ORDINANCE NO.~
AN ORDINANCE PROVIDING FOR THE REQUIREMENTS FOR CULVERTS;
PROVIDING FOR ALTERNATE AND ADDITIONAL MEANS OF CONSTRUCTION
OF CULVERTS BY THE CITY AS PROVIDED BY STATUTES; PROVIDING
FOR PAYMENT AND DELIVERY OF CULVERTS BY THE PROPERTY OWNER
AND PROVIDING FOR THE INSTALLATION OF SAID CULVERTS AND
REQUIREMENTS THEREOF.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:
Section 1. All driveway culverts except on County maintained roads within
the City of Bel Aire installed or replaced after May 1, 1984 shall be reinforced
concrete or corrugated metal and shall be of a size to allow the free flow of
drainage. The City Engineeer shall determine the size and type of any culvert but
in no event shall any culvert be less than fifteen (15) inches in diameter and
all culverts must be new.
Section 2. No person shall build, alter or otherwise change any drainage
located within the public right-of-way without the approval of the City Enginee<.
Section 3. As an alternative to and in addition to any provisions provided in
the Statutes of the State of Kansas for the construction, alteration or reconstruction
of culverts in the City, the City may install a culvert at the request of a property
owner under the following conditions:
1. The property owner shall have purchased the required sized culvert and
shall be responsible for having it delivered to the point of installation.
2. The property owner shall be responsible for and have removed all hard
surface material from above the existing culvert from the owner's property line
to the edge of the existing road.
3. The property owner shall be responsible for the removal of all decorative
p1antings, curbings, and retaining structures that may be damaged during the removal
or installation of the driveway culvert and shall hold the City harmless from any
damage done to the same.
4. The property owner shall be responsible to remove all construction material
removed from the installation or removal process within 48 hours.
5. The City will remove culverts only for owners who have gravel drive approaches,
provided all provisions of these regulations are adhered to.
6. The City will install new culverts provided by the property owners, provided
the installation of the culvert replaces an existing culvert and that all provisions of
the requirements are adhered to.
7. The City will place gravel over the top of any culvert the City installs
upon the request of the owner and the owner will pay the cost of the gravel.
8. Any costs incurred by the City for the installation or removal of culverts
as set forth herein shall be paid by the owner to the City promptly upon billing. The
City may require all or part of the cost be paid in advance.
Section 4. This Ordinance shall take effect and be in force from and after its
publication in the official city paper.
