts, .cables, wires and all- other necessary overhead and underground apparatus• on, over, along, in, under and through the streets, alleys, highways and other public places- within the limits of the Town of Leesburg, in the county of Loudoun, and state. of Virginia; and to use the property ofoothenccompanteseand permit other companies to use its property upon arrangements as the two campanies may agree; PROVIDED: Section 1. That all poles erected by said cdmpany shall be neat and symmetrical, and shall be so located as in no way to in- terfere with the safety or convenience of persons traveling on or over the said streets, alleys, highways and other puhlic places•: and in the installation and maintenance of its underground system, said company shall not open or encumber more of any street, alley, highway or- other public place thanwill be necessary to enable it to perform11 the work with proper economy and efficiency. • • • section 2. That the erection of poles and construction of conduits, under the provisions of this ordinance, shall be sub- ject to the supervision of the Chairman of the Street Committee or some other representative appointed by said Council, and said company shall replace and properly relay any sidewalk or street pavement which may have been displaced or damaged by it in the construction and maintenance of its system. section 3. That space on one (1) orossarm of the poles: erected or one (1) duct of the conduit constructed, under the pro- visions of this ordinance, shall be reserved, free of charge, • for the purpose of carrying wires of any fire alarms or police telegraph system owned and maintained by said town, provided the said wires are placed and maintained in such a manner as may be prescribed by the said company, and in no case used to carry electric light or high-tension currents. • • Section 4. That the said •Company shall maintain its lines in good andeaafe order and condition; and shall at all times fully _ indemnify, protect and save harmless the said town from and against. all claims arising from the erection, construction or negligent . maintenance of its said lines. Section 5. That nothing in this ordinance shall be con- . 11 strued to grant unto said Company any exclusive right or to pre- vent a grant of similar privileges to other companies. Section 6. That no poles or overhead wires or construction shall be allowed along King street extending from Loudoun street to Cornwall street and along Market street extending from the Presby- terian Church to Church street, except as now 'located, and that said company shall at alltimes be subject •to the Town Ordinances now in existence, or which may be hereafter passed relative to the use .of streets by telephone companies. - Section 7. This ordinance shall be in force from its passage. 435 BE IT FURTHER ORDAINED that THE CHESAPEAKE AND POTOMAC TET,F • - PHONE COMPANY OF VIRGINIA, before proceeding to act under this ordi- nance, shall execute a bond, in the penalty of Five Hundred Dollars, ($500.00) , with good and sufficient security, in favor of the Town of Leesburg, conditioned upon the construction and putting into oper- ation and maintaining in good order, the plant provided for in this franchise, and furnishing of. efficient telephone service at reasonable rates. . The Mayor announced that he had appointed the following as members of the Board of Recreation for the Town of Leesburg as in- structed by Council at a regular, meeting on May 12, 1947: John .Deidrich, Louise H. Patton, T. Robert Fulton, Wm. F. Peach, H.I.Tiffany. On motion of C.W.Fiske,- seconded by J.L.Mclntosh and unani- mously carried,. the Auditor-Treasurer was directed and instructed to send notices to. all property owners, reminding them that the Town would - pay $1.25 per square- yard towards the laying of any cement sidewalk, pro- viding proper application was made to the town and the construction of said work was in conformity to Town regulations. Said notices to be mailed out with. the September water bills. do motion of C . W. Fiske, seconded by J.L.Mclntosh and unanimously carried the -following. resolution was adopted: WHEREAS, T. Russell Potts, E.S.Dailey, and C .P.Conrad, Judges of the Town Election- held on dune 10, 1947, have certified that M. R. Lowenbach received 210 votes -for Mayor, Francis L. Patton received 202 votes for Mayor.; George E. Ward received 302 votes for Recorder, Roscoe B. Rhoads received 1 vote for necorder, Sol Feldman received 1 vote for Recorder; James. L. McIntosh received 355 votes for Councilman, Louis T. Titus received 340 votes for Councilman, C. William Fiske received 316 votes for Councilman, Thelma J. Smoot received 260 votes for Council- man, Emerson H.. James received 259 votes for Councilman, Joseph L. Oliver received 222 votes for Councilman, Joseph H. Turley received 194 votes - for Co 1man,. Albert M. Kline received 165 votes for Councilman, Arthur T. ElginrFeceived 106 votes for Councilman, Oden K. Semones received 1 vote for Councilman, - C .E.Newton received 1 vote for Councilman. • WHEREAS, it appears from the report of the said Judegs of Election that all of the candidates, exfept Francis L. Patton, RoscoeB. 436. Rhoads, sol Feldman, Joseph H. Turley, Albert M. Kline, Arthur T. Elgin, Or. , Oden K. Semones and.C .E.Newton were elected to the respective offices for which they were candidates; NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Leesburg, in Virginia, that the following persons be and they are- here- by declared to have been duly elected for the term beginning September 1, 1947, and ending August 31, 1949: M. R. Lowenhack, Mayor, ;George E. Ward, Recorder, James L. McIntosh, Louis T. Titus, C. William-Fiske, Thelma J. Smoot, Emerson H. James and Joseph L. Oliver, Councilman. A report from the Special Town Hall Committee was made by Councilman Oliver. Mr. Oliver stated that the Committee in consul- tation with Mr. Nash, architect from Washington and Bluemont, had 11 been .advised that the cost of the proposed improvements would cost approximately $18,000. The Committee felt that further consideration at this time inadvisable. Mayor Bradfield discharged the Committee with thanks. • .
