Mr. Raflo told the Mayor and Council that he believed that he was expressing the opinion of the entire Councilwhen he stated that .the Council was willing to accept the decision of Judge Snead re- garding the Mayor of the Town of Leesburg having certain veto power, but at the same time that the said decision had caused a great deal of controversey threw out the State of Virginia and that the ques- tion of veto power had not been tested for at least fifty (50) years ; that in the best interest of -the Town of Leesburg and other Towns the - decision of .Judge Snead should be appealed and in so doing it would not in any way cause the tax payers of the Town of Leesburg any further expense, and upon motion of -Frank Raflo, seconded by Reginald K." Gheen, and unanimously carried, the following resolution was adopted : BE IT RESOLVED by the Council of the Town of Leesburg that it is the wish of the Council that the opinion of Judge Rayner V. Snead, authorizing that the Mayor. of Leesburg has veto power be appealed to the Supreme Court of Appeals of Virgina and that Wilbur C. Hall, Attorney, be, and he is hereby authorized and empowered to effect said appeal.. There being no further business , upon motion dully made, second- ed and carried, Council adjourned. • • • Prti Mayor Recorder • SPECIAL, JULY 16 , 1954 At a special' meeting of the Mayor and Council of the Town of LQesburg,-in -V-irginia, -held in the Council Chamber on Friday, July 16, 1954, at 7 :30 o' clock-P.. M. , there were present William W. Nickels , Mayor, Reginald K. Gheen; Emerson H. James, Howard B. Gill, Maurice Lowenbach, -Jr. , and MortonRiddle-, III , Councilmen. _ Due to the absence of the Recorder Morton Riddle , III, was a- ppointed to serve as Recorder Pro-tem. Upon motion of Reginald K. Gheen, seconded by Morton Riddle, III, and carried by a vote of three to two - Gheen, Riddle and Lowenbach for, Gill and James against the following ordinance was adopted : BE IT ORDAINED by the Town of Leesburg, in Virginia, that until such time as the Council. shall by proper ordinance declare that an emergency no longer exists on account of the shortage of the Town's water supply, it shall be unlawful : (a) For any person, firm' or corporation to use water from the Town' s supply system for the purpose of washing or- cleaning any motor vehicle. A fine of not less the $5.00 or more than $25.00 shall be im- posed for each violation of Section (a) of this ordinance. (b) For any person, firm or corporation to use water for any air conditioner or similar cooling plant without- equipping the same with a standard re-circulation system, so that-the air conditioner or cooling plant *ill use the same water and not a continuous supply from the Town water supply system. 144 A fine of not less than $5.00 or more than $25.00 shall be imposed for .each violation of Section (b) of this ordinance. (c) For any person, firm or corporation touse water from the Tdm supply system for the purpose of watering or sprinkling lawns, gardens , shrubbery or to use the same for washing pave- ments or sidewalks. A fine of not less than $5.00 or more than $25.00 shall be imposed for each violation of Section (c ) of this ordinance. These ordinances shall become effective on July 23, .1954. ' /S/ William W. Nickels July 16, 1954 Mayor Nickels read a letter from Mr. W. E. Lindsey of the Hayes , Seay, Mattern and Mattern, Engineering Company, in which he referred to several of the sewerage problems of the Town of Leesburg. No action was taken regarding this letter. Frank Raflo was recorded present at this time and voted in all remaining action. Bids were received for the construction of the sewerage line from the new high school to connect to the Town' s sewerage system. The bids were opened and read by Mr. 0. L. Emerick, Superintendent of the .Loudoun County School Board, and upon motion of Maurice R. Lowenbach, Jr. , seconded by Frank Raflo and unanimously approved, Council adjourned to an executive session of Council: Upon motion of Frank Raflo, seconded by Maurice R. Lowenbach, Jr. , and unanimously carried Council reconvened to it' s regular session of Council. Upon motion of Frank Raflo, seconded by Maurice R. Lowenbach, Jr. , and unanimously carried, a resolution. was adopted as follows : WHEREAS, pursuant to advertisement in the Loudoun Times-Mirror, Leesburg, Virginia, bids for the construction of a sanitary sewer line to connect with the Leesburg Consolidated High School sanitary sewer line were filed by the following bidders in amounts as follows : Martin & Gass , Inc. , Arlington, Va. 05,301.60 J. S. McCanless , Middleburg, Na... 4,300.00 W. C. Spratt, Fredericksburg, Va. 4,300.00 Blackwell Engineering' Co.. , Warrenton, Va. 3,640.00 M. J. Bles , McLean, Va. 6,665.00 That said bids were duly received, opened and publicly read in chambers at the Council meeting held on the evening of July 16, 1954; and, WHEREAS, after the consideration of all of said bids for the construction of the sanitary sewer line, and it appearing that Blackwell Engineering Co. is the lowest and best bidder for the• construction of said sanitary sewer line, in the sum of $3,640.00; ' and • WHEREAS, said low bid was made pursuant to the terms , provisions and conditions of the drawings , specifications and proposal prepared by Hayes , Seay, Mattern and Mattern, Engineers, Roanoke, Virginia, 111 and designated as "Sanitary Sewer Line, Comm. 840-B, Item• 1' NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Leesburg, in Virghia as follows : (1) That the bid of Blackwell Engineering Companyfor the • construction of the sanitary sewer line• in ' the sum of 3,640.00; is hereby accepted, determined and declared to be the lowest and best bid. That the awardee shall enter into a contract for the construction of said work, as heretofore prescribed by the plans , • specifications and contract documents. 1.4 5 (2) That William W. Nickels , Mayor, is hereby authorized and d-irected to execute said contract in the name of and for and on behalf of the Town of Leesburg, in Virginia, and the Recorder .is authorized to attest and affix the seal of said Town to the con- tract. (3) That the four other bids submitted on this project be, and they hereby are rejected. • Mr. H. C. Berkeley of the Sydnor Pump and Well Company appeared before Council and discussed the feasibility of drilling a well to alleviate the present water shortage. No action was taken regard- ing this matter. . Upon Motion of Reginald K. Gheen, seconded by Maurice R. Lowen- bach, Jr. , and unanimously carried, the following resolution was adopted; . BE IT RESOLVED that Mr. G. B. Thomas be authorized to run • tests on such wells as the Water Committee designates , located on . the properties of certain individuals with whom the Water Committee has worked out an agreement evidenced by a memorandum in writing to that effect. • Upon motion of Frank Raflo , seconded by Reginald K. Gheen, and unanimously carried, the following resolution was adopted : • BE IT RESOLVED by the Council of the. At a special meetin of the Mayor and Councilof the Town of Leesburg, in Virginia, held in the Council Chamber on Thursday, July 22 , 1954, at 7 :30 o' clock P. M. , there were present William W. Nickels , Mayor, Horace M. Hallett, Recorder, Reginald K. Gheen, Howard B. Gill, Emmerson H. James , Maurie R. Lowenbach, Jr. , Frank Raflo and Morton Riddle, III, . Councilmen. Mayor Nickels read a letter from- Mr. Albert F. Anderson, attor- ney for Mr. Frank Epps in which he requested a payment of $1,400.00 for the use of water taken from the Rock Quarry and for damages to the said area. The Council has requested the Auditor-Treasurer to -write a letter to Mr. Anderson requesting arCitemized statement for the said bill. Mayor Nickels read a letter from the Virginia Department of Highways regarding certain signs being placed on the Highway Depart- ment' s right-of-way. This letter dated June 22, 1954, was turned over-to the Street Committee for further investigation. Mayor Nickels stated that he had met with Mr. Riddle, Mr. Raflo and Mr. Lough regarding the construction or the possibility of con- structing a sewer line in Mr. Lough' s -Subdivision, but thattno agree- ment or recommodations had been reached or made. Upon motion of Frank Raflo, seconded by Maurice R. Lowenbach, Jr. ; and unanimously carried the following resolution was adopted:
