SPECIAL DECEMBER-24, 1953 -
At;a special meeting of the Mayor and Council of the Town of Leesburg,
in Virginia, held in the. Council Chamber, _Thursday December 24, 1953, at 10:00
o'clock A. M., there were present William W. Nichels, Mayor, Horace M. Hallett,
Recorder, Reginal K. Gheen, Howard B. Gill, Maurice R. Lowenbach, Jr; Frank Raflo
and Morton Riddle, 3rd; Councilmen.
On motion of Councilman Morton Riddle, seconded by Councilman Frank
Raflo, and unanimously carried, a majority of the Council of the Town of
- Leesburg in Virginia being present and• yoting, the following ordinance was
adopted.:.
-' WHEREAS, pursuant to Chapter 24 of the 1950 Code of Virginia, and
all acts amendatory thereof, the Council of the Town of Leesburg in Virginia, 111.
ado-'ted a Zoning ordinance for the purpose of establishing zoning districts
within the said Town: and
WHEREAS, by virtue of the said ordinance the Circuit Court of
Loudoun County has heretofore appointed members of a Board of Zoning Appeals
for •said Town; and
WHEREAS, by an order of record in the Clerk's Office of said Court
in Common Law Book 20, at Page 249, John Allen Johnston, John W. Clemens, R.
K. Gheen, Howard B. Gill, and Richard Burbank, were appointed as the.Board of
Zoning Appeals for said Town; and
WHEREAS, John Allen Johnston, John W. Clemens, R. K. Gheen and
Howard B. Gill, have tendered their resignations as members of Said Board and
the Council is willing to accept said resignations; and •
WHEREAS, the Council of the said Town desires that the four vacan-
cies shall be filled by the appointment of Lawrence Muse, William J. Cox, Fred
A. Brock and John W. Pumpheey, and that Richard W. Burbank shall be contin-
ued as a member of said Board of Zoning Appeals; and
WHEREAS, the Council of the 'said Town recommends to the Court the
appointment Of Lawrence Muse, William J. Cox, Fred A. Brock, John W. Pumph-
rey and Richard W. Burbank as the Board of Zoning Appeals for said Town,
which Board shall be empowered with all the authority and charged with the same
duties recuired under Chapter 24 of the 1950 Code of Virginia and all acts
amendatory thereof, and whose terms of office shall expire three years ftom
the date of the appointment by the Court; which Board of Zoning Appeals
shall be empowered with all the authority' provided under the laws of the
-Commonwealth of Virginia relating to Boards of Zoning Appeals for Towns in
this State; and
• WHEREAS, the said Council is advised that in order to fill the
vacancies on this Board of Zoning Appeals it is necessary to institute pro-
ceedings in the Circuit Court of Loudoun County, Virginia, for the purpose
-of re-uesting the appointment of members of the Board of Zoning Appeals; and
WHEREAS, the Council of said Town has requested Stilson H. Hall,
Town Attorney, to present this ordinance and to ipetition the Court to enter an
order appointing members of the Board of Zoning Appeals for said Town.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Lees-
burg, •in Virginia, as follows:
(1) That the resignations of John Allen Johnston, John W. Clemens,
R. K. Gheen, and Howard B. Gill as members of the Board of Zoning Appeals
for said Town be, and the dame hereby, are accepted.
(2) That Stilson H. Hall, Attorney be, and he hereby is, authorized,
' instructed and directed to institute and prosecute all necessary and proper
- proceedings for the purpose of the -appointment' of Lawrence Muse, William J.
Cox, Fred A; Brock, John W. Pumphrey and Richard W. Birbank as the Board of
Zoning Appeals of the Town of Leesburg in Virginia, for a term of three years
beginning with the date of the order of appointment to be made by bald Court.
(3) That the-aforesaid Lawrence Muse, William J. Cox, Fred A. Brock,
John W. Pumphrey, and Richand W. Burbank, shall constitute the Board of Zoning
Appeals for the said Town, and said Board shall be vested with all the power
and authority and shall be subject-to all restrictions provided by the laws of
the Commonwealth of Virginia for Board of Zoning Appeals for towns in this
State.

(4) That the Auditor-Treasurer, be, and he hereby is,-authorized,
instructed and directed to advance and pay all necessary costs for the pur-
pose of instituting and prosecuting these proceedings in the Circuit Court
of Loudoun County, Virginia.
(5) That the Recorder of said Town be, and he hereby is, author-
ized and instructed to deliver two certified copies of this ordinance to
Stilson H. Hall, Attorney, Leesburg, Virginia

RESOLUTION AUTHORIZING LOAN OF $15, 000.00
ON TOWN HALL PROPERTY ON EAST SIDE OF KING
STREET IN THE TOWN OF LEESBURG, VIRGINIA.
Upon motion of Frank Raflo, seconded by Reginal K. Gheen and unaminously
carried the following resolution was adopted:
BE •IT RESOLVED, by the Council of the Town of Leesburg, in Vir-
ginia, that the resolution relating to the borrowing of money on the Town
Hall Building, which was passed by this Council on Noven@er 9; 1953, be,
and the same is hereby amended and reenacted to read as follows:
BE IT FURTHER RESOLVED, that William W. Nickels, Mayor, be and
he hereby is, authorized, empowered and directed for and on behalf of said
Town to borrow the sum of $15.000.00 to be secured by a first deed oftrust
on that certain parcel or lot of land described as follows:

That certain tract of land situated on the southwest .
corner of King and Loudoun Streets, in the Town of
Leesburg, Virginia, adjoining the lands of Meade,
Fadeley, et al. ; being the same land conveyed unto
the Town of Leesburg in Virginia by Henry Heaton,
Special Commissioner in ghe Chancery suit of Meade v.
` Boss, by deed dated July 8, 1979, of record in the
• Clerk's Office of the Circuit Court of Loudoun County, ,
Virginia, in Deed Book No. 6 N's at Page 289.
BE IT ALSO RESOLVED, that William W. Nickels, Mayor, be and
he hereby is, authorized, empowered and directed for and on behalf of said
Town to execute a negotiable and promissory note, under seal, bearing date
of the 4tlt: day of Uanuary,, T.95tL, made payable to the order of The Peoples
National Bank of Leesburg, Leesburg, Virginia , for the sum of $15,000.00,
with interest from date at the rate of 3% per annum, payable semi-annually,
said note to be made payable to The Peeples National Bank of Leesburg, Lees-
burg, Virginia, on or before August 20, 1955, and to be secured by a first
deed of trust note.
BE IT ALSO RESOLVED, that the deed of trust herein authorized shall
be a lien on the following land:
That certain lot of land on the East side •of King Street in the
Town of Leesburg, Loudoun County; Virginia; adjoining the land of
Fadeley and Boss (now the property of said Town) .
Being the same land conveyed to the said Town by William B. Carr,
et al. , by deed dated August 6, 1887, recorded in the Clerk' s office
aforesaid in Deed Book 6 Z' s, at Page 407.
