Fiske and unanimously carried, the Town agreed to pay for the printing and advertising of the necessary inspection Forms for distribution bt thetFire Department for use during Fire Prevention. Week;. April 5-7. Qn motion of Thelma J. Smoot, seconded by Louis- T. Titus and unanimously carried the Town agreed to pay half of the expense of a Mechanic to check weekly on the condition of the Fire Trucks, the Fire Department to pay the other half; the Fire Committee to check further the exact amount of the cost and report to the Council at their next meeting. On motion of C.W Fiske, seconded Emerson H. James and unani- r mously carried, the matter of purchasing accessories for the Town Truck was ordered laid on the table. • - • . On-motion of James L. McIntosh, seconded by Louis T. Titus and carried by a 5 to 1 vote , Fiske not voting, the matter of purchase of street signs was ordered laid on the table for further consideratin Petitions opposing the installation of Parking Meters in the four business blocks in the Town of Leesburg were filed with Council. There being no further bussiness, on motion duly made and unani- mously carried, the Council adjourned. • • Recorder • Aj •ved: / , . ;11#.11 • u: or. f Regular - April 12, 1948 • At a regular meeting of the Mayor and Town Council of the Town of -Leesburg, in Virginia, held in the Council Chamber on Mon- day, April 12, 1948 at 8:00 o'clock P. M. there were present: Maurim '. R. Lowenbac4, Jr. Mayor , ueorge E. Ward, necorder, C .W.Fiske, E.H. James, J.L.Mclntosh, J.L.Oliver, Thelma J. Smoot and Louis T. Titus, Councilmen. - • The minutes of the last meeting were read and upon motion of J. La Oliver, seconded by C . W . Fiske and unanimously carried, they were approved as read: • • • Fmmitt Jackson, representing the Providence Baptist Church appeared before Council and asked that the sidewalk and curb in front of their property on South Church street be repaired. On motion of J. L. McIntosh, seconded by C . W. Fiske and unanimously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be, and he is hereby authorized, instructed and directed to have erected a wooden curbing on the • West side of South Church street between Royal and South street. On motion of Louis T. Titus, seconded by C . W. Fiske, and . unanimously carried the following Ordinance was enacted: • • WHEREAS, the Town of Leesburg in Virginia is advised that in 1946 the ueneral Assembly of Virginia amended Section 3091 (4) of the 1946 Code of Virginia relating to changes and amendments '� in the zoning laws of Towns and Cities of this State; and, • • ' WHEREAS, the Council believes it prudent and expedient to pass an ordinance in order to avail itself of the new provisions of the law and to amend its present ordinances to include the new provisions. NOW, THEREFORE, BE IT ORDAINED by the Council of said Town,' pursuant- to the provisions of Section 3091 (4) of the 1946 Code of Virginia, the said Town shall have the power, right and authority to refer proposed changes in or amendments or supple- ments to, any Town zoning regulations, restrictions or boundaries to the Board of Zoning Appeals for a report and recommendation and such Board shall make report and recommendation to the Council 451 after a public hearing in relation thereto held by the Board pursuant to prior notice published fine dgys in a newspaper of general cir- culation in said Town. The public hearing by the Council in re- lation to such change, amendment or supplement may be held after at least ten days ' notice of the time and place of such hearing pub- lished in a local newspaper of general circulation in said town. On motion of Thelma J . Smoot, seconded by J. L. Oliver and unanimously carried, the following Ordinance was enacted: WHEREAS, H.S.Dorin, President of the Leesburg Laundry, Inc., Leesburg, Virginia, and J. T. Hirst, President of J.T.Hirst & Com- pany, Inc. , Leesburg, Virginia, appeared before the Council of this -'Town and brought to its attention the fact that the property now owned by, the said Laundry located on the East side of King Street, in said Town adjoining the properties of Atwell, White and others; and the property occupied by the said Hirst Corporation owned by • Mark white also located on the East side of King Street -in said Town adjoining the said Laundry, W. & 0. D. Railroad property, and others, under the present Town Zoning Ordinances are included in the "Busi- ness District" ; and WHEREAS, at the time of the passage of the Town Zoning Ordi- nances the said Laundry was conducting on its property a Laundry and Dry-Cleaning business, and the said firm of J.T.Hirst & Company, Inc. , was conducting on the said White property a lumber, paint and hardware -business, and such businesses since that time have con- tinued to be conducted on said properties; and, WHEREAS", pursuant to law a Board of Zoning Appeals consisting of W. 0. •Bailey, T. M. Fendall, John W. Clemens, Roy Flippo and E. S. Dailey have been appointed and are still acting; and, WHEREAS, pursuant to Section 3091 (4) of the 1946 Code of Virginia -it is-provided that the Council is authorized to submit pro- posals, amendments or supplements to any zoning regulations to the Board of Zoning Appeals for its report and recommendations, after a public hearing in relation thereto in the manner and method pro- vided by 'law; and, VIHEREAS, " the said two corporations have requested that the said two properties hereinbefore dewcribed shall be included in the "Indmstrial District" and not in the "Business District" under the Town zoning ordinance; and • WHEREAS, the Council believes that the requested changes and amendments should be sub,itted to the Board 'of Zoning Appeals for its report and recommendations. NOW, THEREFORE, BE IT ORDAINED by- the Council of the Town of Leesburg,' in Virginia, as follows: '(1) That the said Council hereby refers to the Board of Zoning Appeals for its report and recommendation the said requests of the Leesburg Laundry, Inc . and J .T.Hirst & Company, Inc. , Lees- burg, Virginia, to change the present designation of said. properties from that of a "Business District" to that of an "Industrial Dis- trict" after a public hearing in relation thereto held by the said Board in pursuance of law. (2) That the Recorder of this- Town shall forthwith deliver certified copies of this ordinance to the Board of Zoning Appeals in sufficient number as may be required. on motion of Louis T. Titus, seconded by C .W.Fiske and unani- mously carried, the petition of W.J.Hay to re-zone his property on East South Street was ordered laid on the table . The Mayor read to Council the regular monthly report of the Police Department as submitted by Town Sergeant J.A.Thompson. The Auditor-Treasurer read his monthly statement for the month March, 1948, his Quarterly report for the quarter ending March 31, 1948 and upon motion of Louis T. Titus, secohded by J.L.Oliver and unanimously carried the following resolution was adopted: WHEREAS, the Auditor-Treasurer has this day presented to the Council of the Town of Leesburg, in Virginia, a quarterly report of • all receipts and an analysis of all disbursements for the months 452 of January, r'ebruary and March, 1948; • NOW, THEREFORE, BE IT RESOLVED, by, the Council of the Town of Leesburg, in Virginia, that the said quarterly report of the Auditor- Treasurer be and it is hereby approved and accepted by said Council; BE IT FURTHER RESOLVED, by the said Council that the Auditor- 'Treasurer be and he is hereby authorized and directed to have a copy of the said quarterly report published once in a newspaper, published in said Town and also post a copy of the said report in front of the Court House in the said Town. Inc. 8.$ $653-45 The Finance Committee presented the proposed budget for the fiscal year beginning July 1, 1948, and ending June 30, 1949, and upon motion of C .W.Fiske, seconded by E.H.James and unanimously carried the_. following resolution was adopted: WHEREAS, the Auditor-Treasurer has this day presented to the • Council a budget showing the annual receipts and disbursements for the year 1947 and the estimated receipts and disbursements for the fiscal year beginning July 1, 1948 and ending June 30, 1949, NOW, THEREFORE, BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be, and he is hereby authorized, instructed and directed to have the aforesaid budget published once in a newspaper published in said Town. BE IT FURTHER RESOLVED, by the Council of the Town of Lees- burg, in Virginia, that there will be a meeting of the said Council in the Council Chanber of the Town Hall Building, in the Town of Leesburg, Virginia, at 8:00 o'clock on Monday, April 26, 1948, for the purpose of giving any citizen of the Town of Leesburg the right to appear before Council and state his views on the aforesaid budget. BE IT FURTHER RESOLVED , that due notice be published be pub- lished once in a newspaper published in the Town of Leesburg, of said meeting. 453 On motion of Louis T. Titus, seconded by E.H.James and unani- mously carried, the Mayor was authorized and directed to write the Purcellville Library that the Town office would not be available for use a branch office for their library. The matter of purchase of a power mower for, use on the streets was brought to the attention of Council by the Mayor and referred by him to the Street Committee for study and recommendation. Un.motion of C .W.Fiske, seconded by J.L.Mclntosh and carried by a 5 to -1 vote, Mrs. Smoot .not voting, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be authorized, instructed and directed to purchase fifty (50) Street Signs, with posts, and have same installed,at the several intersections in the Town. un motion of J.L.Oliver, seconded by C .W.Fiske and unanimously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditoreasurer be, and he is hereby authorized, instructed and directed to purchase two (2) fire hydrants (with nec- essary valves) etc .) and have same installed at the Corporate Limits r on East Market and East Loudoun Streets. On motion of J.L.Mclntosh, seconded by C.W.Fiske and unanimously carried, the following resoluti®n was adopted: ' BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- gihia, that the Loudoun County Hospital, Incorporated, be, and it hereby is, granted permission to connect a four-inch pipe to the water pipe line on Vest Cornwall Street, to be extended from' said street to a point at or near the Hospital building to supply a fire hydrant in case of fire or other emergency at said hospital, pro- - vided the said hospital pays all costs of installation and main- tenance by complying with all the town regulations. Un motion of Mrs. Thelma J. Smoot, seconded by J.L.Mclntosh and unanimously carried, the week of MaO to 15, was designated as Clean-up and Paint-Up Week. On motion of Louis T. Titus, seconded by E.H.James, and car- ried by a 5 to 1 vote, Fiske voting Nay, the matter of reimbursing Policeman Huber for use of his truck while on duty, was ordered laid On the table. An Ordinance permitting out of town residents to connect to the `gown Sewer system was presented to Council and upon motion of Mrs. Thelma cr. Smoot, seconded by C .W.Fiske and unanimously carried was referred to the Sanitation and Sewer Committee for study and establishmentwof rates and report back to Council at their next meeting at which time action on said Ordinance would be taken.
