HomeMy Public PortalAbout1951_03_12 TT • REGULAR MARCH 12, 1951. • At a regular meeting of the Mayor and Coucil of the Town of Leesburg held in the Council Chamber on Monday March,' 12, 1951, at 7:30 o'clock P. M. there were present, Maurice R. Lowenbach Jr; Mayor, Horace M. Hallett, Recorder, C. W. Fiske, E. H. James, J. L. OLiver, Francis L. Patton, Frank Raflo,. and Thelma J. Smoot, Councilmen. • The minutes of the previous meeting were read, and upon motion of C. W. Fiske seconded, by J. L. Oliver, and unaminously carried were approved as read. The Auditor-Treasurer read his monthly statement for the month of February 1951, and presented the 'current bills arid upon motion of E. H. James, Seconded C. W. Fiske, and unaminously carried the following resolution was adopted: ' BE IT RESOLVED, by the 'Council of the Town of Leesburg in Virginia, that the Auditor-Treasurer, be and he is hereby authorized and directed to pay the follow- ing bills: • The American City - 4.00 S. Oliver, seconded by C. W. Fiske, and unaminously carried ''the following resolution was adopted: WHEREAS, pursuant to Section 15-826 of the 1950 Code of Virginia , and the Council of the Town of Leesburg, in Virginia has adopted a Zoning ordinance • for the establisYunent of zoning districts within the said Town, and_the Council / of said Town has heretofore requested the Circuit Court of Loudoun County, Virginia to appoint a Board of Zoning Appeals for said Town; and, - WHEREAS,in compliance with the said' ordinance the said Court, by and order entered in the Clerk's Office of said .Court in Common Law Book No. at page did appoint W. 0. Bailey, T. M. Fendall, John W. Clemens, Roy Flippo, and • E. S. Dailey, as the Board of Zoning Appeals for said Town; and , WHEREAS, the said Thomas Ti. Fendall has died, thereby creating a vacancy on the said Board of Zoning Appeals for said Town; and, WHEREAS, the Council of the said Town desires-that this vacancy shall be filled but also desires that W. 0. Bailey, John W. Clemens, Roy Flippo, and E. S. Dailey shall continued as members of the said Board of Zoning Appeals; and , WHEREAS, the Council of the Said Town recommends the appointment of William . F. Peach, who, togeather with the said W. 0. Bailey, John.W. Clemens, Roy Flippo, and E. S. Dailey, shall be empowered with all the authority and charged with the same duties required as provided under Section 15-826of the Code of Virginia, and all acts amendatory thereof, whose terms of office shall expire three years from the_date of the passage of this ordinance, and which Board of Zoning Appeals shall be empowered with all the authority provided under the laws of Virginia relating to the Board of Zoning Appeals for Towns in this State; and, WHEREAS, the said Council is advised that in order to fill the vacancies on its Board of Zoning Appeals it is necessaryto institute proceedings in said Court for the purpose of requesting the appointmentof said new members; and , 28 WHEREAS THE Council of Said Town' has requested Stilson H, Hall, Town Attorney to present this ordinance to the Court for the appointment of members of the Board of Zoning Appeals of said Town. ' NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Leesburg in Virginia ' as follows! - ' • (1) That Stilson H. Hall, Attorney, be and he is hereby authorized, instruct- - ed and directed to instiute and prosecute all necessary and proper proceedings for the purpose of the appointment of W. 0. Bailey, John W. Clemens, Roy Flippo, E. S. Dailey, and William F. Peach as the Board of Zoning Appeals for the Town of Lees- burg, in Virginia, for a term of three years begining with the date of the pass- 111age of -this ordinance. , (2) That the aforesaid W. 0. Bailey,_ Jon W. Clemens, Roy Flippo, E. S. Dailey and William F, Peach shall constitute the Board of Zoning Appeals for the said Town and the said Board shall be empowered with all the authority and shall be subject to all restrictions provided under the laws of the Commonwealth of Virginia for Boards of Zoning Appeals for Towns in the Commonwealth of Virginia. (3)' That 'the Auditor-;Treasurer be and he 'is hereby authorized and directed to advance and pay the' necessary and required 'costs for the purpose of institut- ing and 'prosecuting 'these proceedings 'in the' Circuit Court of Loudoun County, in Virginia. • • • ' ' ' • ' • • ' ' (4)' That 'the Recorder of 'said Town be' and he is hereby authorized, instuct- ed and directed td Send 'or deliver two certified copies of this ordinance to Stilson 'H, Hall; Torn 'Attorney. ' ' ' ' ' ' ' Mayor Lowenbach, read a letter 'from the Leesburg Laundry Inc; in which they ' requested a reduction 'in the water rents, 'due 'to the great amount they are now using and that they planned 'to increase this usage largely in the very near fut- ' ure. This matter was tabled 'until 'a later 'date. ' • . The matter 'of painting 'the 'roof on -the 'Fire House .and the Public Toilets and the repair to the 'toilets was 'turned was refered to the Building Committee to make such repairs and painting 'the 'saw necessary 'to have done. Mr: Stilson H. 'Hall and Nr: Lucas D. 'Phillips offered to purchase the bricks ' and- all 'other 'material necessary to 'lay 'a 'brick side walk in front of there build- ing if the Town would furnish the labor for said work. Fiske, Mr. James, and Mr. Raflo aganist and thyor Lowenbach breaking the tie by voting for the follow- ing resolution was adopted: • BE IT RESOLVED By the Council of the .Town .of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to have .a brick side walk constructed in fron of the -Nall, Phillips building anaforesaid-agreeded -:Upon motion duly secohded,and unanimously carried, the Audata:,er was authorized and directed to.request the Commonwealth of Virginia to audit the i, account of the Town of Leesburg, in Virginia, after June 30, 1951. • Upon motion-of Thelma J. Smoot, seconded by J. L. Oliver and unanimously J carried the following resolution was adopted: BE IT RESOLVED, -by the Council of the Town of Leesburg in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to have the deed regarding the Airport property of Arthur Godfrey recorded in the Clerk of the • Court office, and that a copy 'of the signed agreement entered.into between the t Torn of Leesburg and Arthur Godfrey be delivered to M'i•. Godfrey. I BE IT FURThr"R. RESOLVED, by the Council of the Torn of Leesburg in Virginia, ' that the Mayor be and he is hereby•authorized and directed to'signzsuch appli- • cation as necessary to apply for State and Federal Aid. ��- Upon motion of C. W. Fiske seconded by Frank Raflo and unanimously carried the following resolution was adopted: • BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia, that the United States Post Office Department; ,Division_of Railway Service, Washington, D. C. be and they are hereby requested to continue the use of 'the Washington & 29 Old Dominion Railroad for the mail service between `Rosslyt},Virginia and Leesburg, Virginia. • • • • . . . . . • • . - Upon motion of- E. H. James, seconded by C. W. Fiske and carried by a vote of (5 to 0), Patton not voting, the following resolution wad adopted: BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia that the Virginia Highway Department be and they are hereby authorized and requested to in- stall a traffic signal light at the intersection of King and Loudoun Streets.' At a regular meeting of the Mayor and Council of the Town of Leesburg held in the Council Chamber on Monday April, 9, 1951, at 7:30 oclock P. M. there were present . Maurice R. Lowenbach Jr; Mayor, Horace M. Hallett, Recorder, C. W. Fiske, EH James, J: L. Oliver, Francis L. Patton, Frank Ratio, and Thelma J. Soomt, Councilmen. The minutes of the previous meeting were read and upon motion of C. W. Fiske, -seconded by E. H. James, and unaminously carried were approved as read. The Auditor-Treasurer read his monthly statement for the month of March, 1951, • and his quartly report for the months of •Janurary, •February, and March, 1951, and upon motion of Frank Raflo, seconded by J. L. Oliver, and unaminously carried the following resolution was adopted: WHEREAS, the Auditor-Treasurer has presented to the Town Council of the Town • ' of Leesburg, in Virginia, a quartly statemnet of all receipts and analysis of all I disbursements for the months of Janurary, February, and March, 1951, . t NOW, THEREFORE, BE IT RESOLVED, by the Council of the ToWn-of Leesburg, in Virginia that the said quartly statement of the Auditor-Treasurer, be and it is hereby accepted by said Council, BE IT FURTHER RESOLVED, by the -Council of the -Town of Leesburg, in Virginia, that the Auditor-Treasurer, be and he is hereby authorized and directed to have a copy of said statement published in a said newspaper in said town and also poet a copy in front of Court House in the said town. The Auditor-Treasurer presented the current bills for the month of Piarch, 1951 and upon motion of C. W. Fiske, seconded by J. L. Oliver, and unaminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to pay the following bills: Arlington Stone Company $ 61.18 Commonwealth of Virginia Audit 154.27 General Electric Company 3.50 T.
