PRESENT: Council President Rob Geray, Council Member Peter Wadsworth, Council Member Michael Thompson, Council Member Kathy McNamara, City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: Mayor Dan Gubler. VISITORS: Clark Morsbach, Evan Mann, Steven Ellsworth, Josh Williams, Doug Elliott, Sherrie Elliott, Mary French, Gary French, Luis Olivas, Brian Smaka, Maurice Theriault and Chris Williams. Council President Geray welcomed everyone and Director Prouse led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Regular Meeting Minutes of October 19, 2021 were reviewed. Council reviewed the finance reports for the period ending October 31, 2021 (8% of the fiscal year elapsed). The City had $2,130,908.68 in the bank and routine bills had been paid, "Exhibit A". Council President Geray entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: General Water System Discussion — Council President Geray stated the tank project is continuing despite some technical issues pertaining to leakage in the tank and availability of supplies. However, these problems are being addressed and the project is getting closer to completion. Legal Services Proposal; Fiscal Year 2021-2022 — Council President Geray stated this is the renewal of the legal services proposal for the new fiscal year. Attorney Rawlings confirmed the rates stayed the same as the previous fiscal year. No questions or discussion mentioned. Council President entertained a motion. Council Member Thompson made a motion to approve the Legal Services Proposal for Fiscal Year 2021-2022 with rates as specified in the presented proposal. Council Member McNamara seconded the motion. Council President Geray, Council Members Thompson and McNamara voted in favor. Council Member Wadsworth abstained. Motion carried. Public Hearing — Variance Application; Ellsworth & Associates, PLLC; Harvest Cove; a Variance relating to the length of the road allowed for permanent dead-end streets as stated in § 10-1-17(B)(4) of the Iona City Code—Council President Geray explained the Public Hearing procedure. Clerk West confirmed there has been no written correspondence received from the public pertaining to this application. IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 Steve Ellsworth of Ellsworth & Associates of 253 E. 1st Street approached the podium and stated they are requesting a Variance due to the road that is stubbed into the west boundary of this property is already 177 feet long. He continued and stated that would only allow them to have a road approximately 230 feet into their property that is over 600 feet in depth. Mr. Ellsworth continued and stated they have already increased the radius of the cul-de-sac to aid the safety features of the neighborhood. He continued and stated without the Variance, there are not a lot of options for development to keep the neighborhood uniform with the adjoining properties. Mr. Ellsworth then stated there is no accessibility for a through street. Council Member Wadsworth stated there is a piece of this property that is currently unplatted and connects this development to Iona Road. Discussion began regarding options for a secondary access road through the proposed development. Mr. Ellsworth stated if they used the 100' wide strip of land off Iona Road as a road to connect to this development, the houses on the east side of Elim Lane would all have double sided streets. Council Member Thompson confirmed. Council President Geray asked if anyone from the public was in favor of this application. No response. He then asked if anyone from the public was opposed to this application. No response. Council President Geray closed the Public Hearing portion of this agenda item to allow for deliberation amongst the Council, City Attorney and Public Works Director. Attorney Rawlings stated the Variance being requested specifically addresses the depth of the road being longer than 400'. However, in the City Code 10-1-17(B)(4) it states: "All dead-end streets shall be cul-de-sacs, provided at the closed end with a turn-around having a street property line diameter of at least 90 feet, and that are: (a) Permanently not longer than 400 feet; (b) A temporary dead-end street with a distance of greater than 400 feet in length, provided the Developer files or has already filed a Preliminary Plat of an adjoining Development depicting a through Street connecting to such temporary dead-end street that is not a dead-end street, and provided further the Council may order the Developer to file a Final Plat for such Preliminary Plat, at any time at the expiration of three years after the date the Plat showing the temporary dead- end street was approved; or (c) Designed and constructed pursuant to a detailed plan approved in advance by the City Council, in order to protect public safety, which plan may include (but is not limited to) requiring the street to be wider than normal, including the installation of additional fire hydrants, and/or providing additional signage." Attorney Rawlings stated that with these options, a Variance may not be necessary strictly for the depth of the dead-end road. He continued and stated with the above mentioned options, the Council can allow the dead-end street to be longer than 400' if the other public safety recommendations are met. Attorney Rawlings then stated the more concerning issue is the 100' wide section of the property left unplatted and unannexed with this development. He then stated the City can require this section to be included with the development as it will be surrounded on all sides by City of Iona properties. He then read Iona City Code 10-1-4(A): 2 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 "Platting Required. No person shall Subdivide or Re-Subdivide any piece, parcel or tract of land situated within the City or within one mile outside the City limits or Re-Subdivide, sell, lease, or convey any Development or portion thereof, within said area, without first recording a Final Plat approved by the City in conformity with the requirements of this Iona Subdivision Ordinance..." Attorney Rawlings continued and stated this development is considered a subdivision with nine platted lots and one unplatted lot. He stated by the above mentioned Code section, this lot would also need to be platted and annexed. He did read the exclusions to this section of the Iona City Code 10-1-4(B): "Exclusions. Notwithstanding Subsection 10-1-4(A), above, no Final Plat must be recorded in the following circumstances: (1) A bona fide Sale, division, or partition of land intended strictly for use thereafter as Agricultural Land. The intent to construct, as evidenced by a request for a building permit, a residence, apartment, commercial, or industrial Building or other nonagricultural Building or Buildings upon such tract of land shall be deemed sufficient evidence that the land described in the application for a building permit is no longer agricultural and shall immediately subject such land to the requirements of this Iona Subdivision Ordinance." Attorney Rawlings explained the developer would not qualify for this exemption due to the R-1 Zoning of the nine lots in this development. He then read Iona City Code 10-1-16(C): "No Plat shall be approved where the area between the property line of any unplatted property owned by the Owner and any other property owned by another, is of sufficient size or is of an irregular configuration such that the area cannot reasonably be used to develop lots that will conform to the provisions of this Iona Subdivision Ordinance and the Zoning Ordinance of the City of Iona." Attorney Rawlings explained this section presents some issues for the Council to approve the development as presented with the "flagpole" section of the development left unplatted. Council Member Wadsworth asked for clarification if the "flagpole" section of the land needs to be included in this plat for it to be considered by Council. Attorney Rawlings confirmed that is how he reads the above City Code sections. However, he stated there could be an argument from another perspective. Attorney Rawlings continued and stated this is all one parcel that is essentially being split into ten parcels, but only nine of them are being platted and annexed into the City. He stated he does not think this is allowed by the way the Code is written. Council Member Wadsworth suggested one option would be to include the 100' section in one of the nine lots. Director Prouse added this development has the potential of land locking properties and could affect future development to the east. He continued and stated this is more of a platting issue and stated the Variance may not be required as submitted, as stated by Attorney Rawlings. Council President Geray clarified they are separate Public Hearings, but they are related, so it is acceptable to be discussing them together in that context. 3 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 Council President Geray asked the Council if anyone had any comments or questions to add. Council Member Thompson stated he does not like the way the plat excludes the 100' wide strip off Iona Road. Council Member Wadsworth agreed. He also stated he understands that the east portion of Miles Drive is not technically that deep, but when connecting to Elim Lane, it is much deeper than 400'. He continued and stated if there was another exit to the east, this would not be an issue. Council Member Wadsworth stated for emergency services, their only entrance and exit is Elim Lane off Iona Road, and that is a long distance to the back lots on the east side of Miles Drive. Director Prouse stated there may be potential for alley way access for emergency services. Attorney Rawlings encouraged the Council to consider Iona City Code 10-1-12, which pertains to Variances for the Iona Subdivision Ordinance, rather than the Variances for Zoning. He continued and stated this section includes seven conditions that must be met to approve a Variance of the Iona Subdivision Ordinance. Council President Geray asked Attorney Rawlings if he believes this application meets these conditions. Attorney Rawlings stated this is up to the Council to decide, but he would direct the Council to 10-1-12(B): "Strict compliance with this Iona Subdivision Ordinance would result in extraordinary hardship, as distinguished from mere inconvenience, to the Developer because of the particular physical surroundings, shape, or unusual topography of the Developer's property, and will substantially preclude development of the property." Attorney Rawlings reiterated a Variance may not be necessary for the depth of the dead-end road. Council President Geray agreed. He then stated he also does not like the idea of leaving the 100' strip of land off Iona Road unplatted and not being used consistently with the land surrounding it. Council President Geray stated as far as the Variance is concerned, he agrees with Attorney Rawlings that a Variance is not necessary if the developer can meet the other conditions provided per City Code. Mr. Ellsworth asked if he could approach the Council. Council President Geray agreed. Mr. Ellsworth stated Miles Drive is being platted as a 70' right of way, not a standard 60' to accommodate for safety. He also stated the cul-de-sac is wider than standard, with a 120' diameter, to also accommodate for safety. Mr. Ellsworth addressed the concern of the 100' strip of land and stated he does not see any other option than to add it to one of the nine lots. He also mentioned splitting it in half and asked if they would be granted access to a tenth lot off Iona Road. Council President Geray stated he would defer to the City Engineer and Director Prouse for that decision. Director Prouse stated the City could make that accommodation, but that is not what is being considered tonight. He continued and stated his concern would be having two egresses so close together off Iona Road. Discussion continued regarding options for a secondary access for emergencies and future development. Mr. Ellsworth asked if it is their responsibility as the developer to accommodate for future growth. Council Member Wadsworth stated it is the responsibility of the City. Council President Geray noted the City required other developers to accommodate for access to their property being discussed tonight. Mr. Ellsworth then asked if they included the 100' wide strip into the plat and annexation, would they be able to keep it as agricultural use. Council agreed that could be considered. 4 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 Council President Geray entertained a motion. Council Member Wadsworth made a motion to deny the Variance for Harvest Cove Subdivision. Council Member McNamara seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council Member Thompson: YES Council Member McNamara: YES Council President Geray: YES Public Hearing — Preliminary Plat Application; Ellsworth & Associates; PLLC; Harvest Cove, a Subdivision located on the North side of Iona Road to the East of Elim Estates Subdivision —Council President Geray stated they have already discussed this plat in detail with the Variance discussion. Josh Williams of 7243 E. Iona Road approached the podium and asked if the Council is still able to discuss and consider the Preliminary Plat if the Variance was denied. Attorney Rawlings stated the Variance was denied because it was deemed not necessary. He continued and stated there are other options in the Code that allow for the depth of the dead-end road to exceed 400' if other safety features are met. Attorney Rawlings confirmed the Preliminary Plat can still be discussed and is not contingent upon the Variance being approved. Council President Geray asked Mr. Ellsworth if they had anything else to present for the Preliminary Plat discussion. Mr. Ellsworth stated he already presented it with the Variance discussion, but is available to answer any additional questions. Council President Geray stated this is a Public Hearing for the Preliminary Plat application for Harvest Cove. He then asked if anyone from the public would like to stand in support of this application. No response. He then asked if anyone from the public is neutral. No response. Council President Geray then asked if anyone from the public is opposed to this application. Doug Elliott of 4875 E. Hansen Avenue approached the podium and stated he is not opposed to the development. However, he is concerned because his power and water lines go through the 100' wide strip of land that was discussed earlier. Mr. Williams stated there is an easement there, which is part of the reason he left it unplatted with this development. He also stated he would like to continue using this portion of his land as a pasture. Director Prouse addressed Mr. Elliott's concern and stated in the future there may be potential to re-route his water line and connect it to a line on the other side of his property. Director Prouse stated there are some options to address the water and sewer lines in the future, or with the development of this subdivision. Council President Geray requested feedback from the City Engineer, Brian Smaka. Mr. Smaka stated he is concerned with the City creating more dead-end properties. He continued and asked Attorney Rawlings if the previous subdivision, Elim Estates, could be adjusted to have a looped road using the 100' wide strip of land, rather than a "T" shaped road with a cul-de-sac. Attorney Rawlings stated that would require the two developers to work together. Council Member Wadsworth wouldn't recommend having two roads coming off Iona Road. Council Member Thompson stated he likes the idea of the two developers working together to create a more cohesive subdivision. Discussion then continued regarding other options for secondary access, including a stub to the southeast of the development on Hansen Avenue. 5 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 Attorney Rawlings reiterated the plat requirement for the Council to consider regarding the 100' wide section of land that is currently showing as unplatted on this Preliminary Plat. Clerk West then asked if Mr. Williams would like to continue using that section of land as agricultural is he able to include it in the plat and annexation, but zone it as Agricultural (A-1). Attorney Rawlings confirmed he could include it in the plat and zone it as R-1 with the rest of the development, but he could continue using it as a non-conforming agricultural use since it has already been used as such. Council Member Wadsworth stated if the City is going to annex in the rest of the development, that portion of land needs to be included. Attorney Rawlings agreed and stated the Council can either deny or conditionally approve the Preliminary Plat and state the concerns for the developer to address in the Final Plat. Council President Geray entertained a motion. Council Member Wadsworth made a motion to approve the Preliminary Plat for Harvest Cove with conditions to include a separate access point coming out and to include the "flag" portion of the property in the plat. Council Member Thompson seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council Member Thompson: YES Council Member McNamara: YES Council President Geray: YES Discussion of City Sign Ordinances —Council President Geray stated Mayor Gubler's concern regarding signs mainly pertained to small business and temporary signs posted around the City. He continued and stated this proposed ordinance seems a bit excessive and asked for additional perspective from the City Attorney. Attorney Rawlings stated this is a discussion item and is not an action item on tonight's agenda. Discussion began regarding the depth of the proposed ordinance and all Council agreed it was a bit excessive to have so many regulations for signs. Attorney Rawlings described the difference between content based and content neutral regulations. He continued and stated the City can regulate these by zones and even require sign permits if they feel that is necessary. Council President Geray stated with the libertarian nature of the City, he feels it only necessary to regulate signs in the public rights-of-way for safety. Discussion continued regarding regulating signs on private property vs City property and what is appropriate. Council President Geray also explained the difference between City land and City easements that are maintained by neighboring land owners. Council Member Wadsworth stated he agrees and does not feel it is appropriate to regulate signs allowed on a landowner's private property. Clerk West stated the Planning & Zoning Commission (P&Z) also agreed with this ordinance being too strict and there are other sections of the Code that restrict signs and other obstructions in the line of sight from the roadways. Attorney Rawlings stated he will re-write the ordinance and asked for specific feedback from the Council on what regulations they do want to see included. After some discussion, the Council agreed to not allow any signs on City property that are not issued by the City. Council President Geray suggested adding the updated ordinance to the next Work Meeting for further discussion when Mayor Gubler is present. Clerk West agreed. Approval of Official Election Results for 2021 City Election; Precincts #41 and #42 — Council President Geray stated the City must approve the Official Election Results for the election. Council reviewed the results and no questions or concerns were mentioned. 6 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 16, 2021 Council President Geray entertained a motion. Council Member Wadsworth made a motion to approve the 2021 election results for the Council seats in the City of Iona. Council Member Thompson seconded the motion. All in favor. Motion carried. Discussion and Approval of Double Vault Toilets in Iona City Park—Director Prouse stated the Council needs to consider either extensive rehab of the existing toilets in the City Park or installing all new structures. He continued and stated the grandstands in the City Park are also in need of a major overhaul. He suggested getting rid of them all together and replacing them with aluminum bleachers because the current structure is weathered and comprised. Director Prouse suggested talking about that more in detail at a future Work Meeting. Director Prouse stated the double vault toilets would cost approximately $45,000 and would include a toilet on both sides. He also stated the current bathroom structure gets vandalized every year and he believes this option would reduce that risk. Director Prouse also stated the current bathrooms are connected to a septic tank, so there will be additional cost associated with abandoning that tank. Discussion started regarding other projects around the City Building and park that need to be completed with the funds available in the Capital Improvements budget. STAFF REPORTS: Director Prouse stated nothing additional to report. Deputy Williams stated calls for service were slightly higher this month than this time last year. Council Member McNamara thanked Deputy Williams for his continued work for the City. Clerk West stated the City was awarded a grant by the CHC Foundation in the amount of $50,000 for the tennis court rehab project. She continued and stated the total estimated cost of the project is $176,000. Clerk West stated she is researching and will be applying for additional grants to be able to complete the project as designed. She continued and stated the design is to gut the entire existing structure and have 4 pickle ball courts and 1 tennis court with all new lighting and surfacing. Clerk West also suggested trying to secure sponsorships from banks and businesses with the ability for them to have a sign on the fence acknowledging their donation. Council President Geray suggested discussing that option with Mayor Gubler. Clerk West also reported the City Christmas Dinner has been scheduled for Wednesday, December 15th at 6:30pm at the Holiday Inn& Suites in Idaho Falls. Attorney Rawlings stated nothing to report. Council Members Wadsworth & McNamara stated nothing to report. Council Member Thompson stated Director Prouse is waiting to hear back from Direct Communications regarding the fiber, but that is still moving forward. He estimates that will be back on the agenda as a discussion in January. Council President Geray stated he received good feedback on the Veterans Day program this year by combining it with Iona Elementary School. He thanked the City staff for their work on it and suggested continuing that format in the future. Clerk West stated they distributed 56 gifts to veterans. Council President Geray suggested the City reaches out to Thunder Ridge High School to also share the City list of veterans.
