The Tybee Island City Council held its regularly monthly meeting
on Thursday, July 11, 1991, at the Tybee Island City Hall, with Mayor Charles
J. Hosti presiding. The following members of council were present: James P.
Locklear, Jack Youmans, Bill Walsh, Jimmy Brown, L. Jefferson Dukes and
Paul Jackson. City Attorney Thomas Mahoney, Jr. was present to represent
the city.
The meeting began with a Invocation given by Councilman Locklear,
followed by the Pledge of Allegiance led by Mayor Hosti.
Mayor Hosti called the meeting to order and wished Councilman Dukes
a very happy birthday. The mayor recognized Attorney Hermann Collidge and
Attorney Steven Scheer as being in the audience.
Mayor Hosti opened the meeting on the Public Hearing on subdividing
a duplex owned by Mr. Dale Johnson. Mr. Lee Holloway, a friend of Mr. Johnson,
spoke in behalf of the zoning map amendment. Mr. Holloway said that Mr. Johnson
had built the duplex in compliance with all city codes and requirements.
Councilman Locklear asked if this is a duplex only. Mr. Holloway stated that
yes, but that on the downstairs side of Johnson there is a 220 outlet. On
Mr. Daniels side there is a sink and refrigerator downstairs. Jack Daniel, the
owner of the north side spoke to say that he had a wet bar and refrigerator
in the game room for convenience only. The downstairs are not equipped to
be rented out. Charles McIntosh, the southside property owner, stated that
he has no real objections to the duplex, but feels it is not in the best
interest to rezone creating 2 substandard lots. As there were no one else
present who wished to speak for or against Mayor Hosti closed the hearing.
The first visitor to speak to council was Ms. Debbie Bennett of
Homemaker Services. Ms. Bennett said she is requesting funding in the amount
of $913.56 from the city to help defray the cost of servicing 2 citizens of
the island.
No one was present from the 16th Street Merchants for the request
of closing off 16th street for two days in order to hold a Street Fair on
August 16 and 17, 1991. Marianne Wildi asked who had requested permission.
Mayor Hosti said that Mrs. Wilma McCusker and the owner from Yai Yais came
to see him last week.
Mrs. Kathy Williams of the Tybee Island Beautification Committee
spoke to council of the J. C. Park project. The three phases are 1. walkway,
2. a gazebo, 3. repair and remodeling the bridge. What TIBC is requesting
is the use of the backhoe, the operator, crush in run, and for the city to
order the asphalt so that TIBC can get the discount.

Mayor Hosti explained that he has talked with Mr. Pye concerning this matter.
If the TIBC will wait until sometime in September to have this work started,
the city will ask whoever gets the paving contract to donate some asphalt
for this project.
Dorothy Van Winkle and Bucky Chafin were asked to come forward
and receive certificates of appreciation for the volunteer work that they have
done for the community.
Mayor Hosti then opened the meeting for business legally presented.
Councilman Youmans made a motion to grant the rezoning for subdividing a duplex
by Mr. Dale Johnson. Councilman Jackson seconded. Councilman Youmans stated
that council had received a letter from our attorney concerning this matter
and that we have been through this procedure before in the past. Councilman
Dukes asked under what ordinance does this body have the authority to grant
the request. He then read a memo that was read by the Planning Commission
Chairman at the July 1st meeting. Councilman Dukes said that this council
should pay some attention to the recommendations from the Planning Commission.
Councilman Youmans asked who wrote the memo. Councilman Dukes answered the
members of the Planning Commission. Councilman Youmans stated that the council
has a letter from attorney Thomas Mahoney explaining the citys' position.
Attorney Mahoney said the council has a full, free right under Code Section
8 -3 -9 to grant request. Councilman Jackson called for the question.
Five in favor of granting the subdivision, 1 opposed (Dukes).
Councilman Locklear moved that the city grant the Homemaker Services
request for $913.56. Councilman Brown seconded. The vote by council was
5 in favor, 1 abstained (Youmans).
Mayor Hosti said that the request from the 16th Street merchants
will be postponed until the August meeting.
Councilman Jackson made a motion to reconsider and grant the
variance to Stacye Smith. Councilman Walsh seconded the motion. Councilman
Youmans stated that it had been denied by a quorum at the last council meeting
and could not come back before council for 12 months. Councilman Dukes said
he reinforces what Councilman Youmans is saying and that he can not see
the basis for reconsideration. Mayor Hosti called for the vote. Three in
favor (Jackson, Walsh, Locklear), three opposed (Brown, Youmans, Dukes.
Mayor Hosti broke the tie by voting in favor of granting the variance.
Councilman Dukes announced that a demonstration will be given by
Vivian Maxey on the Booton computer plan on July 25th at 9:30 a.m. and that
council and public is invited to attend. Councilman Dukes said that the
Planning and Development Committee met with members of the Planning Commission

to go over the tree ordinance. The committee asked the Planning Commission to
go back and study the ordinance with the 4 ideas that the work session
came up with.
Councilman Dukes said that all councilmembers have received a
worksheet concerning the mid year budget adjustments and that Mrs. Brown
was trying to set up a work session to go over the budget. Mayor Hosti
asked if Thursday, July 18th at 7:30 P.M. would be alright to have the
work seesion. All council agreed.
Councilman Walsh made a motion to hire 2 policemen, 1 clerk by
adding $17,700.00 to the line item titled salaries, to add $500.00 to
the police training line item, and to change the title of Records Clerk on
the paysteps to Clerk II. Councilman Youmans seconded the motion. Councilman
Dukes asked that council hold up on this decision until after the budget
review is held. Councilman Walsh stated that earlier in the year he had
requested hiring more policemen and was told the same thing. He then
said we have the money according to the audit. Councilman Youmans said the
officers would be paid mostly from the overtime pay that the city would be
saving and that we need the personnel. Councilman Locklear questioned if
these recommendation have come before the finance committee. Councilman
Dukes answered no. The vote by council was 4 in favor; 2 opposed (Locklear,
Dukes).
Mayor Hosti stated that council had approved the hiring of a
dispatcher earlier in the year and that this has not been done yet. Councilman
Youmans said that Officer Billy Pierce will be coming back to work next week
on light duty and will be a dispatcher until he is able to go back on the
street as a policeman.
Councilman Youmans said that the back hoe is being repaired.
Councilman Locklear asked what council was going to do about Earl's Grill.
Councilman Walsh said that this matter did not need to be discussed at this
time.
Councilman Locklear said that Deputy Chief Buckley of the First
Response had gotten some information together for the purchase of a new
unit. If there is enough money after the September budget adjustment we
will try to purchase the unit.
Councilman Brown stated that the parking revenues are a little
ahead of last years figures.
Councilman Jackson said that the water department is still locating
cave ins around the island. Mayor Hosti said that he will give a list of all
lines repaired to date.

Councilman Jackson made a motion to accept the June 13 and
June 28 minutes. Councilman Walsh seconded. The vote by council was
unanimous.

Councilman Locklear made a motion to pay the bills that have been
approved by council. Councilman Jackson seconded. Vote by council was unanimous.
Councilman Dukes said that a letter has come concerning the hospital/
dental insurance from GMA. The hospital amount will remain the same but that
the dental has a 9.9% increase. Councilman Youmans asked if the city pays the
dental. Councilman Dukes said the employees pay their own dental.
Councilman Walsh made a motion to accept Judge Coolidge's letter
of resignation as Recorder for Tybee Island. Councilman Brown seconded. Vote
by council was unanimous. Judge Coolidge thanked the Mayor and Council for the
pleasure of being the judge these past few years.
Councilman Walsh then made a motion to appoint Attorney Steven Scheer
as the Recorder Judge of Tybee Island for the remainder of this year.
Councilman Locklear seconded. Vote by council was unanimous. Judge Scheer
thanked the Mayor and Council for his appointment and was sworn in by City
Attorney Thomas Mahoney. Judge Scheer complimented Chief McCutchen and Mary
Edgerly on the efficiency of the court.
A letter was read requesting permission to hold the 10th class reunion
at North Beach from Ms. Joanne Faulk on July 20th. Councilman Locklear moved
that the request be approved. Councilman Youmans seconded. The vote by council
was unanimous. The next request was from Food Associates on having a get
together in the North Beach area. Councilman Locklear moved for approval, with
Councilman Youmans seconding. All parking fees will be paid up at the time of
entering the parking lot.

Mayor Hosti announced that WAEV 97 Radio and Spankys will have
a beach cleanup on July 21 and he encourages all to participate.
Mayor Hosti appointed James P. Locklear and Jimmy Brown to co -chair
the Sport Complex Committee.
A resolution was then read concerning the upcoming election to be
held in November and superintended by the Board of Elections of Chatham
County. Councilman Jackson so moved to adopt the resolution. Councilman Walsh
seconded. The vote was unanimous.
Councilman Locklear read the ordinance Section 4 -2 -10 Propane Gas
Tanks - identified; inventoried, updated for the second time. Councilman.
Youmans made a motion to adopt the ordinance. Councilman Jackson seconded.
The vote by council was unanimous.
Mayor Hosti announced that a Public Meeting will be held on the
Master Plan on Monday, July 15th at 7 P.M. and invited all to attend.
Jim Kluttz asked the question concerning the subdivision of a
duplex. Will a person still have to come and request the subdivision. Mayor
Hosti answered yes they will have to come and request. Kluttz then asked if
a person could come and request before the duplex is built. Mayor Hosti stated
that the ordinance needs to be refined and redone. Councilman Locklear said
that the Public Meeting would be a perfect time to ask these questions.
Councilman Youmans made a motion to adjourn. Councilman Brown seconded.
Mayor Hosti then closed the meeting.

RESOLUTION
WHEREAS, The City of Tybee Island is scheduled to hold a
municipal election on Tuesday, November 5, 1991, and
WHEREAS, For the last ten years the city has contracted with the
Board of Elections of Chatham County to superintend all
municipal elections held within this city; and
WHEREAS, It is the opinion of the elected officials of the city
that the county elections board has performed these
duties in a superior manner, giving excellent,
impartial service to the citizens of Tybee Island;
NOW THEREFORE BE IT RESOLVED, AND IT IS HEREBY RESOLVED BY THE
MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND IN OPEN MEETING
ASSEMBLED THAT THE BOARD OF ELECTIONS OF CHATHAM COUNTY BE
INVITED TO SUPERINTEND THE CITY'S UPCOMING ELECTION AND THAT THE
BOARD ALSO SUPERVISE THE PREPARATIONS FOR SAID ELECTION TO BE
HELD ON TUESDAY, NOVEMBER 5, 1991.

AN ORDINANCE OF THE CITY OF TYBEE ISLAND CODE OF ORDINANCES,
Title 4, Public Safety, Chapter 2, Fire Prevention and Protection
Section 4 -2 -10.
Be it ordained, and it is hereby ordained by the Mayor and Council in
Open Meeting assembled, that the Tybee Island Code of Ordinances, Title 4,
Chapter 2, be amended by the addition of Section 4 -2 -10 Propane Gas Tanks;
identified; inventoried; updated.
Section 4 -2 -10 Propane Gas Tanks; identified; inventoried; updated.
(1) Each above ground propane gas tank that is owned by a propane gas firm
shall be identified with the name of the firm, and the firm's telephone
number. It shall be the responsibility of the propane gas firm to
inventory each tank that the distributor services; letter each with
the name of the distributor's firm and 24 hour emergency telephone
number; record it; and provide the City Marshal with the original copy
of the inventory. The initial propane gas list shall be provided to
the City Marshal no later than 9 September 1991, with updates as they
occur. Distributors shall include the location of underground propane
gas tanks on their lists, but do not have to mark the tanks.
(2) Each propane gas tank serviced by a distributor but owned by the
resident shall be so identified on the distributor's inventory. The
distributors nor the owners need letter theses propane gas tanks,
unless the owners and distributors so agree.

Notes from Tybee Island Public Hearing - July 15, 1991
Public Input:
*Code enforcement issues, code development, and zoning enforcement
(espec. residential).
*Enforce the sign ordinance
*Private property rights ( "too many ordinances ").
*Tree ordinance needed
* "Sense of community" needs to be kept at forefront
(public -vs- private interests)
*Public recreation assets need to be looked at for development
potential and use (ie: the North Beach).
*Bury the utility cables
*Examine the existing sign ordinance and its "quality"
( "Large, illuminated signs take away from the natural beauty.
Don't want to see as drastic as Hilton Head's ordinance, but we
need a protective ordinance. ")
*Historical aspects of the Island must be kept in mind
(identification, preservation, protection)
*Historically sensitive zoning is necessary (ie: Neighborhood #7 is
significant historically and this .;should be reflected in the
zoning).
*Checks on over -dense development in areas need to be in place
(espec. in certain neighborhoods where a developer can buy a few
lots and build a new building which is not consistent with those
buildings already present in the neighborhood).
*Give value to low- density of areas (That is, protect this
characteristic through zoning and other means.)
*There are problems with "residential /tourist" zoning of certain
areas.
*Move the easement from 20/ to 10' because such a large setback
greatly impacts the use of lots by residents.
*Call for compatibility with the Fort Pulaski Plan (also, compare
with other plans).
*Beach renourishment (fed and state money will eventually stop,
what then ?) Future renourishment and optional techniques need to
be looked at.
*Sources of revenue for the city need to be explored (residents are
paying for the services being given to visitors)
*Speed bumps needed in residential areas ( "police could pay for
themselves in some areas ").
*School system (attempt to regain the system, espec. while the
building has not yet been committed for a permanent "other" use).
Check county school boards needs and changes in state support for
facilities which are "small ".
*Paint yellow lines at intersections of avenues and streets so stop
signs will be better noticed and accidents avoided.
*Litter control on public streets (resident pedestrians should help
with pick -up).
*Home -made trashcan holders should be gotten rid of, these are
ugly.
*Population profiles of the island are problematic. Several
factors impact - year -round residents, snow - birds, seasonal people,
and visitors.
*Give authority to planning commission for implementation? "The
law is such that the planning commission is working for the City
Council."
*Demolish old school building(s) if they are not to be used. Make
public space of these lots. "The island needs more recreational
facilities ".
*Memorial and Jaycee Parks are important assets
*City auditorium & /or an ampitheatre are needed. (There is no good
place on the island to perform.)
* "No new property taxes to pay for these wonderful ideas"
*Can the city raise taxes?
*Again, respect for private property rights (espec. concerning
trees).
*Bring the bike trail onto the island from Pulaski.
*Identification of cottage- industry possibilities
*Establish an arts commission
*Maintenance of property problems (community eye- sores, need to
enforce the laws)
*Curb -side recycling necessary
Need recycling plan, publicize new center, educate public.
* "Return for deposit" containers necessary & /or mandate "no sale of
destructive materials ".
*Commercial recycling a possibility
*Trash contract coming up, task force exists now, consult with the
force in planning, they have also looked into yard clipping use.
*Paint the city trucks, bad public relations
*Home delivery of mail
*Clean business streets
* "Fine for Littering" signs
*Enforce "No Dogs on the Beach" laws
*Problem with litter on the beach
*Water and sewer limits of the island
*Revenue enhancement of the city
*Problem with water safety on the back river
