REGULAR APRIL 12, 1954 • - • At a regular meeting of the Mayor and Council of the Town of Leesburg, in Virginia, held in the Council Chamber on Monday, April 12, 1954, at 7 :30 o' clock P. M. , there were present : William W. Nickels , Mayor, Horace M. Hallett, Recorder, Reginald K. Gheen, Ho- ward B. Gill, Emmerson H. James, Maurice R. Lowenbach, Jr. , Frank Raflo, and Morton Riddle, III, Councilmen. The minutes of the regular meeting of March 8, 1954, were read and upon motion of Reginald •K. Gheen, seconded by Emerson H. James and unanimously carried, were approved as read. The minutes of the special meeting of March 29th, 1954, were read and upon motion of Frank Raflo, seconded by Reginald K. Gheen, and unanimously carried, were approved as read. The minutes .of .the .special meeting of .April .7th, 1954, were read and upon motion of Morton Riddle, III, seconded by Maurice R. Lowenbach, Jr. , and unanimously carried were approved as read. The Auditor-Treasurer read his monthly report for the month ending March 31, 1954, and his quarterly statement for the quarter ending March 31, 1954, and upon motion of Maurice R. Lowenbach, Jr. , seconded by Emmerson H. James and unanimously carried, the follow- ing resolution was adopted: WHEREAS, the Auditor-Treasurer has presented to the Town Council of the Town of Leesburg, in Virginia, a quarterly report of all rece- ipts and analysis of all disbursements of January, February and March, 1954. THEREFORE, BE IT RESOLVED, by the Council of the Town of Lees- burg, in Virginia, that the said quarterly report of the Auditor- Treasurer be, and it is hereby accepted by the said Council. BE IT FURTHER RESOLVED, by .the Council OF the Town of Leesburg, in Virginia that the Auditor-Treasurer be, and he is hereby authorized and directed to have a copy of the said quarterly report published in a newspaper in the said Town, and also post a copy of said quarterly report in front of the Court House in the said Town. The Auditor-Treasurer presented his current bills and upon motion of Reginald K. Gheen, seconded by Morton Riddle, III, and unanimously carried the following ,resolution was adopted. Cooley, Treas. 4 23.63/ . Total *669.921' The .Mayor -read a letter from Mr. Robert K. Wilson regarding a contract for a survey of the Town of Leesburg. • Upon .motion of Maurice R. Lowenbach, Jr. , seconded by Morton Riddle, III, and unaminously carried, the following resolution was adopted: . BE IT RESOLVED, by the Council of the Town of Leesburg, in .Virginia, that Robert K. Wilson, certified land surveyor, be and he is hereby employed to make a boundary survey along the boundary lines suggested in the Planning Commissioner' s report= dated December 10, 1953, for the sum of 42,600.00, the field sur- vey to be made with an accuracy of 1 foot in 10,000 feet or better, before adjustment, iron pins to be used in marking the survey lines until such time as it is required, that permanent markers shall be set, that Virginia State Grid Coordinates shall be-included on the linen tracing which shall be drawn to the scale of -1 inch equals • •300 •feet and which shall show the metes and bounds •of the present and new boundaries as well as streets, said •survey to be completed within 90 days from the 5th day of April, 1954, and that in the event the Council of the Town of Leesburg, In Virginia, requests and instructs the said Robert K. Wilsm to furnish and set con11. - crete monuments 6 inches square by 3 feet ,long, to be set in the ground at a depth of 21 feet, the additional sum of 410.00 for - each monument so furnished and set, will be paid to said Robert K. Wilson. Mr. B. Powell Harrison, Chairman of the Planning Commission of the Town of Leesburg, appeared before the Council and •submitted a verbal report regarding the planned u���??-ivision of "Beans & Thomp- son". Mr. Harrison stated that Mr. Tolbort, of the State Highway ,/ Department, has recommended a 50 foot-right-of-way street into the V sub-division if it was possible to obtain the width. Also, Mr. Harrison stated that Dr. Charles G. Souder of the Loudoun County Health Department had submitted only one objection to the proposed sub-division and that was , children living in the sub-division area • would have access to a stream passing through this property which he did not feel was entirely satisfactory. - A written report from the Board of Zoning Appeals of the Town - of Leesburg was read and the following recommendations were made : The Board by unaminous vote makes the--foliowing recommendations to the Council : (1) That the area in question be rezoned from "Residential - District No; -l" to - "Residential District No. 2" 111.(2) And further, that although the sub-division ordinance re- quires a minimum right-of-way-of 50 feet-for a local street, it is the belief-of-the Board of Zoning Appeals that if -it is found that conditions- do not permit that width from the entrance from south . King Street to -the -proposed -sub-division, a right-of-way width of 40 feet might be approved. -. -- --- -- - . _- A letter from Mr. Leon Wolcott -was -read- regpesting that a cer- tain area -of- land be rezoned from "Residential" to "Business-" , and WHEREAS, Leon Wolcott-has requested the -Council of the 'Down of Leesburg, in-Virginia, to -rezone a portion of that certain parcel of 1 .15 land situated, lying and being on East Fayette and .Loudoun Streests in -the Town of Leesburg, in Loudoun County, Virginia, said parcel or • lot of land having a frontage of approximately 150 feet on the to aforesaid streets and constituting a rectangle extending from one street through to the other, being the same land described in those certain deeds dated May 14, 1888, and May 9, 1891, recorded in the Clerk' s Office of Loudoun County, Virginia, being the same land of which- the late Mary E. Waters died seised and which, upon her death, passed to Charles Waters , Mary E. R. Waters and Fannie E; West and which lot or parcel of land is bounded by the lands of Grimes , Raflo ' and others , by changing from "Business-Residential"#1" ;to "Business" , . it being represented to Council that a portion of said property is now zoned "Business". WHEREAS, pursuant to the laws of the State of Virginia, it is provided that the Council is authorized to submit proposals, amend- ments or supplements to any zoning regulations to the Board of Zon- ing Appeals for its report and recommendations after a public hear- ing in relation thereto in the manner and method provided by law; and WHEREAS , the Council believes that the requested change and amendment should be submitted to the Board of Zoning Appeals for its report and recommendation: NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Leesburg, in Virginia: (1) That the Council hereby refers to the Board of Zoning Appeals for its report and recommendation, the said request of Leon ` Wolcott to change the present designation of a portion of said pro- , ' perty from that of "Business-Residential #1" to "Business" , after a public hearing in relation thereto to be held by the Board of Zon- ing Appeals in pursuance of law. . (2) That the Recorder of this Town shall forthwith deliver a certified copy of this ordinance to the Board of Zoning Appeals. Upon motion of Morton Riddle, III, seconded by Emmerson H. James, and unaminously carried the Auditor-Treasurer was authorized and directed to insert and add in the paper notifying the citizens of the Town of Leesburg that there would .be a public hearing to consider the rezoning requested by Leon Wolcott on the 27th day of . April, 1954, at 7 :30 .o' clock P. M. • Reginald K. Gheen, a member of the Finance Committee, pre- sented a proposed budget to the Council for the year beginning July 1, 1954, and ending June 30, 1955, and upon motion of Morton Riddle, III, seconded by Emmerson H. James , and unaminously carried, Council voted to hold a special meeting, May 5, 1954, at 8 :00 o' clock P. M. , in the Council Chamber to give any citzen -of the Town 'of Lees- burg an opportunity to express his views regarding the said proposed budget, and that the said proposed budget be published in a news- paper in the said Town once. A letter from Mr. Vierbeachum was read regarding sewerage ser- vice at the Town sewerage treatment plant, and a proposed price sub- milted. This matter was referred to the Sanitation Committee. Upon motion of Frank Raflo, seconded by Morton Riddle, III,. and carried by a vote of five to nothing, Mr. Gill not voting, the following resolution was adopted: BE IT RESOLVED, by the Council- of the Town of Leesburg, in Virginia, that the resolution passed at the last regular meeting of the Council on the 8th day of March, 1954, appointing Howard B. Gill as Justice of the Peace for the Town of Leesburg, in Virginia, be and the same is hereby rescinded. _. Upon motion of Frank Raflo, seconded by Morton RiddleIII, and said motion was carried by a vote of five to nothing, Mr. Gill not voting, the following resolution was adopted: . 11.,6Rn 4, , BE IT RESOLVED, by the Council of the Towntof'Leesburg, -in Virginia, ''that 'ptrsuant to an act of the 1954 General Assembly of Virginia providing for the amendment of the charter of said Town, that Howard'B. Gill be, and he hereby is , appointed an issuing Justine for the Town of Leesburg, in -Virginia, for' the term begin- ning March 8,- 1954, and •ending August 31; 1955. Upon motion of Morton Riddle, III , seconded by Frank Raflo, and carried by a vote of five •to •nothing; Mr. Gill not voting, the following resolution was adopted : BE.IT RESOLVED that all costs collected by any issuing Justice appointed :by :this Town• shall be paid into the Town treasury at least every month. • • BE IT FURTHER RESOLVED that any issuing Justice appointed for - the Town of Leesburg, in Virginia, shall be compensated at the rate --. of $ ' per year for their services. Mayor Nickels read a letter from the Town' s attorney, Mr. Stil- son H. Hall, in which it was pointed out by Mr. Hall that the Mayor had acted within his authority in dismissing a member of the Town Police Force. • Upon motion of Frank Raflo, seconded by Howard B. .Gill, the following resolution was offered; . BE IT RESOLVED by the Council of the Town of Leesburg, in Vir- - ginia, that Officers Venable, Athey and Turner be retained by. the Town of Leesburg on a permanent basis beginning the ). t day of May, - 1954, and. until the 31st day. of August, 19,55, at a siof ,$250.00 ' per month for Officer Venable, and 3225.00 per month respectively -for Officers Athey and Turner, and if charges of failure to properly -- perform their duty or charges of conduct detrimental to the best interest of the Town be raised againsted any police officer, said . charge will be told at a meeting offUll Council, and the officer in question be granted an opportunity to speak and defend himself. • After some discussion on this resolution, Mr.. Gill and Mr. Raflo withdrew their second and motion. - And.Upon motion of Frank Raflo, seconded by Howard B. Gill,, and unanimously carried.., the following resolution was adopted•;• by the Council•;OF- .the Town of'Leesburg; in Virginia, that Officers •Venable, Athey and Turner by retained by the Town on a permanent basis beginn- ing on. the lat ,i�f May 1954, to continue to the 31st day of Aug- ust, 1955, at d p d of $250.00 per month for Officer Venable, and $225.00 per month for Athey and Turner. • Upon motion of Frank •Ratio, secoriad by Emmerson H. James , and - unanimoua;ly carried the following resolution was adopted:'. • - BE IT RESOLVED by the Council of the Town of Leesburg; in Vir- ginia, that if charges of failure of a policeman to properly per- form their duty or charges of conduct detrimental to the best in- - terest' of the Tbwn -be,raised against anyone of the police officers , - the said charge will be told at a meeting of the whole Council, and the officer in question be granted an opportunity to speak and de- fend himself. . The Sanitation Committee reported that'+after some discussion with an engineer, it appeared that it would cost approximately $7,000.00 to connect the school' "sewer at the corner of Loudoun and - Ayre Streets. The estimate;..formaking the said connection back of of the Town land field would be approximately $6,300.00. • • ' Upon motion of Frank Raflo, seconded by Emmerson H. James, and unanimously carried the following resolution was adopted: • • BE IT RESOLVED by the Council of the Town of Leesburg, in Vir- ginia, that the sum of $1,000.00 of unappropiated balance on hand, - June 30, 1953, be: approropiated to cover a deficit in the depart- ment for the fiscal year 1953 - 1954 as follows : Capital OutlaypSidewalks $1,000.00 • z 1:1.7 • • There is submitted herewith a draft of an ordinance providing for the issuance of bonds of the Town of Leesburg, in Virginia, in the sum of 0250,000.00 for the construction. of a storage reservoir and to obtedh an adequate supply of water for said Town, and for the improvement of the water and sewer systems of said Town. • It is moved that action on this ordinance be tabled until the May meeting of the Council; and It is further moved that Stilson' H. Hall , Attorney for the Town be requested to communicate -with some law firm, that specializes in handling bond issues in order that the.Council,may. be:.assured that the proceedings will be in order so that the bonds will be - . saleable. • Upon motion of Frank Raflo, seconded by Maurice R. Lowenbach, Jr. , the following resolution was offered: • ' BE IT RESOLVED, by the Council of the Town of Leesburg, that a letter be written to the School Board of Loudoun County authoriz- ing them, after due consultation with the sewer committee of the Town, to let a. contract for the construction of a sewer line from the new high school to. a connecting point just below the .town dump*, . the said line to follow the route of the "Dry Mill Road" roadway , . to. where it intersects with the "town branch ' and thence along the line of the branch to a point past the ball field and thence in a straight line. to the manhole at the dump, with the further instruct- -ion that the town will pay for the construction of the line, man- holes and connections from corporate limits to the connecting point, After some discussion and upon -therequest of Maurice R. Lowen- bach, Jr. , and Frank Raflo, the second' and motion were withdrawn. At a special meeting of the Town Council of the Town-of Lees- burg, in Virginia, held in the Council Chamber on Wednesday, April - 14, 1954, at 9 :00 o' clock P. M. , there were present William W. Nick- . els , Mayor, Horace M. Hallett, Recorder, Reginald K. Gheen; Howard B. Gill, Maurice R. Lowenbach, Ji ., and Morton Riddle, III, Council- men. Mr. Barringer, of the Hayes , Seay, .Mattern & Mattern, ,-Co. , Archi- teat Engineers , of Roanoke, Virginia, appeared before the Council and discussed the matter of making a survey regarding annexation, and up- on motion of Maurice R. Lowenbach, Jr. , seconded by Reginald K. Gheen, and carried. by a vote of three to nothing Lowenbach, Gheen, and Gill for; Mr. Riddle not voting, the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that the Council employ the firm of Hayes, Seay, . Mattern and Mattern, Architect Engineers , of Roanoke, Virginia, for furnishing the Town professional. services in anticipation of annexation of territory by the Town. and that such employment be basised• on the basis of costs as. follows : . 1.
