HomeMy Public PortalAbout1953_11_09 98 • REGULAR NOVEMBER, 9, 1953 At a regular meeting of the Mayor and Council of the Town of Leebburg , in Virginia, held in the Council Chamber, Monday November, 9, 1953, at 7 :30 o' clock P. M. , there were present William W. Nickels, Mayor; Horace M. Hallett, Recorder, Reginal K. Gheen, Howard B. Gill, Emmerson H. James, Maurice R. Lowenbach, Jr; Frank Raflo, and Morton Riddle, 3rd ; Councilmen. The minutes the last regular and special meeting were read and upon motion of Maurice R. Lowenbach Jr; seconded by Emmerson H. James and unaminously carried were approved as read.. The Auditor-Treasurer read his monthly statement for the month of October, 1953, and presented his ' current bills and upon motion of Emmerson H. James, seconded by Howard B. Gill the following resoluti- ion was adopted : • BE IT RESOLVED`;' by the Council/Of the Town of Leesburg, in Vir- ginia, that the Auditor-Treasurer be and he is hereby authorized, and directed to pay the following- bills: Virginia Electric & Power Company $ 293.89 Chesapeake & Potomac Telphone Company. . . 3.15 L. This matter was refer- ed to the Street Lighting Committe. Upon motion Maurice R. Lowenbach, Jr; seconded by Frank Raflo, and unaminously carried the following resolution was adopted: WHEREAS, the Council of the Town of Leeth urg, in Virginia, has - entered into an option agreement to purchase certain property on Loudoun Street, commonly know as The Diggs Property, for the sum of $12, 500.00, and now desires to exercise its rights under said option agreement, BE IT RESLOVED, by the Council of the Town of Leesburg, in Virginia, that the said Diggs Property be purchased accordthng to the terms of the aforesaid option , which is of record in minutes of the Council meetings, BE IT FURTHER RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the recent survey oflsaid property by Richard U. Goode, Certified Surveyor, for the TotCn }of Leesburg, in Virginia, be- - and the same hereby accepted, and the employment of said surveyor for the aforesaid purpose be and the same is hereby ratified and approved. BE IT RBRTHER RESOLfby the Council of the Town of Leesburg, in Virginia, that Stilson H. Hall, Attorney for the Town of Leesburg, in Virginia, be and he is hereby employed, authorized and directed • to draw up necessary papers for purchase of said property the 99 Town of Leesburg, Virginia, BE IT FURTHER RESOLVED, by the Council of the Town of Leesburg, in Virginia, that George E. Ward, Auditor-Treasurer, be and he is hereby authorized and directed to a draffon said Town for 02,000. 00, payable to the order of Stilson H. Hall, Attorney, for distri- bution among the sellers, as a part of the purchase price, and del- iver the same to Stilson H. Hall, Attorney, to be held in escrow until the general warranty deed to said property is executed and delivered to the Town of Leesburg, in Virginia, BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that -the •sum •of $15,000.00 be borrowed with the Town Hall Building property as security ; that William W. Nickels, as ' Mayor, be and he •hereby authorized and directed to excute and de- liver in th eTown' s -name and in its behalf a note or series of notes in the aggregate amount of $15,000.00, under seal with intrest not in excess of 5% per annum, and a deed of trust convey@ng the Town Hall Building -property securing said loan to a Trustee, or Trustees; of theLoanor' s •choosing; that Horace M. Hallett, Record- er, be and he is hereby authorized and directed to attest and a- ffix the -seal of •the Town of Leesburg, In Virginia, to said in- truments ; that -the -balance of $10,500.00 due on the purchase of the Diggs property be disposed of in the same manner as set forth in the immediately foregoing resolution; and that the balance re- maining on hand be deposited with the general funds of the Town. Upon motion •of Maurice R. Lowenbach Jr; seconded by Morton Riddle, and unaminously carried the following resolution was ad- opted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby author- ized a,�d • di emoted to pay -to each member of the Leesburg Fire Comp- any:thaus m di $20.00. Upon motion -of Maurice R. Lowenbach Jr; seconded by Emmer- son H. James, and carried by a vote of 5 to 0 Gill not voting, ' the following resolution was adopted-: BE IT RESOLVED, -by the Council of the Town of Leesburg, in ( Virginia; that -the Auditor-Treasurer be and he is hereby author- ized and directed to write -off any town taxes /against the proper- ty of the Leesburg Fire Company. Upon motion -of Frank Raflo, seconded by Emmerson H. James, and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be andhe is hereby authoriz- ed -and directed to have a curb and gutter constructed in front of the Payne property on the east side of King Street. Mr. Riddle gave a report on the possibilites of selling the Town Hall property. Mayor Nickeld stated that the Police Committee and the Pol- ice Department would try and meetin the very near future and make necessary recomendation to the Council regarding the changing of certain traffic ordinances now on the Town- Ordinance Book.
