Ward, Auditor-Treasurer, be and he is hereby authorized and directed to a draft-on said Town for 02,000. 00, payable to the order of Stilson H. Hall, Attorney, for distri- bution among the sellers, as a part of the purchase price, and del- iver the same to Stilson H. Hall, Attorney, to be held in escrow until the general warranty deed to said property is executed and delivered to the Town of Leesburg, in Virginia, BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that •the •sum of 015,000.00 be borrowed with the Town Hall Building property as security ; that William W. Nickels, as ' Mayor, be and he hereby authorized and directed to excute and de- liver in -theTown' s -name and in its behalf a note or series of notes in the aggregate -amount of 015,000.00, under seal with intrest not in excess of 5% per annum, and a deed of trust convey&ng the Town Hall Building -property securing said loan to a Trustee, or Trustees; of theLoanor' s •choosing ; that Horace M. Hallett, Record- • er, be and he is hereby authorized and directed to attest and a- ffix the -seal of -the Town of Leesburg, In Virginia, to said in- truments ; that -the -balance of 010,500.00 due on the purchase of the Diggs property be disposed of in the same manner as set forth in the immediately -foregoing resolution; and that the balance re- maining on hand be deposited with the general funds of the Town. Upon motion -of Maurice R. Lowenbach Jr; seconded by Emmer- son H. James, and carried by a vote of 5 to 0 Gill not voting, ' the following resolution was adopted: BE IT RESOLVED, - by the Council of the Town of Leesburg, in ( Virginia; that - the Auditor-Treasurer be and he is hereby author- ized and 'directed to write -off any town taxes /against the proper- ty of the Leesburg Fire Company. Upon motion -of Frank Raflo, seconded by Emmerson H. James, and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be andhe is hereby authoriz- ed -and directed to have a curb and gutter constructed in front of the Payne property on the east side of King Street. Mr. Riddle gave a report on the possibilites of selling the Town Hall property. Mayor Nickeld stated that the Police Committee and the Pol- ice Department would try and meetin the very near future and make necessary recomendation to the Council regarding the changing of certain traffic ordinances now on the Town Ordinance Book. At a regular meetin-of the Mayor and Council of the Town of Leesburg, in Virginia, held in the Council Chamber, Monday Decem- ber, 14, 1953, at 7 :30 o' clock P. M. , there were present William W. T The minutes of the previous meeting were read and upon motion 100 of Morton Riddle 3rd ; seconded by Reginal K. Gheen, and unam- inously carried were approved as read. The Auditor-Treasurer read his .monthly report -for the month of November, 1953, and presented his current bills, and upon. - motion of Maurice R. Post Office rya -erfli 5. 50 :3, 263.43 Mr. Hartman of the Gulf Oil Company appeared before Con- cil and discussed the matter of purchasing the Town Hall Build- ing, for the purpose of erecting a service station. Council took no action regarding this matter. ! • Mr. Castleman, requested Council to investiagate the sew- - er on West Cornwall Street to see if they could find the cause for the backing of sewage into the basements of homes on that street, Mr. Castleman also stated that his mother had paid a fee for connecting to the Town Sewage System with the understanding that all or a part of this fee would be refunded as others connect- ed to the system. Mayor Nickels requested the Auditor-Treasurer to have Mr. Hough check. the sewer on West Cornwall Street . Members of the Planning Commission presented an anexation report .to Council, and discussed this report at some ,lenght. A . copy of the said report is on file in- the AudtiorrTreasurért office. Upon motion of Frank Raflo , seconded by Morton Riddle 3rd; and carried by a vote of 5 to 1 Gheen, James, Riddle, Raflo, and • Lowenbach, for Gill against the following resolution was adopted : BE IT RESOLVED; by the Council o'f the Town of Leesburg, in Virginia, that the report of the Planning Commission, dated Dec- ember 10, 1953, and in recommendations. for areas to be annesed to the present Town limits', ' togeather with a rough discription ' of the proposed boundries,• be and the same is• hereby. accepted and approved ; a copy of said report is attached hereto, and fur- that Stilson H. Hall, Attorney for the Town; •be' and' he is here- by authorized and directed to draft such resolution as may be 10 1. necessary for the annexation of the territory shown in said re- port. BE IT FURTHER RESOLVED, that William W. Nickels, Mayor, be and he is hereby authorized and directed to secure the services of a certified surveyor to make a survey, draft the necessary plat or _plats and furnish metes and boundsand size of area which the Town propose to annex. Mayor Nickels appointed Frank Raflo, Maurice R. Lowenbach Jr; and Howard b. Gill, as a committee to work on the annexation. Upon motion of Frank Raflo, seconded by Morton Riddle 3rd ; and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby author- ized and directed to have two parking meters removed from the north side of Market Street in front of the Harrison property and that this area be made a NO PARKIng L.0hi. Upon motion of Morton Riddle 3rd; seconded by Maurice R. Lowenbach Jr; and carried by a vote of 4 to 2 Riddle, Lowebach, James and Raflo for Gheen and Gill against, the following resol- ution was adopted : BE IT RESOLVED, by the Council of the Town of `Leesburg, in Virginia that the Auditor-Treasurer be and he is hereby authoriz- ed and directed to have published in both of the newspapers in the county an ad for bids to remove the trash and garbage from 4 .� the Town, and the said bidders shall state in their bids the type equipment that will be used for the said work, the number of times • they propose to remove the trash and garbage each week, that will despose of all trash and garbage in the Town' s land fill, and the Town of Leesburg agrees •depose of any trash and garbage sn- its land fill, collected out side of the Town of Leesburg at a rate of $ 8.00 per hour for the use of the bull dozer. The Town of Leesburg has the right to reject any and all bids. The said bids shall be sealed and in the office of the Auditor- reasurer not later than Janurary 11th ; 1954. ` Mayor Nickels gave a report on work that had been done by the Police Committee. Upon motion of Reginal K. Gheen, seconded by Emmerson H. James and unaminously carried the following ordinance was adopt- ea : BE IT ORDAINED; by the Council of the Town of Leesburg, in Virginia that the owner or custodian of any fowl shall keep the same on his or her premises. The violation of this ordinance shall be punishable by a fine of not less than $1.00 nor more than $50.00 and each violation of the previsions of this ordinance shall con- situte and distinct offense. Upon motion of Reginal K. Gheen, seconded by Frank Raflo, and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of 'Leesburg, in Virginia that the Honorable Lucas D. Phillips be, and he is here- by requested and directed to present a bill for enactment into - law, at the next session of the General Assembly of Virginia, to amend the charter of this Towb for the purpose of giving the Town Council , in its discretion, power and authority to appoint not more than- two justices of the peace for said Town, the law to be come effective immediately, and the first appointment or appobft ments to expire August 31, 1955, and there after the terms of off- ice expiring simultaneously with the terms of office of the council exercising the power of appointment, the lawnprdvidifg the qual- itication of 'office, of the justice of the Peace, including the requirements that they be residents of said Town and also provid- ing for removal- of said justice of the peace.
