Regular May 9, 1949 At a regular meeting of the Mayor and Town Cofincil of the Town of-Leesburg, in Virginia, held in the Council Chamber on Monday, May 9 , 1949 at 7:45 o' clock P. M. , there were present: Maurice R. Lowen- - bach, Jr. Mayor, Ueorge E. Ward, Recorder, J.L.Mclntosh, J.L.Oliver, Francis L. Patton and Thelma J. Smoot, Councilmen. • The minutes of the last meetings were read and upon objection of Councilman Smoot, the following correction was made: In the second line of the last paragraph ` r -appointment of Uearge H. lAardy as Collector of monies from Parking Meters) add "Patton not voting" . Upon motion of Mrs . Thelam J. Smoot, seconded by -J.L.Oliver and unani- carried, the minutes were then approved as corrected. The Auditor-'treasurer read his monthly report for the month of April, 1949, andpresented the current bills and upon motion of J.L. Oliver, seconded by J.L.Mclntosh and unanimously carried the following li' resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that the Auditor-Treasurer be, and he is hereby authorized and directed to pay the following bills : Virginia Electric & Power Co. Smoot and unanimously carried, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that the State Auditing Department be, and it is hereby re- quested to audit the records of the Auditor-Treasurer of- the Town, con- cerning the Town' s finances for one. year, from July 1, 1948 through June 30, 1949, and that the said Town will pay the Commonwealth of Virginia for making said audit; and 'eorge E. Ward, necorder, is authorized and requested to execute a certified copy of this resolution to be mailed to the Auditing Department of the Commonwealth of Virginia. Mr. H. I. Tiffany appeared before Council and complained about bricks falling from the top of the building , now vacant, on the ,1 corner of King and Cornwall streets. Mr. Tiffany stated that the building was an a bad state of repair and was dangerous.. On motion of Francis L. -cotton, seconded by Mrs. Thelma J. Smoot and unani- mously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that Mr: Stilson H. Hall, Town Attroney, be, and he is hereby instructed and directed to draw up an Ordinance, requiring all prop- erty owners to keep their buildings in a safe state of repair. • On motion -of J. L. Oliver; seconded by J. L. McIntosh and unani- mously carried, the Auditor-Treasurer was instructed and directed to rope off the North side of the old brick building on the corner of King and Cornwall streets and place there a danger sign, reading "Danger--calling brick" . On motion of Francis L. Patton, seconded by J. L. Oliver and unanimously carried, the following resolution was adopted: WHEREAS, the following proposed budget was presented to the Council on the 11th day of April, 1949 and the same was published in a news- paper published in the Town of Leesburg, and a Special Meeting of the Council was held on the' 25th day of April, 1949, and no objection was made thereto by any citizen of the Town; ,. A letter from the League of Virginia Municipalities cOncerningnth.e • appointment of a committee from the league to $nvestigate the application of the Chesapeake & Potomac Telephone Company of Virginia for an in- crease in telephone rates was read to council and upon motion of Mrs . Thelma J. Smoot, seconded by J. L. McIntosh and unanimously carried, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that it supportthe league in its opposition to the increase in rates, as ,' petitioned by the Chesapeake & Potomac Telephone Company of Virginia, and that the sum of $25.00 be appropriated for such purpose. On motion of Francis L. Patton, seconded by J. L. McIntosh and unanimously carried, the following resolution was adopted: ' BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that a, sum not to exceed $25.00 be appropriated towards a float to represent Loudoun County at, Culpeper ' s Bi-Centennial Clebration, provided that, the Town Attorney will approve such appropriation. Councilman Francis L. Patton reported to Council that no definitee contact had been established in the matter of bringing Natural Gas to Leesburg. Mr. Patton further reported that connections were being made to the Sanitary Sewer in compliance to Mayor Lowenbach' s letter sent out on January 3, 1949, however, he felt that a second letter should be sent by the Mayor to those who, had made no attempt to connect. At this point Councilman pelma J. Smoot retired from the meeting. Councilman Francis L. Patton read to Council the contract between the Duncan meter Corporation and the Town of Leesburg for the installatim of 100 (more or less) parking peters as corrected by the Town Attorney. On motion of Francis L. Patton, seconded by J. L. Oliver and carried byLa 2 to 1 vote , McIntosh voting against, an Ordinate was enacted pro- viding for the leasing, installation and purchase of parking meters; pro- viding for and regulating the parking on certain streets; authorizing the use of parking meters therefor and providing penalties for the vio- lation thereof. (A copy of this Ordinance may be found in the current Ordinance Book) . Council Patton suggested to Council that the Planning and Zoning Commissions be combined and that the Mayor make necessary appointments to fill vacancies. On motion of Francis L. Patton, seconded by J.L.Oliver and unani- mously carried, it was ordered that a letter_be sent to the Virginia Electric & Power Company, advising them that the pole lot now being used by said company on the property of H.C..Littlejohn located on West Loudoun Street, be ,abated on complaint of residents, that area being zoned residential. On motion of Francis L. Patton, seconded by J. L. McIntosh and unanimously carried, the Street Committee was authorized to get bids on additional, catch basins in the storm water sewer at the intersection of Icing and Market streets. On motion of Francis L. Patton, seconded by J.L.Oliver and unani- mously carried, the Street Committee was instructed to consult with Mr. J.S.Board, State highway Engineer, relative to the enlargement of the culverts on East Market and Fast Fayette Streets. On motion of Francis L. Patton, seconded by J .L.McIntosh and unani- mously carried, it was ordered that letters be sent to the Washington and Old Dominion hallway and Herbert Bryant, Incorporated, requesting a sufficient right-of-way througp their properties for the extension of South Buick Street .
