At a regualr meeting of the Mayor and Council of the Town of Leesburg, in Virg- held in the Council Chamber on Monday June 14, 1954, at 7:30 o'clock P. M. there were present William W. Nickels, Horace M. Hallett, Recorder, Reginald K. Gheen, Emmerson H. James, Maurice R. owenbach, Jr; Frank Raflo, Howard B. Gill, and Morton Riddle 111, Councilmen. The minutes of the last regular and four special meetings were read and upon motion of Morton Riddle 111, seconded by Reginald K. Gheen, and unanimously car r- led, were approved as read. - The Auditor-Treasurer read his monthly statment for the month of May, 1954, • and presented his current bills, and upon motion of Emmerson H. James, seconded by Reginald K. Gheen, and unaminously carried the following resolution was ad- opted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to pay the follow- ing bills: • Virginia Electric & Power Co 277.45 • C. & .P. Mr. George Weaver appeared before the Council in the Behalf of Mr. Claude Honicon, and requested the Mr. Honicon be granted permissiohetotbonhect the sew- er line from the house formerly own by by Mrs. Drake and the builing that he is constructing for apartments, into the town sewer system. Mr. Weaver stated that Mr. Honicon would construct the sewer line according to the plans that would be set forth by an engineer for the town of Leesburg. Mr. Weaver stated that Mr. • Honicon would pay the cost of having an engineer make the plans for making the said connection. This matter was refered to the Sewer Committe. Mr. Kindell, of the Leesburg Laundry appeared before the Town Council and requested that his letter to the Mayor and Town Council be read, in which he • had request the Town of Leesburg to permitt the Leesburg Laundry to connect the Laundry waste line to the sewer system. Mr. Coleman Gore, also of the same Camel). any requested that this request be granted, and stated that the State-Water Con- trol Board had ordered the laundry to stop disposing of it' s laundry watte into the stream known as the town branch with out first removing some of the waste. A report from the Johnson Engneers was read, in which it was stated how much additonal load would be added to the town sewer system. This matter was refer- ed to the Sewer Committee. Mr. Timbrook, and Mr. Winston Baker, of the Southern States Corp; appeared before the To-an Council and requested that a certain parcel of land back of their present building be rezoned from Resident to Business and 1 34 . Upon motion of Frank Ratio, seconded by Maurice R. Lowenbach, Jr; and un- aminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia that the I Board of Zoning Appeals be and they are hereby requested to consider the request J of Messers Timbrook and Baker of the Southern States to rezone.a certain parcel- of land that is located at the rearer of the property owned by /tr. -A. T. Elgin on Fayette Street, and a certain parcel of land owned by Mr. Sol Feldman on rout e 7, from Resident to Business. , 4Q1 5. I- .-c.�.-.1Lti �..._Jd ,, Mr. Howard Vesey, appeardd before Council in behalltof Mr. G. Shirley Myers, -and requested the Council to pass a certain resolution make the Tose of Leesburg i a part of the case that is now being heard in the Loudoun County Circut Court. After some lengthy discussion Council decided not to take any action in this mat- ter unless ordered to do so by the said County Court. - - • Mr. Riddle offered a motion that the above matter be refered to the Water Committee, there was no seconded. Mr. Rano, offered a motion in which he requested that the Council be authoriddr to employ an attorney to advise the Council what steps if any should be taken if any in regards to matter of the Myers, Versers The Leesburg Fire Company. This fail- ed to pass. - - • The Sewer Committee, reported that it notified the engneering 9ompany re- garding the connection of the school sewer line to town sewer system and it was expecting -the said company here very shortly with plans to make the said connect- ion. Council informed Mayor Nickels that it would consider any and all offers of the amount of $ 50,900 for -the -Town Hall -property, and Would appreciate it if he would so inform Mr. Lowe. - Upon motion of Frank Raflo, -seconded by•Firmerson H. James, -and carried by a vote of 4 to 2 Rafloq James; Gheen, and Lowenbach, for Riddle, and Gill against the following resolution was adopted: • • - • - BE IT RESOLVED, by the -Council -of the Town of Leesburg, in Virginia that the III. Auditor-Treasurer be -and he -is hereby-authorized and directed th write to the Virginia Electric and power -Company requesting an additional street light to be suitably placed in the last -block -of East -South Street in the section -commonly known as Vinegar Hill. - The Street Committee submitted -a -report in which it made some suggestion re-• garding one way streets, off street • parking, and certain changes to be made at the Town's new parking lot. .The -said report -was discussed at some length, and the Mr. Riddle offered the following resolution; • • . BE IT RESOLVED, by the -Council -of the Town of Leesburg, in Virginia that Mark- et Street be made one way•to the west, and that Loudoun Street be made one way to the east, and King Street have one way parking, this resolution is submitted • subject to the State -Highway furnishing-a-stop light at the corner of King and Loudoun Street. This -resolution did not recive a second. • ',Kr Upon motion of Maurice R. Lowenbach Jr; seconded by Howard B. Gill, and un- aminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the • following resolution found-on page 79 of minutes of meeting of Skptenber, 13, 1937be and the same is hereby-recinded: which is as follows; ("BE IT RESOLVED, -by the Council of the Town of Leesburg , in Virginia, that the ' Mayor be and he ishere]ry authorized and instructed to employ such additional _ policmen as he shall deem necessary and expedient for the purpose-of maintain- ing adequate police protection for the town. No special policeman shall be paid more that thirty five-cents per hour with out further order from the Council. -BE IT FURTHER, ORDAINED; that the Mayor shall have the general supervision and control over all special policemen as •well as the regular police.") -BE IT ORDAINED, by the Council of the Town of Leesburg, in Virginia, as follows; The police force of the town of Leesburg shall be under the control of the Town . Sergent for the purpose of preserving and enforcing peace and order; for the ex- - ecution of the laws of the sate and ordinance of the town; and for the perform- ance of such other duties as the Council may prescribe. - • The Town Sergeant shall be the chief police of the police department but he shall always be subject to general orders and regulations of the Council. • 135 • Thetfshall be under the immediate. control of the Police Committee for the pur- pose of preserving and enforcing peace and order, and excuting the laws of the state and ordinances of the -Town and to dischargesuch other duties as it or the the Council may prescribe. It shall be the duty of the police force to respect and obey orders of the Town Sergeant not in conflict with the laws of the state and ordinances or rules and regulations of the Town. When charges are filed with the town. Sergaent against any member of the police force, or when he shall be informed of any gross neglect of duty, he shall trans- mit same in writing to the Police Committee immediatly, togeather with the nemes of witness to be summioned , that the charges may be fully-investiag ted by the Police Committee. Any member of the Council may at any time and in writing file charges of mis - conduct or neglect of duty on the part of the Town Seggeant .or any policeman wit h the Police Committee, togeather with the nameswitnesses to be summoned so that . the charges may be.fully investiagted by the Police Committee. • If the Police Committee after due consideration feels that the .charges against -the Town Sergeant or- any policeman warrants it, they are hereby empowered to sus- Tend the offieer in question, with out pay .and report their finding at a special • meeting of Council for action to dismiss or retain the officer or officers charg- ed. Further, if the Council vote to retain the officer or officers so charged, -the Auditor-Treasurer is hereby instructed to reimburse the officer or.officers for their full pay lost Oke as the result of suchsuspension. All ordinances or parts thereof which are in conflict with this ordinance are • hereby rescinded . - This ordinance shall become effective on July 1, 1954. The Above resolution was passed on motion of Maurice R. Lowenbach, Jr; Se- conded by Howard B. Gill and unaminously. . Upon motion of Murice R. Lowenbach, Jr; seconded by Howard B. Gill, and un- aminously carried the following resolution was adopted: BE IT ORDAINED, by the Council of the Town of Leesburg, in Virginia, that Keith Venable be and by this ordinance is hereby elected and appointed Town Sergeant for the Town of Leesburg, in Viginia, pursuant to section 28, of the 111 chorter of the said Town, and be it resolved, that the compensation of the said Town Sergaanli is hereby fixed at the rate of $3,000.00 per annum; and . BE IT FURTHER RESOLVED, that this ordinance shall become effective July 1, 1954. The Water Committee Submitted a report regarding the obtaining water from the rock quarry, and after some discussion and upon motion of Howard B. Gill, second-. ed by Frank Raflo, and =ominously carried the following resolution was adopted: BE IT RESOLVED, by the Council in the Torn- of Leesburg, in Virginia that the the Council be and it is hereby authorized to employ Mr. George B. Thomas to run a pump test on the rock query, and that the cost for the said test shall not exceed'the surof $ 500.00 with out further authorization from the said Council. • Upon motion of Reginald K. Gheen, seconded by Emmerson H. James, and un- aminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of -Leesburg, In Virginia, that the • "y4 report of the Board of Zoning Appeals which was tabled on May the 10th, 1954 be removed from the table for consideration of the Council.. • Upon motion of Reginald K. Gheen, seconded by Frank Raflo, and unaminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that a 111 special meeting of the Mayor and Council be called for June 29, 1954, at 8 P M: in the'Council Chamber for the purpose of consfdereMaeing a report of the Board of Zoning Appeals requesting of rezoning of the Walcott property, and such other business as may properly come before this meeting , and • BE IT FURTHER RESOLVED, that the Auditor-Treasurer be and he is hereby author- ized and directed to have a notice of said special meeting published as pppv- ided by law and ordinance. Mayor Nickels read a letter from Mr. Stilson H. Hall, and also a letter from Mr, Hardee Chambliss regarding the Town using the right of way over the Washing- ' ton Old Dominion Railroad track to go to and from the town sewage plant. No act- ion was taken regarding this matter. Upon motion of Reginald K. Gheen, seconded by Frank Raflo, and unaminously • carried the following vas adopted: - BE IT RESOLVED, by the Council of the ,Town of Leesburg, in Virginia as follows; . 136j HEEea£ter, the voting place for the Town elections shall be at the same place in the Town of Leesburg that County and state elections areheld. ' At a special meeting of the Council of the Town of Leesburg, in Virginia, held in the Council Chamber on Tuesday June 29, 1954, - at 7 :30 o ' clock P. M; there. were present Horace M. Hallett, Record- er, Reginal K. Gheen, Howaed B. Gill, Emmerson H. James, Maurice R. - Lowenbach, Jr; Frank Raflo, and Morton Riddle,lll, Councilmen. Mule tobthe 8bsetteonfaMayoreNickelsr Horace M. Hallett,was re- quested by Council to preside at this meeting._ Upon motion of Emmerson H. James, seconded by _Reginald K. Gheen and unaminously carried Frank Raflo was elected to serve as record- er dt this meeting. Mr. Robert K. Wilson appeared before Council and presented a rough draft of the survey of the area that is being considered for annexation, and requested council to study the draft and make any suggestion it felt would be helpful. Mr. Wilson request another payment of $1,000.00 on the work that he had completed for the town and unon motion of. Morton Riddle 111, seconded by Reginal K. Gheen, and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virinia, that the Auditor-Treasurer be and he is hereby authorized and directed to pay to Mr. Robert K. Wilson, the sum of $1,000.00 as another payment on the work that the said Mr. Wilson had render- . ed for the Town, in its survey work. At 8 o 'clock P. M; the notice regarding the calling.of a special meeting of Council to co ndider the reccommendation of the Board of Zoning Appeals was read, and upon motion of Frank Raflo, seconded by Reginal K. Gheen, and unaminously carried the follow- ing resolution was adopted : • BE IT RESOLVED4, by the Council of the Town of Leesburg, in Virginia, that the Council dccepte the recommendations of the Board of Zoning Appeals to rezone the parcel of land situated, lying, an d being on East Fayette Street in the Town of Leesburg, in Virginia said parcel or tract of land being the same land discribed in those certain. deeds dated May14, 1888 and May 9, 1891, recorded in the Clerk' s.Office of Loudoun County, Virginia and being the same land of which the late Mary Waters deied seized and which, upon her death passed to Charles, Waters, Mary E. Waterd, R. Waters, and Fannie E. West and which parcel of land is bounded by lands of Grimes, Ratio, • and others, be and it is hereby rezoned from Residental No.1 to Business District. Upon motion of Frank Raflo, seconded by Morton Riddle 111, and unaminously carried_ the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in _ Virginia, that George E. Ward, Auditor-Treasurer and Raymond Hough Pumping Station Operator be given a vacation of two weeks or pay at the regular rate in lieu thereof. Mr. Ahalt, and Lowe, appeared before council and discussed _ the matter of laying the 'sewer line, and by whom the cost would be bore. No action was taken in regards to this matter.
